EASEMENT
THIS AGREEMENT made this ~ day of December, 20'11, between
WILLIAM DOUGHERTY residing at 775 Mill Creek Drive, Southold, NY 11971 as
party of the first part and DOROSKI FAMILY LIMITED PARTNERSHIP doing
business at 38400 County Road 48, Southold, NY 11971 and ROBERT H.
JENKINS and JOAN S. JENKINS residing at 2800 Depot Lane, Cutchogue, NY
t 1935 collectively as party of the second part;
WHEREAS, the party of the first part is the owner in fee simple of parcel of
land, ~ocated at 38705 County Road 48, Southold, New York 11971, known as
Lot 3 on the Minor Subdivision Map for Doroski Family Limited Partnership at
Southold, in the Town of Southoid, Suffolk County, New York, filed in the Suffolk
County Clerk's Office as Map No. 11497 on February 20, 2007, and designated
as SCTM: ~3 hereinafter referred to as Parcel 3, and more fully
described in Schedule A attached hereto, and
WHEREAS, the party of the second part is the owner in fee simple of the
parcel of land, located at 38705 County Road 48, Southold, New York 11971,
known as Lot 4 on the Minor Subdivision Map for Doroski Family Limited
Partnership at Southold, in the town of Southold, Suffolk County, New York, filed
in the Suffolk County Clerk's Office as Map No. 11497 or~ February 20, 2007', a~n~d
designated as SCTM: ~I hereinaftei' referred to as Parcel 4, and
more fully described in Schedule B, attached hereto,
WHEREAS, the party of the first part intends to grant an easement to the
party of the second part for a portion of the parcel of land described in Schedule
A, said easement more fully described in Schedule C, attached hereto.
WITNESSETH:
NOW IN CONSIDERATION OF ($10.00) each and to the other paid and
the receipt of which is hereby acknowledged and other good and valuable
consideration the party of the first part hereby grants and conveys unto the party
of the second part, their heirs, successor and/or assigns which shall come into
title to said Parcel 4, a permanent and perpetual easement that runs with the
Iand, as described more fully in Schedule C.
The easement is solely for the purpose of access to the irrigation well,
pump, and all utilities from the Road to the Farm, and not for ingress/egress to
the Farm.
Furthermore, the easement shall be for purpose of the placement,
installation, maintenance, repair, inspection and replacement of any and all
underground utilities, an irrigation well, pump and utilities, as needed, and not for
ingress/egress to the farm.
The party of the second part, their heirs, successors and/or assigns, shall
restore the area to its original'condition alter installation, 'maintenance, repair,
inspection and replacement of such nine inch (9") irrigation well, pump and utility
service over the premises more particularly described in Schedule A. The
parties acknowledge and agree that the nine inch (9") irrigation well, pump and
utility service which belong to the party of the second part, the owner of Parcel 4,
are currently located on Parcel 3, the property of the party of the first part, and will
remain in their current location on Parcel 3.
The party of the second party, its successors and/or assigns will install and
maintain an electric irrigation pump and will install a cover over the irrigation
pump to act as a noise barrier to reduce the noise level from the operation of the
irrigation pump. The cost of installation, maintenance and repair of said nine inch
(9") irrigation well, pump and utility service, and to restore the area shall be born
solely by the party of the second part, their heirs, successors and/or assigns.
The party of the first part, its successors and assigns, retain unto
themselves all righ{s to fully enjoy its aforedescribed premises except for the
purposes herein granted to the party of the second part.
This grant of easement shall at all times be deemed a continuing covenant
that runs with the land and shall be binding upon, and inure to the benefit of heirs,
successors and/or assigns of all parties to this agreement.
IN WITNESS WHEREOF, the parties hereto have set their hands and
