DEC made a determination regarding the limits of Tidal Wetlands Act (Article 25) jurisdiction for this property on December 19, 2000, a copy of that letter is enclosed. This office does not make repeated jurisdictional determinations for the same site. The limits of DEC jurisdiction were indicated in our original Non-Jurisdiction letter. Additionally, in the context of this area where many of the dwellings are non-conforming the requested variances become less substantial. 4. Town Law l$267-b(3)(b/(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant proposed to increase the front yard setback by +/- 8 ft., and the setback from the bulkhead by +/- 3 ft. with the new construction. The applicant will also install a new septic system landward of the proposed dwelling and install drywells as per code. 5. Town Law §267-b(3)(b/(5). The difficulty has been self-created, in so far as the applicant proposes to demolish the existing non-conforming dwelling and [6nstruct a new dwelling in a non-conforming location. 6.
