This amended Site Plan indicates the construction of a new 45' x 45' carport and has been prepared by the office of DiGiovanni &Associates Architects dated 7/19/11. Please consider the following: 1. This proposed carport will be located over an existing asphalt pavement area. For this reason this new development will not generate additional stormwater runoff. Due to the fact that the site has already been constructed with adequate drainage that included this area, additional drainage will not be required at this time. 2. This project will require ZBA approval for relief from the required front yard setback. If you have any questions regarding this review, please contact my office. Sin rely, ames A. Richter, R.A. Based upon all testimony, documentation, personal inspection of the property Page 2 of 3—November 17,2011 • • ZBA File#6514—KOS,LLC CTM: 1000-96-1-1.4 and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The parcel is a Light Industrial Zoned parcel, improved with four large storage buildings, office and an apartment for the caretaker. Surrounding parcels are all commercial in nature and the proposed carport and location are in keeping with the area. The carport will be open on all sides. 2. Town Law &267-b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject parcel contains two front yards and the location of the existing improvements make the proposed location of the carport the only area available. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is substantial for the front yard setback variance, it represents an 84% relaxation from the code. The lot coverage requested is not substantial only representing a 9% variance from the code. However, the proposed location fronts on a cul-de-sac that gets very little traffic and the proposed carport will be placed on an area that is already paved on the subject property. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this commercial industrial park will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant has agreed to place gutters on the carport leading into the existing drainage on site, so all roof runoff will be contained on site. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created, the applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a commercial carport, while preserving and protecting the character of the neighborhood and the health, safety and welfare of this LI industrial district. . RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried,to GRANT, the variance as applied for, and shown on the site plan and elevations prepared by DiGiovanni & Associates Architects dated 7.19.11 and labeled A-1. Subject to the following condition: 1. Based upon the carport's proximity to the street, all roof runoff shall be contained in on-site storm drains. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. It is located inside an already established industrial park which is well-screened. The increase in lot coverage is negligible. Further, the impact is less due to the proposed structure having no walls, and being located on an area that is already paved. Based on the above reasons, the Planning Board has no objection to the requested variances. If you should have any questions or require additional information, please do not hesitate to contact the Planning Office. 1 WORK SESSION AGENDA SOUTHOLD TOWN PLANNING BOARD Monday, October 17, 2011 4:00 p.m. Applications ..................... PROPERTY FACTSIDESCRIPTION:The applicant's 3.07 acre vacant site has 98 feet along Commerce Drive (cul-de-sec)in Cukhogue, and Is located in the Light Industrial Zone District. BASIS OF APPLICATION: Building Department's August 2, 2005 Notice of Disapproval, citing Section 100- 43C M Its denial of an application for a building permit for an accessory apartment within a public storage building is not permitted under the provisions of the zoning code for accessory uses. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which time written and oral evidence were presented. Based upon s8 testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board hinds the following facts to be true and relevant: VARIANCE ,R IFREOUESIED: The applicant wishes to add a 902 sq.ft.Apartment dwelling unit, next to the 725 sq. fL office area, as within one of the proposed new buildings (building referred to as Phase 1)to be built for public storage use in this Light Industrial Zone District. REASONS FOR BOARD ACTION• On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance witi not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new apartment (dwelling) unit will consist of 902+- square feet and is proposed fbr the purpose of residency by the manager-employee of the public warehouse facility at this site. Access to the storage uNM by the public Is available 24 hours a day by the employees of the warehouse facility. If the V86M a were not approved, an employee would not be able to reside at the site as part of the management and security of the public warehouse operations. 2. The benefit sought by the applicant for on-site living space for the manager of the pubile warehouse facility cannot be achieved by some method, feasible for the applicant to pursue, other than by approval from the Zoning Board of Appeels for variance relief. 3. The variance granted herein is substantial. Page 2-December 1,2005 . ZB File Ref.5779-Martin Kosmynka • CTM 96-1-1.4 4. The difficulty was self-created when plans were designed for a business with a residential unit in a Light Industrial Zone District. 5. No evidence has been submitted to suggest that a variance in this community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6.Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an apartment for the employee-manager of the public warehouse facility, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing lest under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the 4/6/05 site plan (A-1) and A-0 Plan of elevation and screening, prepared by DiGiovanni & Associates, Architects, SUBJECT to the condition that the occupant of the accessory apartment must be employed as the public storage/warehouse manager. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Oliva (Chairwoman), Orlando, Goehringer, Dinizio, and Simon. This Resolution was duly adopted (5-0). 6 .G Q'; Ruth D. Application Information Project Title: North Fork Self Storage Carport 11. Action Review all staff and agency comments and schedule for a determination. III: Analysis Description: This site plan is for the proposed addition of a 1,800 s.f, carport on the existing 3.1 acre North Fork Self Storage site in the LI Zoning District where four existing buildings total 53,425 s.f. The 40' x 45' carport would be used as a staging area for customers to have temporary access to containers. The carport is proposed to be built on an existing asphalt area. Outside agencies have all responded with comments. Staff comments and response to agency comments follow. 1. Town Engineer a. This proposed carport will be located over an existing asphalt pavement area. For this reason this new development will not generate additional stormwater runoff. Due to the fact that the site has already been constructed with adequate drainage that included this area, additional drainage will not be required at this time. b. This project will require ZBA approval for relief from the required front yard setback. 2. LWRP: a. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department and the information available, it is recommended that the proposed action is CONSISTENT with the LWRP. V: Staff Recommendations 1. Accept the recommendations made by the LWRP coordinator and the Town Engineer; schedule for approval at the December 12, 2011 Public Meeting. 1 SOUTHOLD PLANNING BOARD SITE PLAN APPLICATION FORM SEP Z 1 2011 Site Plan Name and Location S tiL F S ro 2A(n Application Date: Site Plan Name: No2rN GA-K - A pp --- --.- Suffolk County Tax Map #1000-0% _ o! 14 Other SCTM #s Street Address: 5-0 Hamlet 0 rGHo<rUo Distance to nearest intersection: 5-9 9- F6-C- 7 Type of Site Plan: New ✓ Amended —Residential Zoning District z Owners/A¢ent Contact Information Please list name, mailing address, and hone number or the people below: Property Owner KoS.^1yn/)L4 1(o5 . 1111v Street SO Co r" M C)fGG b R,.
