Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Martin Sidor, Chair Town of Southold Planning Bo From: Mark Terry, Principal Plann~ / LWRP Coordinator Date: September 9, 2011 Re: Proposed Standard Subdivision of Colony Pond SCTM# 1000-52.-5-60.3 Zoning District: R-80 This proposal is for a standard subdivision to subdivide a 13.540-acre parcel into five lots where Lot 1 = 0.8 ac., Lot 2 = 7.7 ac., including a 1 ac. building envelope and 6.8 acres of preserved Open Space, and Lots 3, 4, & 5 = 0.7 ac. in the R-80 Zoning District. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, the proposed action is CONSISTENT with the LWRP, provided that the below recommendations are required Jn the subdivision approval. Figure 1. Subject parcel The New York Department of State GIS- Public Access map was referenced for occurrence of archeo~sensitive areas on site. Althouqh a maiority of the southern area of the parcel is included within an archeo-sensitive, the area in which the residential structures are proposed is excluded form the area, therefore, an archeoloRical survey is not recommended. Figure 2. Subject parcel and Archeo-sensitive areas shown as grey circles. Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. Policy 4.1. Use appropriate siting, scales, forms, and materials to ensure that structures are compatible with and add interest to existing scenic components. Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality: Restore historic or important designed landscapes to preserve intended or designed aesthetic values. This policy has been met with the requiring of a 30' natural buffer along Colony Road and clearing limits on each lot. The clearing limits will function as vegetative buffers to adjacent properties. Protect visual quality associated with agricultural land, open space and natural resources. Avoid structures or activities which introduce visual interruptions to natural landscapes including: a. introduction of intrusive artificial light sources b. fragmentation of and structural intrusion into open space areas It is recommended that the Board waive the street lighting requirements (§ 240-46. Lighting) to preserve the night sky in the area. Minimize losses of human life and structures from flooding and erosion hazards. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. Due to site topography and poor permeability of soils on the subject parcel and adjacent parcels, intermittent flooding occurs on the adjacent property to the northeast during periods of high rainfall. It is recommended that a storm water control measure (shallow swale or trench) be required on the northeast property boundary southwest of the existing driveway easement and foot path. The storm water control should be designed to capture all storm water contributing to the area. To further Policy 5.3. Protect and enhance quality of coastal waters and Policy 5.4. Limit the potential for adverse impacts of watershed development on water quality and quantity. It is recommended that the following best management practices be required to protect water quality of the aquifer and coastal waters: 1. Require the use of native, drought-tolerant plants in landscaping. 2. Prohibit the residential application and use of synthetic fertilizers and pesticides capable of entering the potable water supply. 3. Prohibit the application of lawn fertilizer between December 1st and April 1st. 4. Require only the use of organic fertilizers where the water-soluble nitrogen is no more than 20% of the total nitrogen in the mixture. 5. Require a maximum of t lb. of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 lbs. per 1,000 square feet per year. 6. Prohibit the use of phosphorus-containing lawn fertilizer unless establishing a new lawn or a soil test shows that the lawn does not have enough phosphorus. Fertilizer labels have three bold numbers. The first number is the amount of nitrogen (N), the second number is the amount of phosphorus oxide (P205) and the third number is the amount of potassium oxide (K20). A bag of 10- 5-10 fertilizer contains 10 percent nitrogen, 5 percent phosphorus oxide and 10 percent potassium oxide. The law limits the amount of P205 to less than 0.67%. Therefore the potassium oxide (middle number) should be less than 0.67 for the product to meet the phosphorus lawn fertilizer restriction 7. Prohibit the application of lawn fertilizer on impervious surfaces and require pick up of fertilizer applied er spilled onto impervious surfaces. 8. Prohibit the application of lawn fertilizer within 20 feet of any surface water except: where there is a vegetative buffer of at least 10 feet; or where the fertilizer is applied by a device with a spreader guard, deflector shield or drop spreader at least three feet from surface water. 9. Prohibit the use of underground storage tanks, (except those with spill, overfill, and corrosion protection requirements in place). 10. Require that pervious driveways serve each lot.
