WITNESSETH, that I e party of the first part, in consideration of ninety thousand (90,000)
dollars
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk and State of New York, as
set forth on the "Map of Harbor Lights Estates at Bayview, tliection Four, Town of
Southold, New York, made by Von Tuyl & Son, Greenport, New York," as Lot No. 78,
and filed in the Suffolk County Clerk's Office on 3/1/84 as Map # 7703, more
particularly bounded and described as follows:
BEGINNING at a point on the easterly side of Clipper Drive distant 220.00 feet
southerly from the corner formed by the intersection which connects the easterly
side of Clipper Drive with the southerly side of Anchor Lane;
RUNNING THENCE South 64 degrees 05 minutes 10 seconds East, 215 feet;
RUNNING THENCE South 25 degrees 54 minutes 50 seconds West, 200 feet;
RUNNING THENCE North 64 degrees 05 minutes 10 seconds West, 215 feet to the
easterly side of Clipper Drive;
RUNNING THENCE North 25 degrees 54 minutes 50 seconds East 200 feet along the
easterly side of Clipper Drive, the point or place of BEGINNING.
TOGETHER with the right to use, in ccmmn with others, the beach area having a
frontage of approximately 900 feet on Peconic Bay and a depth not less than 50 fey
from the average high water rritark, as shown on said map; said map being "Map of
Harbor Lights, Section One", which was filed in the Suffolk County Clerk's Office
on June 8, 1965 as Map No. 4362, together with the adjacent parking area having
frontage on Harbor Lights Drive and being located adjacent to Lot #7; said beach
and parking area shall be for the sole use and benefit of the residents of Harbor
Sec: 079.00 Lights Estates comprisapproximately 125 acres.
TOGETHER with all right, title aning,interest, if any, of the party of the first part in and to any streets and roads
Blk: 04.00 abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all
Lot: 017.002 the estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
