AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
quxxe 21 , 2006, and in consideration of application fee in the sum of $250.00 paid by Principi Properties,
LLC and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to construct a new two-stow restaurant over the existing foundation of what
was a restaurant with the conditions of gutters and drywells to contain roof runoff, a
facility, a non-turf buffer to the east landward of the bulkhead, and all as depicted on the
for the restaurant only and not for the marina, surveyed by Hands on Surveying last revised
July 24, 2006.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee, Principi Properties, LLC, 64300 Main Road, Southold as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated[
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be.
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.

Dear Mr. Anderson:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., June 21,2006 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of PRINCIPI
PROPERTIES, LLC applied to the Southold Town Trustees for a permit under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated May 31, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 21,2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of PRINCIPI
PROPERTIES, LLC to construct a new two-story restaurant over the existing foundation
of what was a restaurant with the conditions of gutters and drywells to contain roof run-
off, a pump-out facility, and a non-turf buffer to the east landward of the bulkhead, and
all as depicted on the plans, for the restaurant only and not for the marina, survey by
Hands on Surveying last revised July 24, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Dear Mr. King,
As you know, this Firm represents Mr. Pdnoipi and the Mill Creek Inn who
are seeking to re-build the existing restaurant over its existing footprint.
This Firm was retained by Mr. Pdncipi in Mamh of this year and on Mamh
21, 2006, Mr. Principi and I met with the Town's Building Inspector to outline the
required steps in obtaining a Building Permit to re-build the restaurant within its
footprint. We were informed that an approval from your Board was required.
On April 26, 2006, a full application to re-build the restaurant was
forwarded to your Board.
Subsequently, it was discovered that the docks had been rebuilt using
treated lumber and were different in size and number. On April 26, 2006 the
applicat!on was withdrawn and a new application, expanded to address the
restaurant and marina related concerns, was filed with your Board. Also, the
applicant removed all of the treated limber associated with the docks and
replacing them with non-treated lumber.
Subsequently, we were advised that high mamh vegetation was cleared
from the property. On April 21, 2006, I met with the full Board on site to review
and discuss the alleged violations.
A Re-vegetation Plan dated May 16, 2006 was prepared and submitted to
your Board. On May 30, 2006 1 received correspondence from you directing me
to revise my application for restaurant and bulkhead, only. The planting plan was
returned to me and the marina related activities were dropped from the
application.
On June 21, 2006, your Board approved the re-construction of the
restaurant subject to the installation of drywells, and a non-furf buffer off the
scutheastem comer of the restaurant to be re-constructed. On August 10, 2006
revised survey were filed with your office consistent with the conditions of permit
issuance.
On August 28, 2006, I met with Heather Cusak, staff to your Board who
informed me that the Health Department would have to "OK" the septic system.
This, I do not recall being part of any decision made by your Board, although my
memory is not always perfect. Shortly theraalter, Mr. Principi submitted the final
approval of the Health Department for the previous restaurant and an
engineering certification prepared by Lawrence Tuthill, which documentation
certified the adequacy of the septic system. Still the requested permit did not
issue and so Mr. Principi met directly with the Health Department. By
correspondence from Walter Hilbert, P. E. Chief, SCDHS Off-me of Wastewater
Management to you dated October 24, 2006, the septic system was declared to
be acceptable for use without upgrade. Still no permit issued.
I am now in receipt of correspondenca from James Richter, R. A. to you
dated October 10, 2006, which correspondence contradicts the your Board's
regulatory decision of May 30, 2006, your Board's approval of June 21,2006 and
the determination of the Building Inspector which only required receipt of your
permit in order to issue the requested Building Permit.
I am sympathetic to runoff concems identified in Mr. Richter's
correspondence but note that Mr. Richter has no jurisdiction over the instant
application. Similarly, Mr. Richter can not establish jurisdiction of other agencies
in this matter. I again request that your issue the wetland permit.
I am authorized by the applicant to commence preparation of a larger site
plan which plan will require approvals of the Town's Planning Board, Zoning
Board, Health Depafb,ent, NYSDEC and your Board and suggest that Mr.
Richter's concerns be addressed within that process as appropriate. I make
myself available to discuss this matter with the Board during its next work shop
although I do not know what more I can contribute to the issue at hand: the
issuance of the permit for the re-construction of the restaurant as already
approved by your Board on June 21, 2006. Please let me know if further
discussion is required.

Dear Mr. King:
At per a request from your office, I have reviewed the proposed drainage shown on
the Site Plan for the above referenced project. The drainage calculations provided do not
appear to address storm water run-off beyond what actually falls on the building. Even ifthis
permit application is directed only at the reconstruction of the restaurant, the surrounding
pavement and/or sidewalk access areas used by the facility should be included in the
drainage design.
Currently, run-off from this Site sheet flows off of the existing pavement areas down to
the state road and ultimately enters the mouth of the creek through drainage structures
adjacent to the existing bridge. It is therefore recommended that additional drainage be
installed to contain all run-off leaving the site. Some of the parameters needed to achieve
this goal may be the installation of curbing and the construction of landscaped buffer areas
at the perimeter of the site. This matter will also become an issue when and/or if the
Planning Board has the opportunity to review this project. It is recommended that the
Engineer for the project provide a revised site plan with spot elevations, contours and/or site
profiles to indicate all existing run-off patterns. It is also recommended that the drainage
design be revised to provide drainage structures or other such means that may be necessary
to contain all surface water run-off on site and out of the adjacent wetland areas.
Additional items that should be considered are as follows:
1. An LWRP Consistency determination should be required.
A New York State DOT Curb Cut Permit should be required.

Existing parking appears to be inadequate. It has been suggested that the adjacent
easterly property will become part of this Site Plan. If this is a true, additional
drainage should be provided. This parcel should also be inspected and the existing
wetlands on this adjacent parcel should be flagged and noted or indicated on the site
plan. It would appear that the wetlands on the adjacent property has already been
encroached upon to store boats and provide overflow parking for the site. This
matter, where related to parking, should also be addressed by the Planning Board.
This Site Plan indicates the proposed reconstruction of a restaurant which no longer
exists. Previously, the Town has made a determination that once a Non-Conforming
Use, Setback or other Code Requirement has been removed it must receive all
approvals as if it had never existed. Due to the fact that this structure has been totally
removed and to be consistent with past Town policies, apl non-conforming issues
should be addressed byall appropriate agencies. Therefore, it would appear that the
Zoning Board of Appeals should be part of the process and must provide the following
approvals;
(1) A Special Exception for USE in this Zoning District, and
(2) Approvals of the Setback from the Existing Bulkhead.

We have reviewed the documentation on the Mill Creek Restaurant existing sanitary system and
find it acceptable for use without upgrade. Please be advised that while the Office of
Wastewater Management will no longer be involved in this project, the Food Unit of the Health
Department must still issue a permit for the use of the kitchen.

(9) A statement of the effect, if any, on the wetlands and tidal waters of the Town that may
result by reason of such proposed operations.
(10) A statement describing any known prior operations conducted on the premises in question
and whether any prior licenses or permits have been issued to erect structures or to dredge or
deposit fill on said premises and whether any such permits or licenses were ever revoked or
suspended by a govemmental agency.
(11) Documentary proof of permits that have been applied for, are pending, and have been
granted, including but not limited to NYSDEC, Suffolk County Health Department, USACOE.
(12) A description of how the proposed activities will be mitigated, including erosion control,
replanting and restoration, designated points of access. All proposed operations will be clearly
defined on a survey and described in a project narrative. The Trustees reserve the right to require
specific replanting and restoration methods. Any replanting and restoration guidelines shall be in
keeping with guidelines set by the Town of Southold.
(13) Current photos of the subject area showing the proposed area of operations from at least
two opposite directions. Each photo should be labeled with the date, time and direction. The
location of the photos shall be noted on the survey, project plan or provided on a separate sketch
map.
(14) Drainage upgrade. At the discretion of the Board, nonadministrative applications may
require submittal of a drainage upgrade plan. This plan must indicate how all existing and proposed
on-site drainage from a two-inch rainfall is retained within the subject parcel landward of the
wetland boundary. Retention can include but is not limited to infiltration or impoundment. All
drainage plans shall show the calculations used to develop the plan. At the discretion of the Board
said plans may require certification from a licensed engineer.
(15) All permit applicants shall submit to the Board of Trustees an affidavit signed by the owner
of the project property which indemnifies and saves harmless the Town of Southold from any
claims arising out of or connected with operations under the permit and from all acts, omissions,
commissions or negligence on the part of the applicant, his agents or employees, in such form as
shall be approved by the Town Attorney.
(16) An ethical disclosure statement as provided by the Town of Southold relating to
applications for permits and other governmental requests.
(17) A statement indicating that submission of false information will result in rejection of the
application and may subject the applicant to criminal sanctions.
(18) A completed Local Waterfront Revitalization Program Consistency Assessment Form.

B. Waiver of certain requirements. The Trustees, upon request of the applicant for a permit,
may waive, in whole or in part, the provisions of Article II, § 275-6A(8), (11), (14) or § 275-
1 lA(2) where it finds that the nature of the proposed operations is such that the requirements of
such provisions are not necessary for a proper consideration of a permit application. The resolution
providing for the waiver shall clearly indicate why the waiver was granted.
§ 275-7. Fees.
A. Every application for a permit filed with the Clerk shall be accompanied by a filing fee of
$250, which includes the first site visit, no portion of which shall be refundable. The fee for an
administrative permit shall be $50. For structures that have been previously built without a permit,
the fee will be doubled. Ifa preapplication site visit is requested, the fee shall be $50. [Amended

TRUSTEE DOHERTY: Is there anyone here to speak on behalf of
the application?
MR. ANDERSON: I know you're familiar with this. I don't
think there's much more to say only that I'm stating for the
record we were coming back with all the odds and ends left
over, which there was a lot to do. ~ation before
~,ou relates to. only the restaur~Dt. -We will b~-com~ng back-
for bulkheads, bulkhead returns, there's ~loing to be a
planting plan establj~h¢~JoL~ I'm hoping to
'~esign a Iow profile bulkhead that will follow the shoreline
on the east and west and pull out the brick that's presently
there to stabilize that embankment. I would like to redo
all the docks so they are brought up to code, that they're
functional, that they're better suited than they are today.
I'd like to dredge the inlet. So there's a lot to do
here. When I come back to do next, there's going to be more
agencies involved including the Town's Planning Board,
Town's Zoning Board, DEC, Army Corps, Department of State.
I am here to advise you that's what I intend to do. If for
some reason I am not working on this anymore, I will let you
know that. But the restaurant is really all we're here to
discuss today. There was, always has been an apartment
above, your notice speaks to the apartment. It doesn't
matter to me if you are here to rule on that today or
whether we come back. You can leave that back, I'm
perfectly happy with that because that's going to involve a
special permit from the Zoning Board of Appeals.
TRUSTEE DOHERTY: I'd like to leave it off because right now

it's not allowable in the code. You can have the second
story, you won't have to come back for us when you do the
living space because you're not expanding on the building.
You will have to go to building and zoning. So I'd like to
take that part off the application.
MR. ANDERSON: I agree.
TRUSTEE DOHERTY: What about your septic?
MR. ANDERSON: We have --the approvals aro still in force.
These are approvals for 188 seats, believe it or not, that's
what that current septic is designed for. It includes the
grease traps. The use of this is going to be far less than
what it's historically designed for. It's already in the
ground. It's between the building and the road.
TRUSTEE DOHERTY: And it's fully functional.
MR. ANDERSON: Fully functional.
TRUSTEE DOHERTY: What about drainage; do you have dry wells
on this survey?
MR. ANDERSON: I don't know if I do, but I'm perfectly happy
to add those.
TRUSTEE DOHERTY: Yes. I'd like to see those on here. I'd
like to see as many as you can.
MR. ANDERSON: We can give you a two inch rainstorm and
calculate that out and engineer it the way commercial site
plans are supposed to be engineered.
TRUSTEE DOHERTY: That would be groat. So we'll take off
the section on the second-story living space that is not
included in this. So I'll read it quickly. It's a Wetland
Permit to construct a new two-story restaurant over the
existing foundation of what was a restaurant with the
existing septic system that is fully functional and dry
wells.
TRUSTEE HOLZAPFEL: Can I add a couple of things?

or building a marina, and are we talking marina here?

TRUSTEE HOLZAPFEL: The line I'm getting to is when you
reconstruct or build a marina, the Town code says you have
to build a pump-out station.
MR. ANDERSON: I would think you should have a pump-out
station. I would anticipate that you would require one.
TRUSTEE HOLZAPFEL: I don't see it here.
MR. ANDERSON: That application hasn't been filed.
TRUSTEE HOLZAPFEL: What it says is construction of new or

additions to existing marinas, shall require establishment
of a pump-out facility.
MR. ANDERSON: Again, I'm coming back because we have a
problem with the number of slips and everything else, and I
anticipate that as a requirement.
TRUSTEE DOHERTY: This is not an addition, so to speak,
because he's putting the same size structure that was there
before.
MR. ANDERSON: This is just the restaurant.
TRUSTEE HOLZAPFEL: But he's building a whole building, you
can't say it's nothing.
TRUSTEE DOHERTY: I'm not saying it's nothing.
TRUSTEE HOLZAPFEL: I just think it's an opportunity to get
it in now, so let him get it in now. What are we going to
say next, he has all the docks in there already.
MR. ANDERSON: John, let me be clear, we are going to
completely redo the docks. In '92, your last record goes
back to when Dean Blakey operated it, and there were -- I
don't remember the numbers, but for the sake of argument
there were 20 slips and now there's more like 40. So this
thing went from 20 to 40 over a 15 year -- 14 year period
with apparently no paper approval record. So one of the
things I have to do is come in and fix that.
TRUSTEE HOLZAPFEL: I understand. One of the things I'd
like to see that get in it in now.
MR. ANDERSON: Well, you're going to get it anyway.
TRUSTEE BERGEN: John is saying let's put it in now.
MR. ANDERSON: Put it in now, probably what you would have
is a hand-held. But I don't know that right now, the only
thing I'm hesitating is there's any employees there to
service the marina. It's more like people just sort of dock
their boats there. I don't know who's going to be operating
it right now is what I'm saying.
TRUSTEE HQLZAPFEL: That's something to work out.
TRUSTEE DOHERTY: Since you have to include the dry wells
and everything, you have to include it on these plans.
MR. ANDERSON: What you're going to see is that, like we
have a brick trove, it's like a wheelbarrow and really what
you're looking for is an area where it connects to the
septic system.
TRUSTEE HOLZAPFEL: No. From boating, the Town is going to
spend $85,000 now for a pump-out boat.
TRUSTEE DOHERTY: Minus the grants.
TRUSTEE HOLZAPFEL: The government is investing $90,000 for
a pump-out boat, and we are making a sacrifice, and this is
an opportunity to put a pump-out station in a marina that

there isn't. That's all I'm trying to get across.
MR. ANDERSON: I'm fine with that. What does it look like
on a plan; is it an area that's designated?
MR. MCGREEVEY: Where does it get pumped into?
TRUSTEE HOLZAPFEL: It doesn't get processed there. Usually
you call up and have it taken away.
TRUSTEE DOHERTY: They have a holding tank and they have a
service come.
MR. ANDERSON: You want like an underground receptacle?
TRUSTEE HOLZAPFEL: No. Some of them have little portable
tanks too. What you said before.
TRUSTEE BERGEN: Portable, almost a hand cart, a
self-contained tank.
TRUSTEE HOLZAPFEL: If I bring my boat up to the marina and
say I need to pump out, you need to have a facility to
accept it. It's nothing major.
TRUSTEE BERGEN: Cutchogue Marina has one, New Suffolk has
one.
MR. ANDERSON: The one we use in Brick Cove, there's a boat
that they use and also a wheelbarrow and I believe that goes
into their own septic system, but I could be wrong.
TRUSTEE HOLZAPFEL: You're wrong about that.
TRUSTEE DOHERTY: Are there any other comments from the
audience, from the Board?
MR. JOHNSTON: Are all the Trustees familiar with the
language?
TRUSTEE DOHERTY: I'll read it. it says construction of new
marinas and additions to existing marinas shall require
establishment of pump-out facility for vessel sanitary
waste, and that's for commercial docks, marinas, yacht clubs
and restaurants, and it says and restaurants. It's Section
97-27 (2) commercial docks, then in parentheses marinas,
yacht clubs, restaurants. All right, I make a motion to
close the public hearing.
TRUSTEE KING: Second.
TRUSTEE DOHERTY: All in favor?. ALL AYES.
TRUSTEE DOHERTY: I make a motion to approve the request for
a Wetland Permit to construct a new two-story restaurant
over the existing foundation of what was a restaurant with
the condition that we get a new survey showing the dry wells
to contain all roof runoff; and, as I stated before, the
septic system is functional, and also to have a pump-out
station as per code on the plan and --

TRUSTEE DOHERTY: You know, that's a good point I believe it

is now, isn't it? And it's asphalt already, so the dry
wells -- the drainage for the whole property so not just the
restaurant.
MR. ANDERSON: I would suggest we do the dry wells for the
building. We have to go through a whole site plan review.
TRUSTEE DOHERTY: The Planning Board will address the
drainage on that. I have already spoken to them and the
Building Department, actually this part does not have to go
to Planning Board, it goes to the Building Department, and I
spoke to Mike Verity, and he is also addressing draining.
MR. MCGREEVEY: It is also a concern.
TRUSTEE DOHERTY: Yes, it's a concern with the Building
Department. And the one section behind the bulkhead, on the
east side, there's nothing there right now just sand; what
is planned there for plantings?
MR. ANDERSON: The bulkhead should be extended at least
another 10 or 12 feet on both sides and there should be a
return. When they did the bulkhead work, again, without a
permit, which we have to correct, in my opinion, it's not
even done properly, so you're going to see that.
TRUSTEE DOHERTY: I'm talking not directly behind the
bulkhead but on the east side of that building, the little
corner. This area here, there's nothing there right now.
MR. ANDERSON: I don't think we have any plans for that.
TRUSTEE DOHERTY: I don't want to see any hard surface or
grass there.
MR. ANDERSON: Gravel or --
TRUSTEE DOHERTY: Gravel or plantings, just like a buffer
area. I don't want lawn. We don't want lawn all the way
over here.
MR. ANDERSON: Why don't I then, I'm going to revise this
and send it back for dry wells and so forth.
TRUSTEE DOHERTY: Yes, this is all subject to revised plans.
MR. ANDERSON: You want a designated area in here and say
nonturf area?
TRUSTEE DOHERTY: Yes. And the other area there's no area
to put in turf.
TRUSTEE KING: That was pitched and graded towards the
bulkhead too. You have to be careful.
MR. ANDERSON: You remember, Jimmy, the bulkhead's not even
done properly. It's going to be disturbed again.
TRUSTEE DOHERTY: I want it on this permit as well. You
come in with the bulkhead, we'll probably say the same

have to fill that to grade, which entails pu~ing about 18
inches of gravel in the cavity, bring it up to grade, then
we're going to have to put in what's called hydrostatic
openings to comply with the FEMA regulations, which will be
rated in one inch per one square foot to comply with the
FEMA regulations. Poking holes in that, I don't know if you
want to regulate that but so you know, that's something
that's going to come about as a result of the building
permit process. Right now it's not even constructed to
code.

Dear Mr. King,
As you know, this Firm represents Mr. Principi and the Mill Creek Inn who
are seeking to re-build the existing restaurant over its existing footprint.
This Firm was retained by Mr. Principi in March of this year and on March
21, 2006, Mr. Principi and I met with the Town's Building Inspector to outline the
required steps in obtaining a Building Permit to re-build the restaurant within its
footprint. We were informed that an approval from your Board was required.
On April 26, 2006, a full application to re-build the restaurant was
forwarded to your Board.
Subsequently, it was discovered that the docks had been rebuilt using
treated lumber and were different in size and number. On April 26, 2006 the
application was withdrawn and a new application, expanded to address the
restaurant and marina related concerns, was filed with your Board. Also, the
applicant removed all of the treated limber associated with the docks and
replacing them with non-treated lumber.
Subsequently, we were advised that high marsh vegetation was cleared
from the property. On April 21, 2006, I met with the full Board on site to review
and discuss the alleged violations.
A Re-vegetation Plan dated May 16, 2006 was prepared and submitted to
your Board. On May 30, 2006 1 received correspondence from you directing me
to revise my application for restaurant and bulkhead, only. The planting plan was
returned to me and the marina related activities were dropped from the
application.
On June 21, 2006, your Board approved the re-construction of the
restaurant subject to the installation of drywells, and a non-turf buffer off the
southeastern comer of the restaurant to be re-constructed. On August 10, 2006
revised survey were filed with your office consistent with the conditions of permit
issuance.
On August 28, 2006, I met with Heather Cusak, staff to your Board who
informed me that the Health Department would have to "OK" the septic system.
This, I do not recall being part of any decision made by your Board, although my
memory is not always perfect. Shortly thereafter, Mr. Principi submitted the final
approval of the Health Department for the previous restaurant and an
engineering certification prepared by Lawrence Tuthill, which documentation
certified the adequacy of the septic system. Still the requested permit did not
issue and so Mr. Principi met directly with the Health Department. By
correspondence from Walter Hilbert, P. E. Chief, SCDHS Office of Wastewater
Management to you dated October 24, 2006, the septic system was declared to
be acceptable for use without upgrade. Still no permit issued.
I am now in receipt of correspondence from James Richter, R. A. to you
dated October 10, 2006, which correspondence contradicts the your Board's
regulatory decision of May 30, 2006, your Board's approval of June 21, 2006 and
the determination of the Building Inspector which only required receipt of your
permit in order to issue the requested Building Permit.
I am sympathetic to runoff concerns identified in Mr. Richter's
correspondence but note that Mr. Richter has no jurisdiction over the instant
application. Similarly, Mr. Richter can not establish jurisdiction of other agencies
in this matter. I again request that your issue the wetland permit.
I am authorized by the applicant to commence preparation of a larger site
plan which plan will require approvals of the Town's Planning Board, Zoning
Board, Health Department, NYSDEC and your Board and suggest that Mr.
Richter's concerns be addressed within that process as appropriate. I make
myself available to discuss this matter with the Board during its next work shop
although I do not know what more I can contribute to the issue at hand: the
issuance of the permit for the re-construction of the restaurant as already
approved by your Board on June 21, 2006. Please let me know if further
discussion is required.

As discussed in our meeting this morning with Pat Finnegan and Mark
Terry, you explained that this proposed project involves, among other things, a
bulkhead replacement in-kind, additional dockage and rebuilding of a restaurant
and related buildings. As it appears that this project when viewed in total will
need site plan approval, it is required that the SEQRA and LWRP review be
coordinated with the Planning Board (and/or the ZBA if applicable). Accordingly,
it is our advice that the applicant be requested to submit applications to the
Planning and Building Departments before a review of the entire project reaches
any advanced stage.
As also discussed, there appears to be no impediment to proceeding with
the in-kind replacement of the bulkhead or the in-kind replacement of the dock
with Code-compliant materials.

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal
knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge
in one particular area may not be aware of the broader concerns affecting the question of significance.

This proposal maintains the development scheme of the Town of Southold, which is "defined bY a pattern of
open agricultural land interspersed with development clustered around a number of historic hamlet
centers...', by utilizing an existing site. The proposed use is operatively the same as the existin.q use (marinn
& restaurant). The proposal will also preserve open space as there is no development planned that did not
exist before the Mill Creek Inn was demolished. The proposal will make efficient use of infrastructure by
utilizin.q the existing bullheaded marina. This facet also makes beneficial use of the project's coastal
location. As the site has been previously developed, the proposal "minimizes the adverse effects of
development." Therefore, we feel that the proposal is consistent with this policy.

This area of Southold Town has historicc]lly been utilized as a hub for var¥in.q water dependent uses. In the
recent past, restaurants have become a pad of this scheme as well. The Mill Creek Inn combined both
those uses. The proposal is simply to revive that mixed use. Subject parcel and the surrounding aren
cannot be considered si.qnificant archaeolo.qical resources. Therefore, we feel that the proposal is
consistent with this policy. Please note that an attempt had been previously made to salvage the fagade
of the Mill Creek Inn building. That attempt was not successful.

The si.qnificant scenic resources in the Town of Southold "are defined by traditional patterns of
development that were based on a.qriculture, the stron.qest visual element in Southold, and maritime,
activities." The subject parcel has been in water dependent use for many years, as have the westerly
adjacent parcels. A return to this type of activity at subject parcel will restore an integral piece of land
alon.q this section of Route 25, and bring it into visual harmony with the surrounding area which is also in
marina/restaurant use. More simply, the proposed structure and subsequent aesthetic improvements will
"enhance visual quafity..." by eliminating a partially improved lot in the midst of numerous developed lots.
Therefore, we feel that the proposal is consistent with this policy.

Dear Mr. King,
I have been informed that the above referenced matter has been the
subject of extensive discussions and meetings as to how our application should
be processed. Apparently, there is a belief that the proposed actions (i.e. the re-
building of the restaurant and the addition of madna slips by a prior owner)
constitute unlisted actions pursuant to the State Environmental Quality Review
Act CSEQRA"). There is further belief that an illegal segmentation would occur if
our application were not to be treated in this fashion.
I believe that the undisputed facts are as follows:
A restaurant with apartment above historically existed which
restaurant received permits from both the Trustees and Building
Department to reconstruct the foundation in-kind and in-place.
A marina historically existed on the premises which marina
received a permit from the Trustees to "grandfather permit docks at
Mill Creek Inn as shown on survey". The survey shows the boat
basin with attendant bulkheading and 16 finger piers.
The number of finger slips increased and the increase took place
prior to the purchase of the property by Principi.
The increase in finger piers require a permit from the Trustees and
so an application was made with the Trustees to grandfather the
increased number of finger piers thereby removing a violation.
{617.5(c)(2) defines the "replacement, rehabilitation or reconstruction of a
structure..." as a Type II Action.
{617.5(c)(7) defines the construction or expansion of a pdmary or
accessory/appurtenant, non-residential structure or facility involving less than
4000 square feet...' as a Type II Action and the sum total of the finger piers is far
less than 4000 square feet.
{617.5(c)(29) defines "civil or criminal enforcement proceedings whether
administrative or judicial...' as a Type II Action and the filing of the permit
application for the increased number of finger piers is the administrative process
for the resolution of a violation.
Type II Actions are not subject to SERQA pursuant to {617.5(a).
Therefore, no "coordination process" exists for the applications filed with your
agency.
{617.2(b)(ag) defines segmentation as "the division of an environmental
review of an action such that various activities or stages are addressed under
this part as though they were independent, unrelated activities needing individual
determinations of significance", but no individual determinations could be made
in this instance because none of the actions are subject to SEQRA and thus no
determination of significance can be made. Therefore, there is no concept of
segmentation that can be applied in this matter.
By way of this correspondence I request that your Board take no action
(coordination or otherwise) on this application until this matter has been reviewed
by the Town Attorney. I also believe that it is in the interest of both the Town and
the Application that our application be processed expeditiously so that the
existing eye sore that characterizes the property can be remedied as the Building
Inspector has determined that no site plan approval is required in order to
reconstruct the restaurant with apartment above.

After our conference and adjournment on the last court date, April 28, 2006, I went to
64300 Rte. 25, Greenport to investigate Mr. Principi's claim that the lumber used was
ACQ and not CCA as charged in the above-referenced ticket.
Please find enclosed a sticker that I found attached to the new lumber at the location
which indicates that the wood used was, in fact, treated with CCA in violation of the
Town Code. It is difficult to reconcile Mr. Principi's claim that the wood was authorized,
given the cautionary stickers affixed to the numerous 2 x 6 pieces that comprise the docks
warning of the arsenic and stating "treated with CCA.' It certainly appears that Mr.
Principi was attempting to purposely mislead his attorney and presumably, the Court with
respect to this matter.
Please inform your client that the lumber must be removed immediately, or he faces
additional charges for the continued presence of the environmentally hazardous material.
Please call me if you care to resolve the case before the next Court date, May 19, 2006.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southo d agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a

that did not exist before the Mill Creek Inn was demolished. The proposal will make efficient use of

recent east, restaurants have become a part of this scheme as well. The Mill Creek Inn combined both
those uses. The proposal is simply to revive that mixed use. Subject parcel and lhe sun-ounding aren
cannot be considered si.qnificant archaeoloqical resources. Therefore, we feel that the proposal is
consistent with lhis policy. Please note that an attempt had been previously made to salvaqe the facade
of the Mill Creek Inn buildingl. That attempt was not successful.

Route 25, and brinq it into visual harmony with the surrounding area which is also in marina/restaurant use.
More simply, the proposed structure and subsequent aesthetic improvements will "enhance visual
quality...' by eliminating a partially improved lot in the midst of numerous developed lots. In addition, thn
proposed dockinq facility will look the same as what exists now. Therefore, we feel that the proposal is
