THIS INDENTURE, made the 4~ day of October, Two Thousand Eleven
BETWEEN
J. ER.NEST WELLS, residing at 4297 East Johnstown Road, Columbus, Ohio 43230
party of the first part, and
MAPLE STREET GREENPORT, LLC, whose address is 3535 Cedar Beach Road, Southold,
New York 11971,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and ether valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk, and State of New
York, known and designated as lot number forty-three (43) on a certain map entitled
"Subdivision map, part of the Estate of Thomas F. Price, Sr. situated at Greenport, Town of
Southold, Suffolk County, New York, which map is made by Otto W. Van Tuyt, dated
November 29, 1927 and filed in the Office of the Clerk of Suffolk County, New York, and which
tot is bounded on the North by Lot #58, on the East by Lot #42, on the South by Maple Street,
and on the West By Lot #44, more particularly described as follows:
BEGINNING at a point on the northerly side of Maple Street a distance of 200.00 feet from the
intersection of the westerly side of Sixth Avenue and the northerly side of Maple Street;
RUNNING THENCE along the northerly side of Maple Street, North 75 degrees 13 minutes 20
seconds West, 50.00 fee~ to a point;
RUNNING THENCE North 14 degrees 46 minutes 40 seconds East, 150.00 feet;
RUNNING THENCE South 75 degrees 13 minutes 20 seconds East, 50.00 feet;
RUNNING THENCE South 14 degrees 46 minutes 40 seconds West, 150.00 feet to the northerly
side of Main Street, the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated March 28, 1988, and recorded April 7, 1988, in the Office of the Suffolk County
Clerk in Liber 10577, Page 264.
TOQETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to thc centex lines thereof; TOGETHER
with the appurtenances and all the estate and fights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
tl~ party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before ming any part of the total of the same fox any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
