THIS INDENTURE, made the 19th day of October, Two Thousand Eleven
BETWEEN
DAVID L. FISHER, residing at 1500 Brecknock Road, Apt. 318, Grecnpon, New York 11944,
party oft. he first part, and
DIANE M. FISHER, residing at2145 Old Orchard Road, East Marion, New York 11939,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever, his
99% interest in and to
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at East Marion, in the Town of Southold, County of Suffolk and
State of New York, known and designated as Lot No. 12 as shown on a certain map entitled
"Map of Gardiner's Bay Estates, Section 2" and filed in the Off[ce of the Clerk of the County of
Suffolk on September 23, 1927 as Map Number 275, said lot being more particularly bounded
and described as follows:
BEGINNING at a point on the northeasterly side of Old Orchard Lane (Old Orchard Road) where
the same is intersected by the division line between Lots 12 and 13 as shown on the aforesaid
map; said point or place of beginning being distant 200.00 feet southeasterly as measured along
the northeasterly side of Old Orchard Lane from the comer formed by the intersection of the
southeasterly side of Locust Court with the northeasterly side of Old Orchard Lang
RUNNING THENCE from said point or place of beginning along the division line first above
mentioned, North 58 degrees 58 minutes 30 seconds East, 115.95 feet to the division line
between Lots 12 and 12A;
RUNNING THENCE along said division line, South 31 degrees 01 minutes 30 seconds East,
40.00 feet to the division line between Lots 11 and 12;
RLrNNING THENCE along said division line, South 58 degrees 58 minutes 30 seconds West,
114.20 feet to the northeasterly side of Old Orchard Lane and;
THENCE along the northeasterly side of Old Orchard Lane in a northwesterly direction the
following two (2) courses and distances:
1. Along the arc of a curve bearing to the right having a radius of 431.68 f~t, a clis~ance of
6.35 feet;
2, North 31 degrees 01 minutes 30 seconds West, 23.75 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated August 16, 2006, and recorded August 29, 2006, in the Office of the Suffolk County
Clerk in Liber 12466, Page 796.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in mmpliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied frrst for the purpose of paying the cost
of the improvemem and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be constn~ as if it read "parties" whenever the sense of this indenture so
r~quires.
