Adoption of Meeting Minutes: · Acceptance of meeting minutes from November 15, 2011 MOTION made by Allan Connell, seconded by Maureen Cullinane, to accept the Land Preservation Committee meeting minutes from November 15, 2011. Motion carried: 4/0/2 (L/Il/an Ball abstained as not present during the 11/15/2011 LPC meeting and John Sepenoski abstained) Land Preservation Applications and Inquiries: · SCTM #1000-53.-1-1.2 & 1.3 (Manor Grove) [executive session] Review appraisal The members entered into EXECUTIVE SESSION. Appraisal supports Town Board's purchase price offered to The Nature Conservancy. END OF EXECUTIVE SESSION MOTION made by Maureen Cullinane, seconded by Allan Connell, to support offer made by the Town Board to The Nature Conservancy (as Contract Vendee) for the purchase of 0.722 acre that is a part of the Manor Grove conservation subdivision, subject to Town/County purchase of the remainder of the Manor Grove Corporation parcels for open space purposes. Town will be responsible for un- development of said area. Motion carried: 6/0 SCTM #1000-53.-1-6.1 (Pekunka) [executive session] Status and potential acquisition update Town has been informed that grant proposal submitted by Laura Klahre, Land Management Specialist II, to NYS Department of State has been awarded in the amount of $389,341 in matching funds towards this possible Town acquisition. Grant requires a second appraisal. The members entered into EXECUTIVE SESSION. LPC discusses aspects of possible purchase and reviewed requirement for second appraisal. END OF EXECUTIVE SESSION MOTION made by Eric Keil, seconded by Maureen Cullinane, to direct Melissa Spiro, Land Preservation Coordinator, to commission a second appraisal of the 10.8+ acre Pekunka property, SCTM #1000-53.-1-6.1, for open space purposes. Area appraised excludes a 40,000 sq ft area around the existin9 residential home and accessory structures. Motion carried: 6/0 SCTM #1000-95.-1-11.2 (Biggane, John and Margaret) Review new PDR application received 10120111 with additional info received 1216111 Application was reviewed by LPC. No decision was made. SCTM #1000-68.-4-18 (Sepenoski, John B., Jr.) Review new PDR application received 11/16/11 Committee Chairman, John Sepenoski, was not present for any discussion about this project due to a family relationship to applicant. Application was reviewed by LPC. No decision was made. SCTM #1000-63.-3-25 (ZBL Properties) Inquiry re: potential PDR (property for sale) Inquiry was reviewed by LPC. No decision was made. SCTM# 1000-112-2-1 & 2 (Macari, Bergen Ave. S/S) Review new PDR application received 12/9/11 Application reviewed by LPC. No decision was made. SCTM# 1000-106.-9-2.3 (Cooper Farm) Update re: status of AgPDD application Eric Keil not present for any discussion on this project due to family relationship to applicant. Melissa reviewed AgPDD application made to Town Board for Change of Zone. Melissa is preparing memo to Town Board that application is complete and ready for review. Melissa to present to Town Board at 12/20/2011 Town Board meeting. Landowner has offered four (4) development rights as part of the application. The LPC discussed, in depth, the need for restructuring procedures including developing a system for helping to determine the merit of applications in light of the current state of preservation funding. Applications & Inquiries for Uses or Structures on Preserved Property: · SCTM #1000-63-1-1.5 (Cliff Cornell f/k/a G. Conway) Request for agricultural storage building within Development Rights Easement Committee Chairman, John Sepenoski, was not present for this discussion due to a family relationship to applicant. Maureen, Eric and Melissa met with Cliff Cornell to discuss his potential plans for the farmland on which the development rights had been sold to the Town by a previous landowner, George T. Conway. They recommended that the LPC approve this request for a replacement barn in the southwest corner of the easement area. MOTION made by Sam McCullough, seconded by Allan Connell, to approve landowner Cliff Cornell's request for Construction of a 42'x60' Morton Style building to be located in the southwesterly corner of the property within the development rights easement and replacing an existing old barn in this same area. Building use is to be for the storage of farm vehicles and agricultural equipment such as tractors, etc. Melanie to send formal letter of request approval to landowner. Motion carried: 4/0 (Eric Keil and John Sepenoski not present for vote) SCTM #1000-100.-4-8.2 (Dorset Farms, Inc.) Request for "as built" deer fencing Sam McCullough did not take part in this discussion due to his working relationship with landowner. Landowner's request to LPC for "as is" deer fencing installed around the perimeter of the development rights easement area was discussed. MOTION made by Eric Keil, seconded by Allan Connell, to approve landowner Dorset Farms' request for "as is" deer fencing installed around the perimeter of the development rights easement area. Melanie to send formal letter of request approval to landowner. Motion carried: 5/0 (Sam McCullough not present for vote) SCTM #1000-120.-5-1 & #1000-121 .-1-1.6 (Macari Property f/k/a Thorton Smith) Request for utility use from proposed wind turbine on adjacent property Abigail A. Wickham, Esq, representing landowner's (Macari) interest in the property and Stephen Searl from Peconic Land Trust, were invited to participate in discussion for landowner's request to LPC for a utility use crossing development rights sold lands from proposed wind turbine on adjacent property. Utility use to go along existing farm roads. Said adjacent property is located just north of preserved lands. Application for construction of the wind turbine is in the Building Department for review. Electricity generated from the use of the wind turbine will serve agricultural operation including the existing winery. Discussion included depth of buried wires to be located within the Town's development rights easement and a utility disclosure statement to be shown on future maps of property or recorded in the Suffolk County Clerk's office. MOTION made by Eric Keil, seconded by Lillian Ball, to approve landowner Joseph T. Macari's request for a utility use from a proposed wind turbine on adjacent property as indicated in LPC request form dated December 1, 2011. The Committee has determined that the utility use requested within the development rights easement has no impact on the agricultural use of the development rights property and is consistent with the original intent of the easement and is subordinate to the agricultural use of the property. This approval is given subject to the following conditions: Wires are to be buried to a depth of five (5) foot deep; During trenching, top soil is to be separated from sand and gravel and, during backfilling, agricultural soils are to be returned to original condition. Formal LPC approval letter will contain the following paragraph: Should you utilize the wind turbine in a manner that differs in any way from that proposed to the Land Preservation Committee, or to site the utility use at a location that differs from that proposed to the Committee, you will be required to obtain additional approval. It is recommended that utility disclosure/sketch be recorded in the Suffolk County Clerk's office and Abigail A. Wickham, Esq., in her capacity as attorney for Joseph T. Macari, will word said document. Motion carried: 6/0 Stewardship and Management: None General Land Preservation Items: · PRESERVATION FINANCIAL UPDATE Melissa gave financial update to LPC and distributed current SNAPSHOT to LPC for review. Remaining funding availability was discussed and how to use these funds in the best interest of the Town. UPDATE FROM NOVEMBER 22, 2011 SUFFOLK COUNTY FARMLAND MEETING Highlights of the11/22/2011 Suffolk County Farmland Committee meeting attended by Melissa Spiro were discussed. It was noted that two Southold projects (Vitti and Angela Norton) were approved to be on the County's annual review list. · SUFFOLK COUNTY FARMLAND COMMITTEE MEETING Tuesday, January 24, 2012 ~ 12 noon, H. Lee Dennison Building, Hauppauge. Next Regular Meeting: · The next regular meeting will be held on January 10, 2012 at 7:00 p.m. in the Annex Executive Board Room.
