Adoption of Meeting Minutes: · Acceptance of meeting minutes from October 18, 2011 MOTION made by Maureen Cullinane, seconded by Sam McCullough, to accept the Land Preservation Committee meeting minutes from October 18, 2011. Motion carried: 4/0/2 (Ray Huntington & Allan Connell abstained as they were not present at the October 18, 2011 LPC meeting; John Sepenoski was not present at time of vote) Land Preservation Applications and Inquiries: · SCTM #1000-53.-1-1.2 & 1.3 (Manor Grove) Update re: status - Randy Parsons, The Nature Conservancy (7:30 p.m. appointment) Randy Parsons of The Nature Conservancy gave history of the Manor Grove project to the members. He then gave current status of the project and the existing contracts with landowner, Town and County. He explained the difficulties that TNC is undergoing with the Suffolk County Health Department in TNC's effort to subdivide from the whole parcel, a 30,000 square foot building lot that contains a residential house and barns. Health Dept wants to see an upgraded septic system that would be costly and the installation of such would potentially impact the area as clearing and cutting of trees would likely be necessary. Randy inquired as to whether or not LPC would be interesting in pursing preservation of the lot area. The existing Town/County contract with TNC does not include the proposed residential lot. A separate potential purchase by the Town was considered and all aspects reviewed. Randy will provide Town with an estimate from a notable environmental agency as to cost for demolition and restoration of the site. LPC directed Melissa Spiro and Randy Parsons to arrange for an executive session appointment with the Town Board for the work session being held on Wednesday, November 9, 2011, to discuss potential acquisition by the Town. Status update re: current projects Terry Town has received all necessary approvals for 9rant eligibility. Closin9 has been scheduled for Thursday, November 3, 20'1 '1 Pindar Vineyards LLC Landowner's attorney called for status as landowner would like to close by end of 20'1 '1. Town is waitin9 for survey, and then Reserve Area needs to be mapped out and approved by all parties. Surveyor mentioned that part of the property is under a 2 year lease to a farmer who is raisin9 Icelandic sheep. A fenced area has been erected and a hoop house is now on the parcel. Further information as to use of the hoop house is needed. o Biggane Jack Biggane met with Melissa Spiro on '1 '1/'1/20'1 '1 and made application to LPC for potential sale of development rights on part of his property located alon9 Oregon Road. Melissa to meet with Plannin9 staff about this potential project. Applications & Inquiries for Uses or Structures on Preserved Property: SCTM #1000-102.-4-5.3 (Reinhardt PDR) Itzkowitz/Meltzer inquiry re: Agricultural Structure Placement within development rights easement Itzkowitz/Meltzer formal request for placement of a 4-stall horse barn with tack room, and 2 paddocks to be located within Town's development rights easement area, alon9 with Ms. Meltzer's letter dated October 25, 20'1'1, statin9 her potential use of the property were reviewed and discussed by LPC members. MOTION made by Maureen Cullinane, seconded by Eric Keil, to direct Melissa Spiro, Land Preservation Coordinator, to respond by letter to the Itzkowitz/Meltzer request that the proposed therapy use described in Ms. Meltzer's letter dated October 25, 20'1'1, is not an allowable use within the recorded easement. Non-agricultural production activities would need to be confined to the reserved area. Motion carried: 7/0 SCTM #1000-63-1-1.5 (Cliff Cornell f/k/a G. Conway) Request for agricultural storage building within Development Rights Easement LPC members discussed the landowners request for the construction of a barn within the Town's easement area. Since members still have concerns as to use of the proposed barn, LPC members requested that Melissa contact Cliff Cornell and ask that he attend a future meetin9 of the Land Preservation Committee to discuss his plans for the farmland. Stewardship and Management: · Monitoring Reports o SCTM#1000-19.-1-1.4 Cullinane (Allan Connell) No easement violations noted. Directed Melanie to send copy of report to landowner. o SCTM#1000-84.-1-12.6 Demchak (Allan Connell) No easement violations noted. Directed Melanie to send copy of report to landowner. SCTM #1000-18.-4.7.7 Sepenoski f/k/a Droskoski (Allan Connell) No easement violations noted. Directed Melanie to send copy of report to landowner. SCTM #1000-100.-4-8.2 Dorset Farms (Allan Connell) No easement violations noted. Directed Melanie to send copy of report to landowner. SCTM #1000-96.-2-1-.2 PLT f/k/a Macari (Allan Connell) No easement violations noted. Directed Melanie to send copy of report to landowner. SCTM #1000-95.-1-5.2 Bustamante f/k/a Badenchini (Allan Connell) No easement violations noted. Directed Melanie to send copy of report to landowner. SCTM#1000-115.-8-5.3 Elak (Allan Connell) No easement violations noted; however fuel storage tank could be potential future environmental concern. Directed Melanie to send copy of report to landowner and include information on County requirements for fuel storage tanks as well as information concerning possibility of grant funding available for upgrading tanks. SCTM #1000-108.-2-3 and #1000-115.-2-10.2 Rutkoski (Allan Connell) No easement violations noted; however fuel storage tank could be potential future environmental concern. Directed Melanie to send copy of report to landowner and include information on County requirements for fuel storage tanks as well as information concerning possibility of grant funding available for upgrading tanks. SCTM #1000-86.-1-10.12 ZIP Peconic Wells, LLC (Allan Connell) Allan explained the fuel spill area he found near the fuel tank at the irrigation well motor to be a violation of the recorded easement. LPC members discussed the extent of contaminated area. MOTION made by Eric Keil, seconded by Maureen Cullinane, to direct Melanie to send a letter to Lloyd Zuckerberg of ZIP Peconic Wells, LLC, to address the fuel oil spill found within the easement area during a routine annual site inspection. The spill area must be cleaned up and contaminated soil disposed of properly in accordance with NYS Environmental Law within sixty (60) days from date of letter. Site is to be re-inspected after said sixty (60) days for compliance with the recorded easement. If the spill area still exists after sixty (60) days, the Town will notify the proper authorities. Motion carried: 7/0 General Land Preservation Items: None Next Regular Meeting: o The next regular meeting will be held on November 15, 2011 at 7:00 p.m. in the Annex Executive Board Room. Lillian Ball will be unable to attend this meeting. Adjournment: · The meeting was adjourned at 9:30 p.m. by the six remaining LPC members.
