SCTM#27-4-3.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. It is recommended that the Board require species composition and maintenance parameters within the proposed landscaped buffer. Also note that the sanitary systems leaching pools are proposed with a 2' separation distance from groundwater. Recent studies have indicated that these types of sanitary systems are contributing to adverse surface water quality impacts via subsurface pollutant loading. Although the sanitary system is located out of Board's jurisdiction, the system has the ability to affect water quality within the Boards jurisdiction. I recommend that the Board address this issue in the future. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Moreover, approximately 1,128 square feet of existing cleared area located seaward of the Coastal Erosion Hazard Area boundary will be revegetated with native vegetation and maintained as a landscape buffer so that no developed portions of the property will remain within the Coastal Erosion Hazard Area. Although the newly proposed structures do not meet a 100-foot setback from the tidal wetlands boundary, existing wetlands setbacks are increased by more than 50 percent and structural coverage within wetlands jurisdiction is reduced by more than 50 pement. This project design and the incorporated mitigation measures provide the following environmental benefits with respect to the protection and restoration of the adjacent wetlands and Orient Harbor ecosystem: a) decreased structural footprint adjacent to wetlands and increased separation between structures and wetlands; b) potential improvement in groundwater quality through improved treatment of on-site septic and increased separation distance between septic and wetlands; c) reduction in potential volume of roof and stormwater runoff reaching Orient Harbor; d) improvement in quality of runoff that does reach Orient Harbor through the replacement of existing, potentially chemically dependent lawn/landscape areas with a native vegetation landscape buffer and through the buffer's ability to act as a sink for such chemicals before they reach surface waters.
