other good and vatuable consideration paid by the party of lhe second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part

All that certain plot, piece or parcel of land, situate lying and being in the Town of Southold at

certain map entitled, 'Map of August Acres, Sec. 1" filed in the Office of the Clerk of the County of
Suffolk on June 3, lg91 as Map No. 9107, said lot being bounded and described as follows:
BEGINNING at a point on the southwesterly side of Kerwin Road, said point being the southerly
end of a curve connecting the southerly side of Sage Spur with the southwesterly side of Kenvin
Road; THENCE from said point ef beginning, along the southwesterly side of Kerwin Road,
South 43 degrees 09 minutes 40 seconds East, 137.00 feet to a point; THENCE South 46
degrees 50 minutes 20 seconds West, 250.00 feet to a point; THENCE North 43 degrees 09
minutes 40 seconds West, 162.00 feet to the southerly side of Sag Spur; THENCE along the
southerly side of Sage Spur, North 46 degrees 50 minutes 20 seconds East, 225.00 feet to a
point; THENCE along lhe arc of a curve bearing to the right, having a radius of 25~00 feet a
distance of 39.27 feet to the point or place of BEGINNING.
BEING AND INTENDEDTO BE the same premises conveyed to the party of the first part by deed
dated 08/20/01, recorded 08121/01 in Liber 12138 page 406. -
TOGETHER with all dght, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the esl'ale and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the par[y of the second part forever.
AND the paRy of the firsl part covenants that the party of the first part has not dor~e or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and witl hold the right to receive such
consideralion as a trust fund to be apptied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the tolal of
the same for any other purpose4 The word "party" shafl be construed as if it read "pa~es" whenever the
sense of this indenture so requires.
