ETI ANEY and BARBARA HEANEY, his wife, both residing at 410 Fifth Street, Greenport, New York 11944 party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece o parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the at Glreenport, Town of Southold, County of Suffolk and State of New York, shown and designated as and by the lot number 68 on a certain map filed in the miscellaneous map Section in the Suffolk County Clerk's Office on 5/19/1853 under the map no. 534, which said lot is more particularly bounded and described as follows: BEGINNING at a point on the easterly side of Fifth Street distant 100.0 feet northerly as measured along the easterly side of Fifth Street from the corner formed by the intersection of the easterly side of Fifth Street and the northerly side of Flint Street; RUNNING THENCE North 7 degrees 18 minutes 00 seconds East along the easterly side of Fifth Street 50.00 feet to the division line between Lots 68 and 67 as shown on above map, THENCE South 82 degrees 48 minutes 40 seconds East along said last mentioned division line 165.00 feet to the division line between Lots 68 and 30 as shown on the above mentioned map; THENCE South 7 degrees 17 minutes 40 seconds West along said last mentioned division 50.00 feet to the division line between Lots 68 and 69,as shown on the above mentioned map; THENCE North 82 degrees 48 minutes 40 seconds West along said last mentioned division 165.00 feet to the easterly side of Fifth Street at the point or place of BEGINNING BEING AND INTENDED TO BE the same premises as conveyed by deed dated 4/29/91 and recorded 5/20/91 in Liber 11265 pg 287. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. AND the party of the first part covenants as follows:'that said party of the first part is seized of the said premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the party of the first part will execute or procure any further necessary assurance of the title to said premises; and that said party of the first part will forever warrant the title to said premises. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
