Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfxont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
suooorfin~ facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

PROPERTY OWNERS PARCEL (SUBDIVISION OPEN SPACE PARCEL) LOCATED
IMMEDIATELY TO THE WEST OF THE SUBJECT PROPERTY (See photo below).
MICHAEL & DENISE CHUISANO request a Wetland Permit to construct a deck at the top of the bank
and wood stairs for beach access. Located: 1525 Soundview Rd., Orient. SCTM#15-3-17.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of thc Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department,
as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with tbe following Policy Standards and therefore is INCONSISTENT with the
LWRP:
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions; as set forth in the following section of Chapter 275 of the
Town Wetland Code:
§ 275-11. Constructionandoperationstandards.
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees:
(6) Decks and platforms. No decks or platforms shall be permitted on or near bluffs. Plalfornts

2. Require that existing vegetation on tlae bluffis protectod during Construction and
the applicant limits the clearing of vegetation to the area aecessary to Construct the
access stairway. Any tree~ that are removed shonld be Cut at the base with the
s~umps to remain.
3. Require a ri°ri'turf buffer landward of the bluffto protect the bluff from erosion.
Pursuant to Chaptea- 268 the Board of Trustees shall consider this recommendation
determination regarding the consistency of the proposed action, in preparing its written
