Collins 515 Waters Edge Way Southold, NY 11971 RE: 515 WATERS EDGE WAY, SOUTHOLD SCTM#88-5-60 Dear Mr. Collins: In regards to your letter dated September 5, 2013 and your request concerning the required Non-Turf Buffer landward of the bulkhead, the Board of Trustees cannot modify a project description on a permit without the applicant formally applying for an amendment to that permit. At this time, the Board recommends that you apply for an Administrative Amendment to Wetland Permit #7702 to formally request the 15' wide Non-Turf buffer be modified to a 10' wide Non- Turf buffer along the landward edge of the bulkhead. The Board will make a formal determination of your request at the next available Board Hearing upon receipt of your application. Enclosed is an Administrative Amendment application if you wish to proceed. The fee for an Amendment is $50.00. Along with the enclosed application completed, the office requires two sets of revised project plans for the modification and current photographs of the area of the project. If submitted by September 27, 2013 the Board would review the application on October 16, 2013 with a field inspection at your property on or about October 9, 2013. King President Board of Trustees Dear Mr. King: Following Hurricane Irene I applied for a permit to repair my bulkhead. I followed the proper procedures and was granted permit 47702. As a condition I was required to cut down the jetty on my beach and plant 1500 sq. ft. of beach grass in my back yard. Although essentially requiring the construction of a new jetty, I have no problem with allowing free passage on my beach and will do so. My land does not slope down from the house to the beach and this grass will interfere with my view of the bay. All over town I have seen repairs similar to mine made with a ten foot non-turf buffer. When on my boat in the Jockey Creek, Town Creek area I see new post Sandy bulkheads erected with ten foot non-turf buffers. I care very much about the Bay and am willing to do my share but it sure seems that my punishment is quite severe. I am requesting that you allow us a ten foot non-turf buffer. I guess what I am really asking is that you allow me and my wife to spend our remaining years enjoying the beautiful view that we worked our whole lives to secure. Thank you for your consideration. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10.
