structure with adjacent property and re-work and fortify with additional stone existing+6 x +14

remove/replace in-place existing 4' wide platform and stairs; and establish and subseguently
maintain an 8' wide non-turf buffer on landward side of stone to be planted with Cape American

Dated October 26, 2011 pursuant to which Trustees Wetland Permit#7689 Dated
November 16, 2011 and Trustees Coastal Erosion Permit#7689C Dated November 16, 2011
was issued and conforms to all of the requirements and conditions of the applicable
provisions of law. The project for which this certificate is being issued is
for the existing construction of approximately 87 linear feet of 1,500-3,0001b. stone armor,
incorporating existing xisting row of previously permitted stone armor; construct immediately landward
of stone armor approx. 83 linear feet of vinyl retaining wall and+/-11' northerly return; remove

made by Grace Properties, a partnership with offices located at 6 Bacon Road, St.
James, New York 11780, hereinafter referred to as "DECLARANT":
WITNESSETH:
WHEREAS, DECLARANT is the owner of certain real property
located on Willow Terrace Lane, Orient, Town of Southold, County of Suffolk,
State of New York, described in the Suffolk County Tax Map as District 1000,
Section 26, Block 2, Lot 6.1, which is more particularly bounded and described as
set forth in Schedule "A" annexed hereto, hereinafter referred to as the Property;
WHEREAS, the property is situated on lands within the jurisdiction of
the Board of Trustees of the Town of Southold (hereinafter the "Trustees")
pursuant to Chapter 275 of the Town Code of the Town of Southold or its
successor, and various activities conducted upon the property may thus be subject
to the regulation and approval of the Trustees prior to be conducted;
WHEREAS, the DECLARANT therefore made application to the
Trustees for a permit pursuant to the Wetlands Law of the Town of Southold to
undertake certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to
undertake such regulated activities, the Trustees required that a 8 foot wide "non-
turf buffer" adjacent to and landward of side of stone to be planted with Cape
American beach grass(12" on center);
NOW, THEREFORE, THF, DECLARANT does hereby co,.,enant and
agree as follows:
1) Upon the substantial completion of the aforementioned
permitted activities there shall be established and subsequently maintained an 8
foot wide "non-turf buffer" adjacent to and landward of side of stone to be planted
with Cape American beach grass (12" on center) as defined by Chapter 275 of the
Town Code; and as depicted on the site plan last dated 11-16-2011 and stamped
approved on 11-16-2011.
2) These covenants shall run with the land and shall be binding on
the DECLARANT, his heirs, assigns, purchasers, or successors in interest and may
only be modified after a public hearing and upon resolution of the Board of
Trustees.

( Pursuant to the provisions of Chapter 275 and Chapter 11 I of the Town Code of the Town of Southold
and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on November 16 20
in consideration of application fee in the sum of$500.00 Haid by Grace Properties and subject to the Terms and

3,000 Ib. stone armor, incorporating existing row of previously permitted stone armor;
construct immediately landward of stone armor approx. 831f. of vinyl retaining wall an
+/-11' northerly return; remove portion of existing southerly stone return to allow for
continuous structure with adjacent property and re-work and fortify with additional
stone existing+6X+14 northern stone return; renourish upland area eroded away with
approx. 100 cy. of sand; establish 8' non-turf buffer on landward side of stone to be
planted with Cape American beach grass (12" on center); and remove and replace
(in-kind/in-place) existing 4' wide platform and stairs as necessary to allow for stone work,
and as depicted on the plan prepared by En-Consultants last dated November 16,2011.
IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee, Grace Properties,located at 190 Willow Terrace Lane,Orient.NY as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages,of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties,and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances wan-ant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized,or if,in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety(90)calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completiot of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., November 16, 2011 regarding the above matter:
WHEREAS, En-Consultants on behalf of GRACE PROPERTIES applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance, and Chapter 111 Coastal Erosion
Management, applications dated October 26, 2011, and,
WHEREAS, said applications were referred to the Southold Town Conservation
Advisory Council and to the Local Waterfront Revitalization Program Coordinator for
their findings and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the applications be
found Consistent with the Local Waterfront Revitalization Program policy standards,

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
applications on November 16, 2011 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

The proposed project entails the expansion/raising of existing, previously permitted stone
armor(and the construction of a retaining wall on its landward side to support it and
provide improved retention of the upland area behind it) for the purpose of stabilizing and
providing more effective long term protection of the owner's upland. A significant
portion of that upland was eroded away avulsively during Tropical Storm Irene on
August 29, 2011, despite the presence of the existing low-profile stone armor, which was
entirely buried and covered with an artificially created sand "dune" vegetated with Cape
American beach grass. The project includes the proposed renourishment of this eroded
area, the most seaward 8 feet of which will again be planted with Cape American beach
grass (12" on center) and maintained as a nonturf buffer.
Pursuant to Chapter 275-11(B)(1), the proposed retaining wall is being incorporated into
the erosion control design only where it has demonstrated that the subject shoreline area
is susceptible to and has been impacted by extreme erosion; and the proposed stone will
armor its entire face, leaving no vertically faced structure exposed to Orient Harbor.
Consistent with Chapter 275-1l(B)(1) and Chapter 111-15, the finished structure will
maintain a sloped face and will encroach no further seaward onto the beach than the
existing structure to ensure that it does not cause a measurable increase in erosion at the
site or adjacent properties. The proposed structures are being installed in conjunction
with the adjacent property to the south, which was similarly impacted during Tropical
Storm Irene. The structures are proposed not only where non-structural, vegetative
means alone would not be sufficient to stem the ongoing erosion but also where the
previously installed low-profile stone armor was demonstrated to be insufficient for this
purpose. As a naturally protective feature capable of protecting against continued loss of
upland and ultimately the owner's dwelling is effectively absent at the site, the avulsively
eroded area cannot be successfully renourished and maintained over the long term
without enhanced toe stabilization; and maintaining and enhancing the existing hard
structure for this purpose is the only design consideration that can practicably and
effectively provide such toe stabilization. Despite the loss of the previously created
vegetated "dune,"vegetative enhancement will remain part of the long-term remediation
plan design, as an 8' nonturf buffer to be planted with Cape American beach grass will
again be established landward of the proposed stone armor and retaining wall. Therefore,
the project is also consistent with Policy 4 of the LWRP.

The proposed project entails the expansion/raising of existing, previously permitted stone
armor (and the construction of a retaining wall on its landward side to support it and
provide improved retention of the upland area behind it) for the purpose of stabilizing and
providing more effective long term protection of the owner's upland. A significant
portion of that upland was eroded away avulsively during Tropical Storm Irene on
August 29, 2011, despite the presence of the existing low-profile stone armor, which was
entirely buried and covered with an artificially created sand"dune" vegetated with Cape
American beach grass. The project includes the proposed renourishment of this eroded
area, the most seaward 8 feet of which will again be planted with Cape American beach
grass (12" on center) and maintained as a nonturf buffer.
Pursuant to Chapter 275-11(B)(1),the proposed retaining wall is being incorporated into
the erosion control design only where it has demonstrated that the subject shoreline area
is susceptible to and has been impacted by extreme erosion; and the proposed stone will
armor its entire face, leaving no vertically faced structure exposed to Orient Harbor.
Consistent with Chapter 275-1 l(B)(1) and Chapter 111-15, the finished structure will
maintain a sloped face and will encroach no further seaward onto the beach than the
existing structure to ensure that it does not cause a measurable increase in erosion at the
site or adjacent properties. The proposed structures are being installed in conjunction
with the adjacent property to the south, which was similarly impacted during Tropical
Storm Irene. The structures are proposed not only where non-structural, vegetative
means alone would not be sufficient to stem the ongoing erosion but also where the
previously installed low-profile stone armor was demonstrated to be insufficient for this
purpose. As a naturally protective feature capable of protecting against continued loss of
upland and ultimately the owner's dwelling is effectively absent at the site, the avulsively
eroded area cannot be successfully renourished and maintained over the long term
without enhanced toe stabilization; and maintaining and enhancing the existing hard
structure for this purpose is the only design consideration that can practicably and
effectively provide such toe stabilization. Despite the loss of the previously created
vegetated "dune,"vegetative enhancement will remain part of the long-term remediation
plan design, as an 8' nonturf buffer to be planted with Cape American beach grass will
again be established landward of the proposed stone armor and retaining wall. Therefore,
the project is also consistent with Policy 4 of the LWRP.
