estate therein, which the party of the first part has or has power to convey or dispose of, whether individually,

AND the party of the first part covenants that the party of the first part has not done or suffered anything

first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying Ihe cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party' shafl be construed as if it read "parties" whenever the sense of this indenture so

Schedule A
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Nassau Point. Cutchogue, Town of Southold, County of Suffolk and State of
New York, hounded and described as foilows:
BEGiNNiNG at a point on the Westerly side of Little Peconic Bay Road, said point being North 18°
O0'West, 1.55.07 feet from the intersection of the Westerly sic~e of Uttle Peconic Bay Road and the
NortheHy side of Sailor's Lane, a private road; from said point of beginning running thence along land
now or formerly of Heald South 490 -q2' West, 198.59 feet to land now or formerly of Joseph C. Cornell
Construction Corp.; running thence along said land North 21° 26' West, 150.0 feet to the southerly line
of Vanston Road; thence Easterly along the southerly line of Vanston Road, the tie line being North 460
30' East, :[57.1g feet; thence on a curve to the right having a radius of 15 feet, a distance of 30 feet to
the Westerly line of Little Peconic Bay Road; thence Southeasterly along said Line, the tie line being
South 29° 20' East, :[36.0 feet to the point or place of beginning.

BEGINNING at a point at the intersection of the Northerly line of West Ba Road, as the said West Bay
Road is laid out and shown on a map entitled, "Amended Map A of Nassau Point owned by Nassau Point
CIub Properties Inc., situated in the Town of Southold, Long Island, New York, surveyed by Otto W.
VanTuyt, C.C., Surveyor, Greenport, New York, and filed in the Office of the Clerk of the County of Suffolk
on August 16, 1922 as Map No. 156, with the ordinary high water line of Great Peconic Bay; running
thence North 640 22' llY' East along the northerly Iine of said West Bay Road, 177 feet, more or less, to a
point of curve where the said northerly line of said West Bay Road joins the Westerly line of Lowland
Road; running thence northeasterly on a curve to the left having a radius of 86 feet along the line of
Lowland Road 102.O7 feet to a point, the chord of said curve being North 300 22' 10" East 96.18 feet;
running thence nor'cherly on a curve to the right having a radius of 196 feet along the westerly line of
Lowland Road as said Lowland Road is shown on the map referred to 54.05 feet to a point where said
westerly line of Lowland Road is intersected by the 5outherly ~ine of land now or formerly of Walter C.
Grabie, the chord of said last mentioned curve being 53.88 feet; running thence South 640 22' 10" West
along said land now or formerly of Walter C. Grabie 325 feet, more or less, to the line of ordinary high
water mark of Great Peconic Bay; running thence in a southeasterly direction along the line of ordinary
high water mark of Great Peconic Bay 108 feet, more or less, to the point or place of beginning.
TOGETHER WITH a right-of-way, in common with others, for pedestrian use only over and along a
private walk herein described as follows:
BEGINNING at a point on the southerly lie of Sailor's Lane, a private road, said point of beginning being
the following three courses and distances from a pint on the southwesterly line of Little Peconic Bay
Road at the northwest corner of Lot 244, as shown on Amended Map A of Nassau Point," and filed in the
Suffolk County Clerk's Office as Map No. 156;(1] Northwesterly 100 feet, more or less, along the
southwesterly lien of Little Peconlc Bay Road, the tie line of which runs North 490 lg' West, 100 feet;
thence (2) South 40° 00' west, 141.23 feet; and thence (3) South 540 37' West, 13.33 feet, and from said
point of beginning running thence along land of Hanson, South 10o 09' East, 273.14 feet to a bulk head
along Wunneweta Pond, thence along said bulkhead, 273.14 feet to a bulk head along Wunneweta
Pond, thence along said bulkhead, North 830 29' East, 33 feet; thence along land of Hardy ,three courses
and distances as follows: (1) North :[GO :[4' West, 42.:t3 feet; thence (21 South 7g° 31' West, 20..gg feet;
