AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in accordanc
with the Resolution of the Board of Trustees adopted at the meeting held on September 21.2011 in consideratio
of application fee in the sum of$250.00 paid by Joan Kuchner and subject to the Terms and Conditions as stated
the Resolution,the Southold Town Board of Trustees authorizes and permits the following:
Wetland Permit to replace 100'of existing timber bulkhead using vinyl sheathing and 2'
higher than existing, construct a 16' return on the west side,install rip-rap%to 1 ton stone arm
in front of the bulkhead,construct 4'X 8' beach stairs with a 4' platform,replenish the beach wi
approx.500 cy.of sand,install a fence no closer than 10'of the bulkhead,with the Condition a 111
non-turf buffer is installed along the landward side of the bulkhead,and as depicted on the sure
prepared by Nathan Taft Corwin III last revised October 25,2011.

TERMS AND CONDITIONS
The Permittee,Joan Kuchner, residing at 1726 Arshamomaque Ave. Southold.NY as part of
the consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances wan-ant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized,or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required,upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee pennit-has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety(90)
calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.

Dear Mrs. Kuchner:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., September 21, 2011 regarding the above matter:
WHEREAS, JOAN KUCHNER applied to the Southold Town Trustees for a permit
under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance, application dated September 6, 2011, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 21, 2011, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town, and,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees has found the application to be Consistent with
the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees APPROVES the application of JOAN
KUCHNER to replace 100' of existing timber bulkhead using vinyl sheathing and 2'

Permit to construct and complete project will expire two years from the date the permit

Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

Dear Town Trustees:
The Officers and the Board of Directors are in favor and voted to replace the community bulkhead
damaged by Hurricane Irene. We strongly support the Beixedon bay front bulkhead owners(Ball,
Ilibassi and Kuchner)efforts to replace their damaged bulkhead. The stone armor will help to minimize
toe erosion and help stabilize the shoreline immediately in front of the bulkheads.
The Board of Directors and Officers of Beixedon Estates Association,Inc. are working very closely with
the bulkhead owners to reestablish our shoreline and beach. The bulkhead owner's sand permit will
help restore our shoreline to the 2008 levels. We hope to come to a long-term solution to the shoreline
erosion problem through careful application and monitoring of the sand while working with the
regulating agencies.
I recently addressed the community informing the Beixedon community of the Trustees meeting tonight
and the meeting in October for the community bulkhead. We strongly support the one—two foot
height increase of the bulkhead because it will add stability and a safe access point to the beach for all
community residents.This access helps preserve a significant asset our community has,and it would he
a shame to lose.
In my recent letter to the community, I also addressed correspondence and communication with
government agencies. 1 would like to state that only I and members of our Board have the authority to
communicate and make decisions on behalf of our Association.I understand every member is entitled to
their own opinion(and vote within our Association), but one individual cannot make representations to
the thoughts of the community. Please retain my contact information for future reference should you
need any clarity or have any questions relating to Beixedon. I appreciate your help and consideration
given to our current situations.

At the meeting of the Southold Town Conservation Advisory Council held Wed.,
September 14, 2011, the following recommendation was made:
Moved by Doug Hardy, seconded by Derek Bossen, it was
RESOLVED to RELUCTANTLY SUPPORT the Wetland Permit application of JOAN
KUCHNER to replace 1 00' of existing timber bulkhead using vinyl sheathing 1' higher than
existing, construct a 16' return on the west side, and construct 4'X 8' beach stairs with a 4'
platform.
Located: 1726 Arshamomaque Ave., Southold. SCTM#66-2-44
Inspected by: Doug Hardy
The CAC Reluctantly Supports the application, however, recommends the applicant
consider a rock revetment with a 3:1 slope to absorb the wave energy and cut it back into
the property. The CAC has sympathy for the applicant, however, replacing the bulkhead
will not solve the problem.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the LWRP review provided
the following best management practices are required if the action is approved:
1. Require a landscaped buffer landward of the bulkhead.
2. Minimize the use of CCA materials in the proposed stair. The diagram indicates
that all wood would be CCA treated.
To further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6;
Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is
recommended that the Board require a silt boom during construction.
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:
(2) Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This structure
may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt
booms. The placement of the erosion control structure(s) shall be determined by the Trustees
or their designee. All intertidal construction and excavation requires the installation of a
silt boom that will retain all suspended sediments within the immediate project area
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Dear Town Trustees:
I have submitted an application for replacing my bulkhead because of the damage incurred from
Hurricane Irene on August 28, 2011. After several years of effort, I recently obtained amendments to
the DEC permit and Trustees permit#469 for rip-rap and sand replenishment. The Town Trustees
permit for sand replenishment was issued on July 20,2011.The Beixedon Estates Association (50
homeowners)requested that the work for the sand replenishment and rip rap project start after Labor
Day to avoid disrupting the beach during the summer. Unfortunately,the damage from Hurricane Irene
happened before I was able to start this project.
I am requesting that the amendments to permit#469 to install rip-rap 34 to 1 ton stone armor in front of
the existing bulkhead and to replenish the beach with approx.400 cy.of sand,as depicted on the site
plan prepared by Dru Associates, Inc. be included in this application.

assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
