by and between ADOLPH W. KALBERT, residing at 424 4th Street, Greenport,
New York, 11944,
PARTY OF THE FIRST PART/GRANTOR,
-AND-
A.W. KALBERT AND JOHN F.A. KALBERT, Trustees, or their
successors in trust, under the A.W. KALBERT LIVING TRUST dated March
18, 1993, and any amendments thereto, residing at 424 4th Street, Greenport,
New York, 11944,
PARTY OF THE SECOND PART/GRANTEE.
WITNESSETH, that the party of the first part, in consideration of the sum
of ONE and 00/100 ($1.00) DOLLAR, lawful money of the United States, and
other good and valuable consideration paid by the party of the second part, does
hereby grant and release unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever:
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the village of Greenport
Town of Southold, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a point on the easterly line of Fourth Street, 200.00 feet
northerly along said easterly line from Flint Street, said point of beginning being
the southwest corner of land of the grantor herein, and from said point of
beginning; running thence along said easterly line of fourth Street, North 7017'30"
East, 102.79 feet to the southerly line of a 15 foot right-of-way; thence along said
southerly line of said right-of-way, South 87044'50" East, 140.33 feet to land now
or formerly of Kearny; thence along said land now or formerly of Kearny, South
7011'20" West, 114.87 feet to land now or formerly of Kip; thence along said
land now or formerly of Kip, North 82048'40" West, 140.00 feet to the point or
place of BEGINNING.
TOGETHER with a right-of-way for ingress and agress over the said 15
foot right-of-way adjoining the aforementioned property to the north and running
from the northwesterly corner of the premises herein described, easterly 365.00
feet, more or less, to Greenport Harbor.
TOGETHER with a right to use in common with others the parcel of beach
at the end of the aforementioned right-of-way on Greenport Harbor, of an area
50.00 feet, more or less, along Greenport Harbor by 65.00 feet, more or less, in
depth.
SUBJECT to the right-of-way and easement of the Village of Greenport for
the purpose of laying, relaying, repairing, operating and maintaining water and
sewer mains, both supply and'distribution, and appurtenances including domestic
services and any future fire hydrants for a distance of 5 feet South of the 15 foot
right-of-way adjoining the subject property.
TOGETHER with a right to use in common with others, the sewer and
water mains running along the 15 foot right-of-way adjoining the subject property
to the North, which sewer and water mains have been installed in conformity with
the rules and regulations of the Village of Greenport and which sewer and water
mains have been dedicated to the Village of Greenport.
BEING AND INTENDED TO BE the same premises conveyed to the
grantor herein Adolph W. Kalbert by Deed of Adolph W. Kalbert and Helen B.
Kalbert, formerly known as Helen Wilson, dated March 30, 1977, and recorded
in the Suffolk County Clerk's Office on March 31, 1977, in Liber 8213 at Page
142.
THIS is a transfer wherein the Grantor and the Grantee are father and
son wherein the premises are being transferred into a Trust.
TOGETHER with all rights, title and interest, if any, of the party of the
first party in and to any streets and roads abutting the above described premises
to the center lines thereof.
TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part
forever.
