Box 933 Cutchogue, NY 11935 RE: RUSSELL & JULIANNE KARSTEN 57908 MAIN RD., SOUTHOLD SCTM#66-2-2.2 Dear Mr. Schwartz: The Board of Town Trustees took the following action dudng its regular meeting held on Wed., October 19, 2011 regarding the above matter: WHEREAS, Mark Schwartz, Amhitect on behalf of RUSSELL & JULIANNE KARSTEN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southoid Town Code, the Wetland Ordinance, application dated September 12, 2011, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the Local Waterfront Revitalization Program policy standards, specifically with Policy 6 - Protect and restore the quality and function of the Town of Southold ecosystem and Policy 6.3 - Protect and restore tidal and freshwater wetlands, and, WHEREAS, the Board of Trustees has furthered Policies 6 and 6.3 of the Local Waterfront Revitalization Program to the greatest extent practical through the imposition of the following Best Management Practice requirements: the requirement of a line of staked hay bales and silt fencing landward of the non-turf buffer area and maintained throughout construction and the existing buffer is maintained, and, 2 2 WHEREAS, a Public Headng was held by the Town Trustees with respect to said application on October 19, 2011, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirements imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approves the application of RUSSELL & JULIANNE KARSTEN to construct a partially covered deck off the rear of the existing dwelling; hot tub; as-built pool, patio and fencing, with the Condition a line of staked hay bales and silt fencing is installed landward of the buffer and maintained throughout construction and the existing buffer is maintained, and as depicted on the site plan prepared by Mark Schwartz & Associates dated September 1,2011 and stamped approved on October 19, 2011. SCTM#66-2-2.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP: Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions The structures were constructed without a permit pursuant to Chapter 275 Wetlands and Shorelines of the Southold Town Code. Additionally, if the action is approved and to further Policy 4.2 Protect and restore natural protective features and Policy 6; it is recommended that a perpetual natural vegetated buffer incorporating existing vegetation landward of the wetland be required, An example definition follows: NATURAL VEGETATED BUFFER -- a land area of a certain length and width where existing vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be maintained to achieve a minimum percent ground cover of ninety-five (95) percent. To achieve the percent ground cover indigenous, drought tolerant vegetation shall be planted. Survival of planted vegetation shall be (ninety) 90 percent for a period of three (3) years. Maintenance activities within the buffer are limited to removing vegetation which are hazardous to life and property, trimming tree limbs up to a height of fifteen feet (15') to maintain viewsheds, replanting of vegetation and establishing a four foot (4') wide access path constructed of pervious material for access to the water-body. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
