Request for Vadance from Code Section 280-15 and 15D and the Building Inspector's September 20, 2010
Notice of Disapproval based on an application for building permit to construct an accessory garage at; 1 ) at
less than the code required front yard setback of 50 feet, 2) dormers at moro than the code permitted 40% of
the roof width, at: 830 Clearview Rd., (adj. to Cedar Beach Harbor), Southold, NY. SCTM#1000-89-3-11.5.
The proposed action has been roviewed to Chapter 288, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed action is
EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item "F" and "11' which state:
F. Granting of individual setback, lot line and lot area variances, except in relation to a
regulated natural feature or a bulkhead or other shoreline defense structure or any activity within
the CEHA;
The proposed dormers aro rocommended as CONSISTENT with the LWRP.
The vadance requested will not affect a regulated natural feature and the parcel is not located within
the Coastal Erosion Hazard Area.
