SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type Il category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated September 14, 2011, stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt
list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION.' The Applicant's property is a 71,954 sq. ft. parcel in the R-80 Zone.
The northerly lot line measures 348.29 feet. The Easterly lot line measures 222 feet. The southerly lot line
measures 300 feet along Main Road, and the westerly lot line measures 227.69 feet. The property is improved with
a single family dwelling and several accessory structures, numbered 1-5, as shown on the site survey drawn by
Stanley J. Isaksen, Licensed Land Surveyor, dated July 12, 2007.
BASIS OF APPLICATION: Request for Variance from Article III, Code Section 280-13C and 280-15, based on an
application for building permit and the Building Inspector's June 20, 2011 Notice of Disapproval, concerning "as
built" art studio; 1) "as built" construction of an art studio is not a permitted use, 2) less than the code required rear
yard setback of 20 feet.
RELIEF REQUESTED: The Applicant proposes to construct a family "Artist Workshop", and not a commercial
"Art Studio" as it is referred to in the Town Building Department's Notice of Disapproval dated June 20, 2011. The
proposed workshop is to be located within the pre-existing, non-conforming accessory structure identified as
accessory structure #2 on the site survey submitted. The Applicant also requests a variance for the "as built"
construction of a 2''~ floor window dormer in the accessory structure, labeled wooden structure w/utilities,
with a nonconforming rear yard setback of 7 feet, when a 20 foot setback is required by Town Code.
ADDITIONAL INFORMATION: The Applicant applied to the Town Building Dept. for a permit to construct an
"Artist Workshop" with an "as built" dormer window, located within pre-existing, nonconforming accessory,
labeled wooden structure w/utilities. The permit was denied, with the Notice of Disapproval stating that the "as
built" construction of an "Art Studio" is not a permitted use; and further, in reference to the "as built" dormer
window, it is located in a nonconforming area at less than the code required rear yard setback of 20 feet.

The Applicant testified at the public hearing that the family artists whose paintings will be created in the workshop
have a commercial gallery/studio in Greenport where the paintings will be displayed for sale. The Applicant
testified that the home workshop will be used only for the creation of paintings and art objects, and that there will
be no sales or exhibitions conducted at the artist workshop or anywhere on the Applicant's residential property.
As an outcome of ZBA Decision 6424, dated Nov. 16, 2010, and in the absence of such definitions within the text
of Town Zoning code, The Board defined an 'Artist Studio' "as the physical location for creating artwork, and a
location for the public and/or private viewing and/or sales of same created artwork". The Board also defined an
'Artist Workshop' "as a physical location for creating artwork, and expressly prohibits the public and/or private
viewing or sales of same created artwork".
It is noted that this same accessory structure will also contain a separate accessory apartment on the Ist floor,
pending the grant of Zoning Board approval of Berglund Appeal 6479. A letter of support was received from a
neighbor.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on November 3,2011, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property,
an assessment of the character of the neighborhood, and other evidence, the Zoning Board finds the following facts
to be true and relevant and makes the following findings:
On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following
findings:
1. Town Law §267-b(3)(b)(1). Grant of alternative relief to construct an "Artist Workshop" in a residential
Zone will not produce an undesirable change in the character of the neighborhood or a detriment to nearby
properties. The workshop will be contained within a pre-existing, nonconforming accessory structure located in
the rear yard. An "Artist workshop" is a customary use of an accessory structure, as it is relates to a home
occupation in a residential zone, and similar to some other types of home workshops, can be permitted by Town
Zoning Code.
Grant of the variance for the "as built" second floor dormer window will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The existing non-conforming rear yard setback
was established when the structure was built prior to Zoning Code. The window is screened from the view of the
adjacent neighbor by a well-established vegetated hedgerow of various types of woody plants and shrubs.
2. Town Law §267-b(3)(b)(2). The benefit sought by the Applicant for construction of an "Artist Workshop" in a
pre-existing, nonconforming accessory structure can be achieved by some method, feasible for the applicant to
pursue, other than an area variance. The Applicant could seek to amend the Notice of Disapproval to change the
wording from "accessory Artist Studio" to state "accessory Artist Workshop". The benefit sought by the applicant
for the "as built" dormer window cannot be achieved by some method, feasible for the applicant to pursue, other
than an area variance. The window was built into a pre-existing structure with a nonconforming rear yard setback,
and it cannot be relocated to a conforming location on the structure, yet still provide the same degree of natural
lighting for the "Artist Workshop".
3. Town Law §267-b(3)(b)(3). The variance granted herein for an "Artist Workshop" is not substantial to the
extent that it may be construed to be a permitted use allowed by Town Code within a residential Zone, whereas an
"Artist Studio" is not a permitted use within a residential Zone.
The variance granted herein for a seven feet rear yard setback is not substantial, considering that it only for an "as
built" window installed in a pre-existing structure with an established nonconforming rear yard setback.
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance for an "Artist
Workshop" in this residential community will have an adverse impact on the physical or environmental conditions
in the neighborhood. There will be no commercial signs erected which indicate the presence of an "Artist
Workshop" on this property. No evidence has been submitted to suggest that a variance for a nonconforming seven

foot rear yard setback for a 2nd floor dormer window built in a pre-existing accessory building in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. There
will be no degradation produced to any property within this residential zone by the installation of a dormer
window.
5. Town Law §267-b(3)(b)(5). The difficulty has been self-created because the Applicant should have been
aware of Town Zoning Code when applying for a permit to construct an "Artist Workshop", and also aware of the
need to secure a valid building permit before constructing the "as built" dormer.
6. Town Law §267-b. Grant of alternative relief, for construction of an "Artist Workshop" in an accessory
structure is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a workshop,
while preserving and protecting the character of the neighborhood and the health, safety and welfare of the
community.
Grant of the requested relief for a seven foot rear yard setback for an "as built" window is the minimum action
necessary and adequate to enable the applicant to enjoy the benefit of a window, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member
Goehringer, and duly carried, to

structure w/utilities, shown on the site survey drawn by Stanley J. Isaksen, Jr., dated July 12, 2011.
DENY, as applied for, and noted on the Building Dept. June 20, 20I 1 Notice of Disapproval "Artist Studio", and
GRANT ALTERNATIVE RELIEF, as noted below:
For construction of an "Artist Workshop" in the accessory structure, labeled wooden structure w/utilities, in a
residential Zone, and shown on the site survey drawn by Stanley J. Isaksen, Jr., dated July 12, 201 l. Subject to the
following conditions;
Conditions:
1. Public viewing of artwork is prohibited.
2. There shall be no commercial or private sales of artwork from the accessory structure.
3. An "Artist Studio" is not permitted in the accessory structure, or anywhere on this residential property.
4. A second accessory apartment, cooking, or sleeping is not permitted in the "Artist Workshop".
5. No part of the artist workshop may be rented to or otherwise occupied by anyone other than the applicant's
family members.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued
Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two
sets of the final architectural drawing, conforming to the alternative relief granted herein. The ZBA will forward one set of
approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a
building permit, and may require a new application and public hearing before the Zoning Board of Appeals.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or
survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action
does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
Thc Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of
nonconformity.

REASONS FOR APPEAL (additional sheets may be used with preparer's signature):
AREA VARIANCE REASONS:
(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment
to nearby properties if granted, because:
The existing barn contains an artist workshop (non-habitable portion), unfinished storage area and pre-
existing seasonal cottage (pre-co). Applicant has a pending application to convert the pre-existing seasonal
cottage to an "accessory apartment". The barn was renovated and the interior non-habitable space is an
artist workshop used exclusively by the family. The Berglund family members are professional artist with
a gallery in Greenport. The workshop is their exclusive workshop for the artist to paint. The public has
no access to this work shop area, it is used exclusively by the family.
The existing two story barn was remodeled, the interior space was made into artist workshop. The roof
was replaced and the roof pitch in the back of the barn was changed to make space for windows for natural
light to the artist workshop. When the barn was renovated the windows were replaced and roof pitch
changed for the windows. The existing setbacks of the barn remained the same.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant
to pursue, other than an area variance, because:
The existing barn was constructed originally for the adjacent farm. The property was splitoff from the
farm years ago. The barn contains a pre-existing cottage (east side of barn), a room on the first floor room
of the barn and second floor of the barn was converted to an artist workshop. The artist workshop is
accessory to the residence. The family lives in the home and the accessory cottage, the family are
professional artist with gallery space in Greenport and art work shown in Manhattan galleries. The artists
in the family are Amy Worth, Alice Dennison, Kate Ledogar and Joan Berglund (owner and daughters)
and son, Jim Ledogard. They are all professional artist who need a work area. No one sells from the
property, they all show in galleries. Amy Worth (artist) and her husband, Thomas Payne, are the owners
of the Greenport Gallery. They will live in the accessory apartment. Joan Berglund lives in the main
house. The daughters and son use the work shop space when they visit their mother. The artist workshop
provides a quiet, clean and bright space for the artists.
The existing barn was renovated, the second floor was renovated for the artist studio which required the
roof pitch to be changed in order to replaces the windows. However, the existing nonconforming setbacks
of the barn were maintained. The Windows run along back of existing barn to provide the natural light
needed in an artist workshop.
(3) The amount of relief requested is not substantial because:
The artist workshop occurs inside an existing barn. A beautiful pre-existing barn, built years ago when the
surrounding land was farmed, is preserved and re-used by the family. The artist workshop provides a
private work area for the family of artist to paint. The setbacks were maintained and existing structure
renovated. The roof pitch was modified to make room for the windows.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions
in the neighborhood or district because: The lot is not on the water and has no environmental restraints.
The road is a scenic byway because the pre-existing barns are preserved. The artist workshop provides a
use for the barns without changing the agricultural look of the building. The windows in the back of the
barn on the second floor were changed to provide the light for the artist workshop and to keep the
architecture of the barn the same.
(5) Has the alleged difficulty been self-created? ( X )Yes, or ( )No The artist workshop is inside the
existing barn. An artist workshop does not provide for retail use, it is only used as a work area. Work
should have been undertaken with a building permit. The roof needed to be replaced and the builder
should have obtained a building permit prior to the start of construction.

sets of plans, accurate plot plan to scale. Fee according to schedule.

d. Upon approval &this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit

This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency. *Except minor exempt actions including Building

Before answering the questions in Section C, the preparer of this form should review the exempt

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Times Review newspaper.
1) Before October 20th:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable, you are requested to make other attempts to
obtain a mailing address or to deliver the letter to the current owner, to the best of your ability,
and to confirm how arrangements were made in either a written statement, or during the
hearing, providing the returned letter to us as soon as possible;
AND not later than October 26th: Please either mail or deliver to our office your Affidavit of
Mailing (form enclosed) with parcel numbers, names and addresses noted, along with the
green/white receipts postmarked by the Post Office. When the green signature cards are
returned to you later by the Post Office, please mail or deliver them to us before the scheduled
hearing. If any envelope is returned "undeliverable", please advise this office as soon as
possible. If any signature card is not returned, please advise the Board during the hearing and
