CREEDON, his wife, both residing at 22 Jackson Avenue, Centereach, New York 11720 Zi i - - -- 12 17 61 20 party of the second part, WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of die second part,does hereby grant and release unto the party of the second part,the heirs or successors and assigns of the party of the second part forever, ALL that certain unit designated as #4 in Building A of Condominium I together with an undivided 5% interest in the Common Elements as shown on Map of Mooresland a/k/a Pheasant Run Estates Condominiums I, II & III and filed in the Suffolk County Clerk's Office on 12/22/94 as map #257 and amended by map filed 6/13/96 as Map #257. THE land on which the condominium lies being more particulary bounded and described as follows: ALL that certain plot, piece or parcel of land, situate, lying and being at Greenport, 'fax Map r Designation Town of Southold, County of Suffolk and State of New York bounded and described as follows: Disc BEGINNING at a point on the southerly side of Middle Road (CR 48) at the extreme 000 easterly end of the arc of a curve connecting the southerly side of Middle Road (CR 48) and the easterly side of Moore's Lane; Sec. 40.01 THENCE along the southerly side of Middle Road (CR 48) the following 2 courses and distances: 1.00 1. North 65 degrees 54 minutes 50 seconds East, 78.52 feet to a point; 2. North 69 degrees 00 minutes 20 seconds East, 695.97 feet to the westerly line of Lot(s) Map of Cedarfields filed in the Suffolk County Clerk's Office as Map #8966; 04.000 THENCE South 16 degrees 01 minutes 50 seconds East along the last mentioned land, 1254.09 feet to the northerly side of Cedarfields Drive; continued on Schedule A attached hereto TOGETHER with all right, title and interest, if any,of the party of the first part of, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever,except as aforesaid. AND the party of the fust part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties"whenever the sense of this indenture so requires. South 58 degrees 15 minutes 00 seconds West, 32.98 feet to a point; 2. Westerly along the arc of a curve to the right having a radius of 689.69 feet a distance of 198.62 feet to a point; 3. South 74 degrees 45 minutes 00 seconds West, 496.39 feet to a point; THENCE Westerly and northerly along the arc of a curve to the right having a radius of 40.00 feet a distance of 61.44 feet to the easterly side of Moore's Lane; THENCE North 17 degrees 15 minutes 00 seconds West, along the easterly side of Moore's Lane, 1151.66 feet to a point; THENCE Northerly and easterly along the arc of a curve to the right having a radius of 20.00 feet a distance of 29.03 feet to the southerly side of Middle Road (CR 48) the point or place of BEGINNING. The premises are not in an agricultural district and the premises are entirely owned by the transferor. This transaction is made in the ordinary course of business of the grantor with unanimous consent from all of the shareholders. The grantor herein is the same as the grantee in deed dated June 30, 1993 and recorded in the Office of the Clerk of the County of Suffolk on August 20, 1993 in Liber 11640 cp 929.
