WHEREAS, on November 14, 1984, this board received site plans as
amended relocating the subject 10' by 12' storage building with a
27-foot setback from the easterly property line (rather than a 20-foot
setback as originally applied); and
WHEREAS, the applicant by his attorney requests that the variance
application be withdrawn since it is the determination of the building
inspector that the new location would be in compliance with the bulk
schedule requirements;
NOW, THEREFORE, on motion by Mr. Goehringer, seconded by Mr. Sawicki,
it was
RESOLVED, that the application of SOUTHLAND CORP., Appeal No. 3275,
be and hereby is WITHDRAWN WITHOUT PREJUDICE, as requested.

This board determines the within project not to have a signifi-
cant adverse effect on the environment for the reasons indicated
below.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar

submitted which indicates that no significant adverse effects to
the environment are likely to occur should this project be imple-
mented as planned;
(2) The property in question is not located within 300 feet
of tidal wetlands or other critical e~vironmental area.

comments and six copies we believe were meant to be filed with
you.

Gentlemen:
This letter is in reference to the petition by Southland Corporation
to the Board of Appeals of the Town of Southold requesting a side yard
setback variance for the Seven-Eleven store on Main Road, Southold.
At this time, we wish to voice our objection to this variance for the
following reasons:
Noise. Even at present we find the noise created by deliveries
at all hours, including 2:00am and 3:00am, to be a major dis-
turbance. Any change in location where deliveries are made or
garbage is stored and/or picked up, would create a further
disturbance that is completely unacceptable.
Also at present, and you may already be aware, the store's
parking lot has become an unsupervised local youth "hangout".
Any further expansion would only serve to enhance this situation,
contributing to the general disturbance in the area (which includes
beer-drinking and bottle-smashing in the rear of the building and
on our adjacent property.)
Cleanliness. We are already plagued by the presence of unsightly
garbage on the Main Road and on our property. Prior to the building
of the store, at the meeting held by Superintendant Pell with the
immediate neighbors, we were told that the Seven-Eleven management
would be required to send an employee out once a day to pick up any
litter on our adjacent property. To date, this has never been done.
We were also assured at the meeting that garbage would be stored only
on the west side of the building, facing Locust Lane, and farthest
frcm our residence.
As you can see, any alterations to the current situation would not alleviate
problems, but add to them.
We respectfully request that any plans or further intentions by Southland
Corporation concerning this variance be brought to our attention well in
advance.

Dear Ms. Pascucci:
Following a field inspection of the 7-11 stores at
the above mentioned locations and review of same
at the Planning Board meeting of July 9, 1984, the
Planning Board makes the following recommendation.
It was the consensus of the Board that the proposed
accessory buildin~ should be located in the rear
of the stores. It was also suggested that a leanto
could be constructed in the rear of the stores rather
than the utility building in order to provide more
storage.

1. STRICT APPLICATION OF THE ORDINANCE would produce procticaldifficultiesorunneces-
sary HARDSHIPbecause the existing dimension requirements of the site as
improved do not allow the proposed expansion for a "bottle return"
facility as required by the New York State "Bottle Law" and reasonable
health requirements mitigating against inside storage in a store that
sells food. Passage of the recently enacted Bottle Law was not
anticipated at the time of original construction and therefore outside
storage was not included.
2~ The hardshipcreated is UNIQUE and isnotshared by all properties alike in the immediate
vicinity ofthisproperty and inthis use district because the site as improved met prior
requirements of the law and the enlargement for the bottle return
facility as required by the New York State "Bottle Law" is necessary
