The Planning Board approved two lots subject to ZBA approval. You have advised that the application for ZBA approval was withdrawn by the applicant in 1983. Also noted in file is a permit from the DEC for construction of three single family dwellings, dated 2/29/88. Did the applicant submit the original three lots to DEC? Has Suffolk County Health Department changed their position? the In any event, vacant lot C.O.'s should not have been issued for either the two lot subdivision, since that has not been completed, nor for the three original lots. The variance application pending before this board is for area and lot width as shown on the 4/16/82 survey in our file. Since the applicants will be amending their original plan, the amendment should be re-filed with the Building Inspector in order to determine whether or not a setback variance will be needed. On August 9, 1983 the Town Board adopted Local Law No. 9 "...in Relation to Area and Yard Regulations .... " One of the amendments includes a minimum 35-foot frontyard setback for lots under 40,000 square feet in area (depicted as "A" on the attached schedule). We are forwarding a copy of this letter to the applicants' attorney and request that three copies of the amended and approved survey/plan be filed with our office in order that the board may review same for further processing. BE IT ENACTED by the Town Board of the Town of Southold as follows: Chapter 100 of the Southold Town Code (Zoning) is hereby amended as follows: I, Section 100-31 thereof is hereby amended to read as follows: Section 100-31 - Bulk and Parking Requirements No building or premises shall be used and no building or part thereof shall be erected or altered in the A Residential and Agricultural District unless the same conforms to the following Bulk and Parking requirements, to wit: A. In the case of a lot held in single and separate ownership prior to Nove~nber 23, 1971 and thereafter, with an area of less than forty thousand (40,000 sq. ft.) square feet, a single family dwelling may be constructed thereon, provided that the requirements of Column A of the Bulk and Parking Schedule incorporated into this Chapter are complied with. Schlussel and Marion Sadick Dear Mr. Grigonis: I am writing to you as a result of the State's August 16, 1983 decision conference for the above tidal wetlands application. We have decided to issue a permit and grant an average 10' variance to our setback requirement of the Tidal Wetlands Land Use Regulations. This would entail moving the proposed dwellings closer to the road. Therefore, the dwellings will be located 40' from the road rather than the proposed 50'. This would necessitate that you grant them a 1~ variance to to local zoning requirements (setback from road). We believe that granting of these variances (both State and Town) would be least de~imental to the environment. It would allow for a 50' undisturbed, upland buffer zone and still provide a 15' wide area between the house and buffer zone for the applicant's lawn. In this case, we believe that a 65' setback from the high marsh is necessary to preserve and protect the present and potential values of these tidal wetlands (i.e., marine food production, wildlife habitat, flood and hurricane and storm control, cleansing ecosystems, and absorption of silt and organic material). We hope you agree and are willing to grant a variance for the above. Enclosed is a copy of the permit. If you have any questions, please contact me at 751-7900. Thal the State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 9. That if the display of lights and signals on any work hereby authorized is not otherwise provided for by law, such tights and signals as may be pre- scribed by the United States Coast Guard shall be installed and maintained by and at the expense of the owner. 10. All work carried out under this permit shall be performed in accor- dance with established engineering practice and in a workmanlike manner. 11. If granted under Articles 24 or 25, the Department reserves the right to reconsider this approval at any time and after due notice and hearing to continue, rescind or modify this permit in such a manner as may be found to be just and equitable. If upon the expiration or revocation of this permit, the modification of the wetland hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 12. This permit shall not be construed as conveying lo the applicant any right to trespass upon the lands o; interfere with the riparian rights of others to perform the permitted work or as authorizing the impairment of any rights, title or interest in real or personal property held or vested in a person not a party to the permit. 13. The permittee is responsible for obtaining any other permits, ap- provals, lands, easements and rights-of-way which may be required for this project. 14. On July 27, 1972, Richard L. Sadick and Murray Schlussel purchased three lots on the north side of Stillwater Avenue in Cutchogue, New York. Enclosed herewith please find photocopies of map of property surveyed for Richard L. Sadick and Murray Schlussel, said survey dated June 9, 1972 and showing three lots. The most westerly situ- ate lot was taken in the name of Murray Schlussel. The center lot was taken in the name of Richard L. Sadick and Murray Schlussel and the most easterly lot was taken in the name of Richard L. Sadick. Each of the lots was a legal building lot by reason of the decision of the Zoning Board of Appeals under appeal number 1174 dated March 29, 1968, a copy of which is at- tached hereto. Messrs Sadick and Schlussel had made application to New York State Department of Environmental Conservation for approval to fill to bring to grade and for the construc- tion of three houses on the subject properties. Said permission was granted on November 6, 1974, with the pro- viso that no construction or fill be within fifty feet of the line of the mean high water mark. Sadick and Schlussel then applied to the Suffolk County Department of Health for Health Department permits to construct the three houses. The Suffolk County Health Department, however, denied their application by reason of the fact that the Health Department would not approve the construction of the houses by reason of the fact that cesspools and wells could not be placed on the three lots which would maintain a one-hundred foot distance between cesspools and wells as well as maintain a one-hundred foot setback of the cesspools from the dredged canal. In the year 1978, Richard L. Sadick died and his Will was probated naming his wife, Marion W. Sadick as his Executrix as well as the owner of his interest in the subject real property. By reason of the disapproval by the Health Department of the application to construct three houses on the property, Marion W. Sadick and Murray Schlussel submitted to the Suffolk County Health Department an application to construct only two houses on the area comprising the three lots. Approval was granted on June 18, 1982 for the construction of two houses on the area comprising of the three lots, pro- vided that two lots be created out of the three lots. At- tached hereto is a copy of the survey of the subject ~roper- ty showing the approval by the Suffolk County Health Depart- ment. The within application to your Board seeks permission to subdivide the center lot owned by Sadick and Schlussel into two segments wherein the westerly portion of the center lot would be merged with the westerly lot o~ned by Schlussel and the easterly portion of the center lot would be merged with the easterly lot owned by Sadick so as to create two lots out of the three lots.
