Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards to the .qreatest extent practicable and therefore is CONSISTENT with the LWRP. The existing shed located in the side yard is EXEMPT from LWRP review. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including BuiMing Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: Referring to the attached aerial photograph, please note the property located to the south, directly across Harbor Lights Drive, the adjacent property to the west and the following property to the west are all improved with similar residential swimming pools. These swimming pools have been in-place and in-use for over ten (10) years without resulting in any change in the character of the neighborhood or detriment to nearby properties, including the Blackley property. Additionally, the proposed swimming pool will be substantially screened from the surrounding neighborhood by existing landscaping, fencing and the actual dwelling. Furthermore, the proposed swimming pool will be proposed at grade, further decreasing its visibility from the surrounding neighborhood. Consequently, we do not anticipate that this proposal will create a detriment to nearby properties. With respect to the existing frame shed, this structure is a typical residential appurtenance for storage of lawn & gardening equipment, and has existed hereon for the past five (5) years without resulting in any form of change in the character of the neighborhood or detriment to nearby properties. Additionally, the existing shed is also substantially screened by existing landscaping, fencing and the existing dwelling itself. (~2) The benefit sought by the applicant CANNOT be achieved by some method feasible fbr the application to pursue, other than an area variance, because: With respect to the proposed swimming pool, due to the pre-existing/non-conforming nature of the property in terms of size, opportunity to place any accessory structure within the rear yard is substantially limited from the north by the 75.0' setback required from both the wetlands boundary and the existing bulkhead, and from the south by the location of the actual dwelling and decking. Relocation of the proposed swimming pool into a designated side yard, if possible, would result in further non-conformity with respect to zoning. Relocation of the proposed swimming pool into the front yard would be permissible as per § e80-15 (F), however, it would not be able to meet the required front yard setback of 50.0'. Consequently, the applicant requests a variance of ~0.5' for the construction of a proposed swimming pool located 54.7' from the existing bulkhead. With respect to the existing frame shed, this structure has existed harmoniously within this site for over five (5) years without any form of detriment to this property or surrotmding properties. The applicant requests a variance of $.9' for the existing shed located 6.1' from the side yard property. (3) The amount of relief requested is not substantial because: With respect to the proposed swimming pool. the variance requested amounts to only ~7% of the required setback and which can be represented as being non-substantial. Please note that the existing swimming pool located two (~) properties to the west is situated 5~.0' from a bulkhead and was permitted via Town of Southold Zoning Board of Appeals Determination No. ~685 on May 10, 1999. To date, this swimming pool has existed harmoniously within this property without resulting in any form of detrimental impact to surrounding properties. In that our requested relief is slightly less, we believe that this variance is non-substantial. With respect to the existing shed, this structure has existed hereon for the past five (5) years without any apparent detrimental impact to the surrounding neighborhood due to its minor size and use, as well as it being visually screened from all surrounding neighbors. The shed is situated at 6.1' from the side yard property botmdary, where 10.0' is required. Consequently, relief of only 8.9' is requested, which is slightly less than the width of the shed itself. Consequently, we believe that this variance is non-substantial. (+) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: Again, referring to the attached aerial photograph, please note the property located to the south, directly across Harbor Lights Drive, the adjacent property to the west and the following property to the west are all improved with similar residential swimming pools. These swimming pools have been in-place and in-use for over ten (10) years without resulting in any form of negative impact to the surrounding area, including the Blackley property. Additionally, please note that this project benefits from a New York State Department of Environmental Conservation (NYSDEC) Permit, and will be issued a wetlands permit from thc Town of Southold Board of Trustees. Accordingly, the granting of this variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood. With respect to the existing frame shed, this structure also benefits NYSDEC approval, and meets the required 75.0' setback from the wetlands boundary, as required by the Town of Southold Board of Trustees.
