DAVIS, residing at no#Hobart Road,Southold,New York, 11971 party of the first part,and /00 f� "/ �7- n DOROTHY SARGEANT,residing at no#Old Harbor Road,New Suffolk,New/' 7ork, 11956 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Incorporated Village of Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the westerly side of Main Street distant 89.55 feet southerly from the corner formed by the intersection of the westerly side of Main Street and the southerly side of Center Street; RUNNING THENCE South 7 degrees 01 minutes 40 seconds East along the westerly side of Main Street 75 feet to land of Heffernan; THENCE South 85 degrees 23 minutes 20 seconds West along said land 166.81 feet to land of Urban, formerly Cook; THENCE North 6 degrees 49 minutes 00 seconds West along said land of Urban, 58.45 feet to a point; THENCE North 7 degrees 00 minutes 50 seconds West still along land of Urban 16.59 feet to land of Orient Community Properties; THENCE North 85 degrees 23 minutes 20 seconds East along said land and also land now or formerly of Malin 166.61 feet to the westerly side of Main Street at the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed dated August 3, 1987 recorded in the Office of the Clerk of the County of Suffolk on August 7, 1987 in Liber 10387 page 01. THIS CONVEYANCE IS SUBJECT TO mortgage made by Stirling Bay Redev. Co., Inc. and dated 9/21/77 to Southold Savings Bank in the sum of$32,500.00 which mortgage was recorded on 9/26/77 in the Office of the Clerk of the County of Suffolk in Liber 8002 page 244 and mortgage made by Stirling Bay Redev. Co., Inc. and dated 1/5/78 to Southold Savings Bank in the sum of$2,500 which mortgage was recorded on 1/10/78 in the Office of the Clerk of the County of Suffolk in Liber 8087 page 311; and mortgage made by Stirling Bay Redev. Co., Inc. and dated 3/15/83 to Southold Savings Bank in the sum of$28,493.37 which mortgage was recorded on 4/20/83 in the Office of the Clerk of the County of Suffolk in Liber 9535 page 294; and Extension Agreement between Stirling Bay Redev. Co., Inc. and and dated 3/15/83 to Southold Savings Bank in the stun of$60,000.00 which extension agreement was recorded on 4/20/83 in the Office of the Clerk of the County of Suffolk in Liber 9535 page 284, which mortgage was further extended by Extention Agreement between Dorothy Sargeant and Julie P. Davis dated 8/3/87 to Southold Savings Bank in the sum of$8,14LED which Extension Agreement was recorded on 8/7/87 in the Office of the Clerk of the County of Suffolk in Liber 13189 page 486; and mortgage made by Dorothy Sargeant and Julie P. Davis dated 8/24/88 to Southold Savings Bank in the sum of$67 657 78 which mortgage was recorded on 9/1/88 in the Office of the Clerk of the County of Suffolk in Liber /�$490 5 8 4 ; and Consolidation, Extension and Modification Agreement between Dorothy Sargeant and Julie P. Davis dated 8/24/88 to Southold Savings Bank in the sum of$ 12 5, 0 0 0. 0 0 which Consolidation Extension and Modification Agreement was recorded on September 1, 1988 in the Office of the Clerk of the County of Suffolk in Liber 14420 page 593 and which Consolidation, Extension and Mofidicalion Agreement was corrected to reflect the correct liber and page of a certain mortgage dated 3/15/83 which correction instrument was recorded on 5/25/89 in the Office of the Clerk of the County of Suffolk in Liber 15154 page 20. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever,except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
