All that certain plot, piece or parcel of land, situate, lying and being at Matfituck, in the Town of Southold,

BEGINNING at a concrete monument set on the easterly line of Cox Neck Lane at the northwesterly
comer of the premises about to be described where the easlerly tine of said Cox Neck Lane is intersected
by the southerly ~ine of land now or formerly of C&D Realty, now or formerly of Town of Southold, and from
said point of beginning;
RUNNING THENCE along said land, South 84 degrees 18 minutes 00 seconds East, 179.46 feet through
a concrete menumeot to the approximate high water mark of Mattituck Creek;
THENCE along the approximate high water mark of Mattituck Creek on a fie line bearing, South 38
degrees 06 minutes 06 seconds East, 84.55 feet to land now or formerly of Jenowicz;
THENCE South 73 degrees 45 minutes 00 seconds West along said lasl mentioned land, 257.26 feet to a
point in the easterly side of Cox NeGk Lane;
THENCE along the easterly side of Cox Neck Lane the following two (2] courses and distances: (1) North 02 degrees 45 minutes 00 seconds West, 97.00 feet to a concrete monumenl;
(2) North 19 degrees 22 minutes 00 seconds Easl, 63.00 feet to the monument set at the point or
place of BEGINNING.
BEING AND iNTENDED TO BE the same premises conveyed to the party of the first part by deed dated
June 13, 2002, recorded on June 20, 2002 in Libor 12192 page 763 in the Suffolk County Clerk's Office,
the grantor herein being same person as the grantee in deed recorded in Libor 12192 page 763,
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any `streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estale and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read 'parties'~ whenever the
sense of this indenture so requires.
