BOUNDARY LINE AGREEMENT

This Agreement, made the 10~ day of November, 201 I, between Linda Warren and Julia
Platas, as co-ex--rs of the Estate of Williara Beebe, owners of 1455 N~w'Suff-olk Road,
Cutohogue, NY 11935 (hereinag. er "Estate of Beebe") Party of the First Part and Lisa and David
Cifarelli, residing at 1335 New Suffolk Road, Cut~hoguc, NY 11935 ~hercinafler ':Cifarelli")
Party of the Second Part;
WHEREAS, the Party of the First Part is the owner in fee simple of certain real property known
as and by 1455 New Suffolk Road, Ctnchogue, NY 11935, designated as District 1000, Section
109, Block 7, Lot 10.004 on the Tax Map for the County of Suffolk, State of New York and ~s
more particularly described on Schedule A attached hereto and made part hereof (hcreinat%r
"Parcel A");
WHEREAS the Party of the Second Part is the owner in fee simple of certain real property
known as and by 1335 New Suffolk Road, Cutchogue, NY t 1935, designated as Dislrict 1000.
Seclion 109, Block 7, Lot 9.2 on the Tax Map for the County of SutTolk, State of New York and
as more particularly described on Schedule B attached hereto and made part herco£ (hereinafter
"Parcel B"); and
WHEREAS, Parcel A adjoins Parcel B; and
WHEREAS, a survey of Parcel A has been prqmrM, by John C. Ehlcrs Land Surveyor, land
surveyor, dated August 22, 2011 (hemlnafler the "Survey"), a copy ofwhioh is attached as
Exhibit 1, Said surv~ shows, among other things, a fence which runs along or nearby the north
line of Parcel 1455 New Suffolk Road, and the south line of Parcel 1335 New Suffolk Road, but
is situated up to 10 feet inside Parcel 1455 New Suffolk Road; and
WHEREAS, the parties desire to fix and definitely establish the boundary line between the two
parcels mentioned above respectively ownM by them without resort to litigation; ami
NOW, THEREFORE, in consideration of the mutual promises and conveyances herein
oontained, and other good and valuable consideration, ~he receipt of which is hereby mutually
acknowledg~ the parties hereto for themselves and their heirs, legal representatives, successors
and assigns, covenant and agree as follows:
Thai irrespective of the placement of the fence between Parcel A and Parcel B, the common
boundary line between the parcels shall be deemed the north boundary of the property own~ by
thc Party of the First Part and the south laouvcl~ry of the property owned by the Party of the
Se~nd Part is e~tablished as being deim'ibed as follows:
A linc commencing at a point of the North Fast Comer ofPa.,'cel A and running West
200 f~et to the North West Comer of Parcel A.
And the Party of the First Part does hereby remise, release and quitclaim unto the Party of the
Second Part, its successors and assigns, all of its right, title and interest in and to any land lying
to thc south of said boundary line so established, and the party of the Second Part does hereby
remise, r~lease and quitclaim unto the Party of the First Pm't, its successors and assigns, all o£its
right, title and interest in and to any land lying to the north of the said boundary line so
established; and
The parties further agree and ~knowledge tl~ any ag by the Pray of the Second Part. thoir
heirs, legal r~,pms~ntative, s, sue, cea,sots and assigns, of any portion of Parcel A lying north of thc
