PREFACE PursuanttoSection402oftheCleanWaterAct(CWA),operatorsof smallmunicipalseparate A@ stormsewersystems(smallMS4s),locatedin urbanizedareas(UA)andthose additionally A@A@ designated byNewYorkStateareunlawfulunlesstheyareauthorizedbya NationalPollutant DischargeEliminationSystem(NPDES)permitorbyastatepermitprogram.NewYorks State A@= PollutantDischargeEliminationSystem(SPDES)isanNPDESapprovedprogramwithpermits A@ issuedinaccordancewiththe EnvironmentalConservationLaw(ECL). A@ Onlythose smallMS4operators who develop and implement a stormwatermanagement program(SWMP)andobtainpermitcoverageinaccordancewithPartIIofthis SPDESgeneral permit areauthorizedto dischargestormwater fromtheir smallMS4 underthis SPDESgeneral permit. A coveredentity authorizedunderGP008002asoftheeffectivedateofGP010002,shallbe permittedtodischargeinaccordancewiththerenewedpermit,GP010002,uponthe submissionoftheirAnnualReport,unlessotherwisenotifiedbythe Department. 1 obtaincoverageunderthis SPDESgeneral An operator notauthorizedunderGP010002may permit bysubmittingaNoticeofIntent(NOI)totheaddressprovidedontheNOIform.For newlyregulatedMS4s,authorizationunderthis SPDESgeneralpermit iseffectiveuponwritten notificationfromthe Department ofthereceiptofacompleteNOI.Copiesofthis SPDESgeneral permit andtheNOIforNewYorkareavailablebycalling(518)4028109oratanyDepartment ofEnvironmentalConservation(Department)regionaloffice(AppendixA).Theyarealso availableonthe Department swebsite: = http://www.dec.ny.gov/permits/6045.html SubmittinganNOIisanaffirmationthataninitial SWMP hasbeen developed andwillbe implemented inaccordancewiththetermsofthis SPDESgeneralpermit. *Note:allitalicizedwordswithinthis SPDESgeneralpermit aredefinedinPartX.Acronyms andDefinitions. PERMIT COVERAGE AND LIMITATIONS A. Permit Application 1.This SPDESgeneralpermit authorizes discharges of stormwater from small municipalseparatestormsewersystem s(MS4"s)asdefinedin40CFR A 122.26(b)(16),providedalloftheeligibilityprovisionsofthis SPDESgeneral permit aremet. 2.ExemptNonStormwaterDischarges.Thefollowingnonstormwater discharges areexemptfromtheneedfor SPDESgeneralpermit coverage unlessthe Department hasdeterminedthemtobesubstantialcontributors ofpollutantstoaparticular smallMS4 applyingforcoverageunderthis SPDESgeneralpermit.Ifthe Department determinesthatoneormoreofthe discharges listedbelowisasubstantialcontributorofpollutantstoa small MS4,theidentified discharges willbeconsidered illicit.Inthatevent,the coveredentity musteliminatesuchdischargesbyfollowingthe illicit discharge minimumcontrolmeasure(MCM)requirements(SeePartVII.A.3 A@ orVIII.A.3,andPartIX.A.3,B.3,C.3,andD.3whereapplicable). a.waterlineflushing b.landscapeirrigation c.divertedstreamflows d.risinggroundwaters e.uncontaminatedgroundwaterinfiltration(asdefinedat40CFR 35.2005(20)) f.uncontaminatedgroundwater g.dischargesfrompotablewatersources h.foundationdrains i.airconditioningcondensate j.irrigationwater k.springs l.waterfromcrawlspaceandbasementsumppumps m.footingdrains n.lawnandlandscapewateringrunoffprovidedthatallpesticidesand fertilizershavebeenappliedinaccordancewiththemanufacturers = productlabel; o.waterfromindividualresidentialcarwashing p.flowsfromriparianhabitatsandwetlands q.dechlorinatedswimmingpooldischarges r.residualstreetwashwater s.dischargesorflowsfromfirefightingactivities SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 6 (PartI.A.2.) t.dechlorinatedwaterreservoirdischarges u.anySPDESpermitteddischarge. Evenifthenonstormwaterdischargesaredeterminednottobesubstantial contributorsofpollutants,the Department recommendsthatthe covered entitysstormwatermanagementprogram(SWMP)includepublic A@ educationandoutreachactivitiesdirectedatreducingpollutionfromthese discharges. B. Limitations on Coverage Thefollowingarenotauthorizedbythis SPDESgeneralpermit: 1.Stormwaterdischarges whoseunmitigated,direct,indirect,interrelated, interconnected,orinterdependentimpactswouldjeopardizealistedendangeredor threatenedspeciesoradverselymodifydesignatedcriticalhabitat; 2.Stormwaterdischarges or implementation ofa coveredentitysSWMP,which adverselyaffectpropertieslistedoreligibleforlistingintheNationalRegisterof HistoricPlaces,unlessthecoveredentityisincompliancewithrequirementsofthe NationalHistoricPreservationActandhascoordinatedwiththeappropriateState HistoricPreservationOfficeanyactivitiesnecessarytoavoidorminimizeimpacts; 3.Stormwaterdischarges toterritorialseasnotoftheStateofNewYork,the contiguouszone,andtheoceansunlesssuch discharges areincompliancewiththe ocean discharge criteriaof40CFR125subpartM; 4.Stormwaterdischarges,thepermittingofwhichisprohibitedunder40CFR122.4 and/orthe ECL; C. Exemption Criteria For stormwaterdischarges fromadesignated smallMS4 thataremixedwith non stormwater or stormwater associatedwith industrialactivity,the Department may determinethemtobeexemptfromtherequirementsofthis SPDESgeneralpermit ifthe discharges are: 1.Effectivelyaddressedbyandincompliancewithadifferent SPDESgeneralpermit or an individualSPDESpermit;or 2.IdentifiedbyandincompliancewithPartI.A.2ofthis SPDESgeneralpermit. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 7 Part II. OBTAINING PERMIT COVERAGE A. Permit coverage is obtained by submission of a complete and accurate Notice Of Intent. B. Permit coverage is public noticed by the Department. NOIswillbepublicnoticedandanopportunityforpubliccommentprovidedonthe contentsofsubmittedNOIs. a.NOIsandthelocationoftheSWMPsandAnnualReportsforexistingMS4swillbe postedintheEnvironmentalNoticeBulletin(ENB). b.Adeadlineof28calendardaysfromthepostingintheENBwillbeprovidedfor receivingcomments. c.Afterthepubliccommentperiodhasexpired,the Department mayextendthe publiccommentperiod,requiresubmissionofanapplicationforanindividualSPDES permitoralternative SPDESgeneralpermit,oraccepttheNOIorSWMPas complete. C. Continuance of Permit Coverage for Covered Entities Authorized by GP-0-08-002 (Continuing Covered Entities) AsofMay1,2010,entitieswithcoverageunderGP008002willcontinuetohave authorizationtodischargeonaninterimbasisforupto180daysfromtheeffectivedate ofthis SPDESgeneralpermit.Coveredentitiesmaygaincoverageunderthis SPDES generalpermit bysubmissionoftheir2009AnnualReportdueinJune2010.Forpublic participationpurposes,theupdatedAnnualReportwillbeconsideredequivalentto submissionofanNOI. Whentheoperatorchanges,anewoperatorisadded,ortheindividualresponsiblefor theSWMPchanges,thesechangesmustbeindicatedontheMCCformsubmittedin accordancewithPartV.D.ItisnotnecessarytosubmitarevisedNoticeofIntent(NOI). D. Permit Coverage for Covered Entities Newly Designated Under GP-0-10-002 (Small MS4s not Previously Authorized by GP-0-08-002) Certain smallMS4s designatedby40CFRSection122.32(a)(1)werenotauthorizedby GP008002,butarenowrequiredtogaincoverageunderthis SPDESgeneralpermit. The smallMS4s werenotpreviouslyauthorizedbecausetheywereeither: requiredtogaincoverageunderGP008002,butweregrantedawaiverfromthat requirement; werenotrequiredtogaincoverageunderGP008002basedonthedesignation criteria,buttheyarenowwithinan AdditionallyDesignatedArea;or SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 8 (PartII.D.) wereotherwisenotpermittedunderGP008002. 1.Inorderfor stormwaterdischarges from smallMS4s tobenewlyauthorizedunder this SPDESgeneralpermit,an operator must: a.within180daysofreceivingwrittennotificationfromthe Department thata permitfordischargesfromMS4sisrequired,prepareanNOIusingtheform providedbythe Department(oraphotocopythereof);and b.submittheNOI,signedinaccordancewithPartVI.Jofthis SPDESgeneralpermit, to: NOTICEOFINTENT NYSDEC,BureauofWaterPermits th Floor 625Broadway,4 Albany,NY122333505 2.Operators whosubmitacompleteNOIinaccordancewiththerequirementsofthis SPDESgeneralpermit areauthorizedto dischargestormwater from smallMS4s, underthetermsandconditionsofthis SPDESgeneralpermit,uponwritten notificationfromtheDepartmentthatacompleteNOIhasbeenreceived. E Small MS4s Not Required to Gain Coverage Operators ofunregulated smallMS4s mayapplyforcoverageunderthis SPDESgeneral permit atanytime,perPartII.B. F. Extension of Permit Coverage to Covered Entitys Full Jurisdiction = Operators oftraditionallandusecontrolMS4smustextendtheimplementationof minimumcontrolmeasures(MCMs)4and5inaccordancewith Criterion3 ofthe DesignationCriteriaorapplyforawaiver,ifeligible. Operators ofallregulated smallMS4 smayalsoextendtheimplementationofanyofthe sixMCMstoareasundertheircontrol,butoutsideoftheexistingareacoveredbythis SPDESgeneralpermit.Thismaybedonebydescribingtheprogramcomponents (MCMs)beingextendedandthegeographicextenttowhichtheyarebeingextendedin theannualreport(PartV.C.)andindicatingintheMunicipalComplianceCertification (MCC)form(PartV.D.)thattheprogramwasextendedtothe coveredentitys full jurisdiction. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 9 (PartII.) G. Single Entity to Cover the MS4 Asingleentitymaygaincoveragefor,andonbehalfof,oneormoreregulatedMS4sto implementapartofanMCM,one,oralltheMCMs.Asingleentityshallbe definedbywatershed,municipalboundaries,specialdistrictboundaries,orother specificallydefinedboundaries.Thesingleentitymustdemonstratetothe Department thatitwasformedinaccordancewithapplicablestateand/orlocallegislation,andthat ithasthelegalauthorityandcapacity(financial,resources,etc.)tomeetthe requirementsofthis SPDESgeneralpermit.DependingontheMCM(s)implemented,the singleentityshalldemonstratethatithasthefollowingcapacities,asapplicableforeach MCMthatthesingleentityisseekingcoverageunderthisSPDESgeneralpermit: 1.Initiateandadministerappropriateenforcementprocedures, 2.Collect,finance,bondorotherwiseborrowmoneyforcapitalprojects, 3.Controlthemanagementandoperationofthestormsewersystem, 4.Implementbestmanagementpracticesatallmunicipalfacilitiesdischargingto theMS4,and 5.Obtainaccesstopropertythatmaybenecessaryforsitingstormwater managementfacilitiesand/orpractices. ThesingleentitymustsubmitacompleteNOIformtothe Department,detailingwhich oftheregulatedMS4sitwillgaincoverageforandwhichoftheMCMs,orpartsof MCMs,itwillimplementforeachparticularregulatedMS4.Acopyofthedocument formingthesingleentity,anddetailingthelegalauthorityandcapacityofthesingle entity,mustbeattachedtotheNOI.Priortothesingleentitygainingcoverageunder thisSPDESgeneralpermit,eachregulatedMS4,forwhichthesingleentitywill implementingoneormoreMCMmustsubmitacompletenoticeoftermination(NOT). Thisnoticeshallspecifywhichoftheminimumcontrolmeasuresthesingleentitywill implementfortheMS4andwhichoftheminimumcontrolmeasurestheMS4will implement. Part III. SPECIAL CONDITIONS A. Discharge Compliance with Water Quality Standards Wherea discharge isalreadyauthorizedunderthis SPDESgeneralpermit andislater determinedtodirectlyorindirectlycauseorhavethereasonablepotentialtocauseor contributetotheviolationofanapplicable waterqualitystandard,the Department will notifythe coveredentity ofsuchviolation(s)andmaytakeenforcementactionsforsuch violations.The coveredentity musttakeallnecessaryactionstoensurefuture discharges donotdirectlyorindirectlycauseorcontributetotheviolationofa water qualitystandard,andthe coveredentity mustdocumenttheseactionsinthe SWMP. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 10 (PartIII.A.) Compliancewiththisrequirementdoesnotpreclude,limit,oreliminateany enforcementactivityasprovidedbytheFederaland/orStatelawfortheunderlying violation.Additionally,ifviolationsofapplicablewaterqualitystandardsoccur,then coverageunderthis SPDESgeneralpermit maybeterminatedbythe Department in accordancewith7501.21(e),andtheDepartmentmayrequireanapplicationforan alternative SPDESgeneralpermit or individualSPDESpermit maybeissued. B. Impaired Waters 1.ImpairedWatersWithoutWatershedImprovementStrategiesorFutureTMDLs Ifa smallMS4discharges astormwaterpollutantofconcern(POC)toan impaired waterlistedinAppendix2,thecoveredentitymustensurenonetincreaseinits discharge ofthelisted POC tothatwater. ByJanuary8,2013,coveredentities mustassesspotentialsourcesofdischargeof stormwater POC(s),identifypotentialstormwaterpollutantreductionmeasures,and evaluatetheirprogressinaddressingthePOC(S).Newlyauthorizedcoveredentities mustperformtheabovetaskswithin5yearsaftergainingcoverageunderthisSPDES generalpermit.Coveredentitiesmustevaluatetheir SWMP withrespecttothe MS4'seffectivenessinensuringthereisnonetincreasedischargeofstormwater POC(s)totheimpairedwatersfor stormsewersheds thathaveundergone nonnegligiblechangessuchaschangestolanduseandimperviouscovergreater thanoneacre,orstormwatermanagementpracticesduringthetimetheMS4has beencoveredbythis SPDESgeneralpermit.Thisassessmentshallbeconductedfor theportionsofthe smallMS4stormsewershed that discharge tothelistedwaters (seeAppendix2).Theassessmentshallbedoneusing Department supported modelingofpollutantloading. IfthemodelingshowsincreasesinloadingofthePOC,theSWMPmustbemodified toreducetheloadingtomeetthenonetincreaserequirement.Thesubsequent annualreportsmustcontainanassessmentofprioritystormwaterproblems, potentialmanagementpracticesthatareeffectiveforreductionofstormwater POC(s),anddocumentagrossestimateoftheextentandcostofthepotential improvements. 2.WatershedImprovementStrategies The SWMP sfor coveredentities inthewatershedslistedbelowmustbemodifiedto complywiththefollowingrequirementsandthewatershedimprovementstrategies. Coveredentities implementingthepollutantspecificBMPsinadditiontotheBMPs requiredofall coveredentities willbetakingsatisfactorystepstowardsachieving compliancewithTMDLrequirements.Coveredentities undertheMS4 SPDESgeneral SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 11 (PartIII.B.2.) permit arerequiredtomakebesteffortstoparticipateinlocallybasedwatershed planningeffortsthatinvolvetheNYSDEC,othercoveredentities,stakeholdersand otherinterestedpartiesforimplementationofloadreductionBMPs.Covered entitiesmayformaRegionalStormwaterEntity(RSE)toimplementstormwater retrofitscollectively.The coveredentities mustensurethatdischargesofthe POC to the TMDL waterbodyarereducedthroughtheseoradditionalchangestothe SWMP sothatthewasteloadallocationismet. MS4sarerequiredtomeetthereductionofthePOCdefinedbytheTMDLprogram definedinPartIXofthis SPDESgeneralpermit.BythedeadlinesdefinedinPartIXof thegeneralpermit,coveredentities mustassesstheirprogressandevaluatetheir SWMP todeterminethe MS4's effectivenessinreducingtheirdischargesof TMDL POC(s)to TMDL waterbodies.Newlydesignatedwatershedimprovementstrategy areasmustperformtheassessmentwithin5yearsfromauthorizationunderthis SPDESgeneralpermit.Thisassessmentshallbeconductedfortheportionsofthe smallMS4stormsewershed thatarewithinthe TMDL watershed.Theassessment shallbedoneusing Department supportedmodelingofpollutantloadingfromthe stormsewershed.The coveredentities oranRSEmustprepareandimplement, participateinorutilizetheresultsofexistingorongoingambientwaterquality monitoringprogramstovalidatetheaccuracyofmodelsandevaluatethe effectivenessoftheadditionalBMPSforwatershedimprovementstrategies. IfthemodelingshowsthatloadingofthePOCisnotbeingreducedtomeetthe wasteloadallocation,theSWMPmustbemodifiedtoreducethepollutantloading tomeetthewasteloadallocation. EachregulatedMS4isresponsibleforanindividualloadreduction,whichisa fractionofthetotalrequiredloadreductionintheTMDL.IfMS4sformanRSEand stormwaterretrofitsareapproachedcollectively,the Department wouldallow compliancewiththisconditionoftheSPDESgeneralpermittobeachievedona regionalbasis. InthiscasetheloadreductionrequirementforeachparticipatingMS4willbe aggregated,tocreateanRSEloadreduction,toallowdesignandinstallationof retrofitswheretheyaremostfeasible,withoutrestrictingMS4stositeretrofit projectswithintheirmunicipalboundaries. EachmemberofanRSEisincomplianceiftheaggregatereductionnumber associatedwiththeretrofitplansismet.Iftheaggregatenumberisnotmet,eachof theparticipatingMS4swouldbedeemednoncompliantuntilsuchtimeastheyhad mettheirindividualloadreductionrequirements. ModificationsmustbeconsideredforeachofthesixMCMs.Refertoassistance documentsorenhancedrequirementsforspecificpollutantsindocumentsonthe Department swebsiteformodificationsspecifictothe TMDL.Revised SWMPs must = includeupdatedschedulesforimplementation. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 13 (PartIII.B.3.) WithinthreeyearsofhavingmodifieditsSWMPtoensurethatreductionofthePOC specifiedintheTMDLisachieved,coveredentitiesinfutureTMDLareasmustassess theirprogressandevaluatetheir SWMP todeterminethe MS4's effectivenessin reducingtheirdischargesof TMDLPOC(s)to TMDL waterbodies.Thisassessment shallbeconductedfortheportionsofthe smallMS4stormsewershed thatare withinthe TMDL watershed.Theassessmentshallbedoneusing Department supportedmodelingofpollutantloadingfromthe stormsewershed. Part IV. Stormwater Management Program (SWMP) Requirements A. SWMP Background Coveredentities must develop(fornewlyauthorizedMS4s,implement),andenforcea SWMP designedtoreducethe discharge ofpollutantsfrom smallMS4s tothe maximum extentpracticable(MEP)inordertoprotectwaterqualityandtosatisfythe A@ appropriatewaterqualityrequirementsofthe ECL andtheCWA.Theobjectiveofthe permitisforMS4stoassureachievementoftheapplicablewaterqualitystandards. Coveredentities underGP008002musthaveprepareda SWMPplan documenting modificationstotheir SWMP.SeePartX.B.(Definitions)formoreinformationaboutthe SWMP and SWMPplan. The SWMP and SWMPplan maybecreatedbyanindividual coveredentity,byashared effortthroughagrouporcoalitionofindividual coveredentities,orbyathirdparty entity.The SWMPplan shallbemadereadilyavailabletocoveredentitysstaff,tothe = publicandto Department andEPAstaff. B. Cooperation Between Covered entities Encouraged The Department encourages coveredentities tocooperatewhen developing and 2 .However,each coveredentity isresponsibleforobtaining implementing their SWMP itsownpermitcoverageandforfilingitsownNOI.Irrespectiveofanyagreements between coveredentities,eachindividual coveredentity remainslegallyresponsiblefor satisfyingallGP010002requirementsandforitsown discharges.Ifone coveredentity isrelyingonanother coveredentity tosatisfyoneormoreofitspermitobligations,that factmustbenotedonthe coveredentity's MCCform.Theotherentitymust,infact, implement theMCM(s)andmustagreeto implement theMCM(s)onthefirst covered entity's behalf.Thisagreementbetweenthetwoormorepartiesmustbedocumented 2 For example, villages are encouraged to cooperate with towns, towns with counties, and adjacent counties with each non-traditional MS4s other. In addition, municipal governments are encouraged to coordinate and cooperate with such as DOT, school and fire districts, Federal and State facilities located within and adjacent to their jurisdictions. Sewer boards, water boards, or other non-traditional entities are encouraged to partner with the municipality (municipalities) that they serve. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 14 inwritingandsignedbyboth(all)parties.PartIV.G.belowmayapplyifsuchan agreement (Part IV.B.) isnotalreadyinplace.Theagreementmustbeincludedinthe SWMPplan,andbe retainedbythe coveredentity forthedurationofthis SPDESgeneralpermit,including anyadministrativeextensionsofthepermitterm. Coveredentities thatareworkingtogetherto develop(fornewlyauthorizedMS4s)or implement their SWMP sareencouragedtocompletesharedannualreports.Covered entities mayalsoholdagroupmeetingtopresenttheirannualreportstothepublicand toreceivecommentsontheirannualreports.Theseoptionsarediscussedinmoredetail inPartV.C.2. C.SWMP Coverage Area Ataminimum,coveredentities arerequiredto develop(fornewlyauthorizedMS4s)and implementSWMP sintheautomaticallydesignated urbanizedareas(UA)and A@ additionallydesignated areas(40CFRSection122.32(a)(1)or122.32(a)(2))undertheir 3 jurisdiction. SWMP coverageshallincludeallUAoradditionallydesignatedareaswithinthe covered entity sjurisdictionthatdrainintotheir smallMS4 andsubsequently discharge to = surfacewatersoftheState directlyorthroughother smallMS4s. Operatorsof smallMS4s whosejurisdictionincludesregulatedandunregulatedareas areencouragedtoincludetheirentirejurisdictionintheir SWMP(refertoPartII.D). D. SWMP Development and Implementation for Covered entities Authorized by GP-0-08-002(Continuing Covered entities) Coveredentities authorizedunderGP008002shallcontinuetofully implement their SWMP,unlessotherwisestatedinthis SPDESgeneralpermit.A coveredentity may modifyits SWMP ifitdetermineschangesareneededtoimprove implementation ofits SWMP.Anychangestoa SWMP shallbereportedtothe Department intheMS4's 3 Thepurposeofthissectionistominimizeconflictsbetweenadjacent smallMS4s.Forthepurposesofthis SPDESgeneral permit,areasunderthe coveredentitys jurisdictionshallmeanareaswherethelegalauthorityexistsforthesubject covered entity to develop and implement an SWMP includingthesixMCMs.Itisnotapermitrequirementfor coveredentities to implement andenforceanyportionoftheir SWMP inanyareathatisunderthejurisdictionofanother coveredentity.For example,ifaportionofatowndrainsdirectlyintoastormwatersystemownedandoperatedbytheStateDOT,andthisareaof thetownisregulated,theDOTwillnotberequiredtoimplementandenforceanyportionofa SWMP inthearealyingoutside ofitsrightofway.Inthiscase,thetownwouldberequiredtoimplementtheprograminthesubjectareainaccordancewith this SPDESgeneralpermit,thisdespitethefactthatthesubjectdrainagedoesnotdirectlyenterthetownssystem. = SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 15 annualreportandMunicipalComplianceCertification(MCC)form(SeePartV.Cand V.D). (PartIV.) E. SWMP Development and Implementation for Newly Regulated Covered entities (Small MS4s not Previously Authorized by GP-0-08-002) Certain smallMS4s designatedby40CFRSection122.32(a)(1)werenotauthorizedby GP008002,butarenowrequiredtogaincoverageunderthis SPDESgeneralpermit. The smallMS4s werenotpreviouslyauthorizedbecausetheywereeither: requiredtogaincoverageunderGP008002,butweregrantedawaiverfromthat requirement; werenotrequiredtogaincoverageunderGP008002basedonthedesignation criteria,buttheynowmeettheadditionaldesignationcriteriainNYSDEC DesignationCriteriaforIdentifyingRegulatedMunicipalSeparateStormSewer A Systems;or @ wereotherwisenotpermittedunderGP008002. Operators of smallMS4s newlyregulatedunderthis SPDESgeneralpermit must develop aninitial SWMP andprovideadequateresourcestofully implement the SWMP nolater thanthreeyearsfromthedateoftheindividualMS4'sauthorization. Anewlyregulated coveredentity maymodifyits SWMP tocomplywiththetermsand conditionsofthis SPDESgeneralpermit ifitdetermineschangesareneededtoimprove implementation ofits SWMP.Anychangestoa SWMP shallbedocumentedinthe SWMPplan andreportedtothe Department intheannualreport(SeePartV.C). Coveredentities arerequiredtomakesteadyprogresstowardfull implementation inthe firstthreeyearsafterthedateofauthorization.Full implementation of SWMP sfor newlyregulated smallMS4s isexpectednolaterthanthreeyearsfromthedateof coverageunderthis SPDESgeneralpermit. F. Minimum Control Measures Each coveredentity isrequiredtodevelop(fornewlyauthorizedMS4s)andimplementa SWMP thatsatisfiestherequirementsforeachofsixrequiredprogramcomponents, knownasminimumcontrolmeasures(MCMs). TheMCMsfor traditionallandusecontrolMS4s arelistedinPartVII.TheMCMsfor traditionalnonlandusecontrolMS4s and nontraditionalMS4s arelistedinPartVIII. AdditionalMCMsthat coveredentities inwatershedswithimprovementstrategiesmust address,referredtoinPartIII.B.2,aredescribedinPartIX. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 16 (PartIV.) G. Reliance Upon Third Parties Thissectionapplieswhena coveredentity reliesuponanythirdpartyentityto develop or implement anyportionofits SWMP.Examplesofsuchentitiesinclude,butarenot limitedtoanongovernment,commercialentitythatreceivespaymentfromthe coveredentity forservicesprovided(forexamplebusinessesthatcreatepoliciesor proceduresfor coveredentities,performillicitdischargeidentificationandtrackdown, maintainroads,removesnow,cleanstormsewersystem,sweepstreets,etcas contractedbythecoveredentity). Thecoveredentitymust,throughasignedcertificationstatement,contractor agreementprovideadequateassurancethatthethirdpartieswillcomplywithpermit requirementsapplicabletotheworkperformedbythethirdparty.Thecertification statement,contractorotheragreementmust: provideadequateassurancethatthethirdpartywillcomplywithpermit requirements; identifytheactivitiesthatthethirdpartyentitywillberesponsibleforandinclude thenameandtitleofthepersonprovidingthesignature; thename,addressandtelephonenumberofthethirdpartyentity; anidentifyingdescriptionofthelocationoftheworkperformed;and thedatethecertificationstatement,contractorotheragreementissigned. Examplecertificationlanguageisprovidedbelow: ContractedEntityCertificationStatement: IcertifyunderpenaltyoflawthatIunderstandandagreetocomplywiththetermsand A conditionsofthe(coveredentitysname)stormwatermanagementprogramandagree = toimplementanycorrectiveactionsidentifiedbythe(coveredentitysname)ora = representative.Ialsounderstandthatthe(coveredentitysname)mustcomplywiththe = termsandconditionsoftheNewYorkStatePollutantDischargeEliminationSystem (SPDES)generalpermitforstormwaterdischargesfromtheMunicipalSeparateStorm A@ SewerSystems(MS4s")andthatitisunlawfulforanypersontodirectlyorindirectly A causeorcontributetoaviolationofwaterqualitystandards.Further,Iunderstandthat anynoncomplianceby(coveredentitysname)willnotdiminish,eliminate,orlessen = myownliability. @ SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 17 Part V. PROGRAM ASSESSMENT, RECORD KEEPING, REPORTING AND CERTIFICATION REQUIREMENTS A. Assessment Coveredentities arerequiredtocollectandreportinformationaboutthe development and implementation oftheirSWMPs.Specificinformationthe smallMS4s arerequired tocollectisidentifiedinPartsVIIorVIII,dependingonthetypeof smallMS4.The small MS4s areencouragedtocollectadditionalinformationthatwillhelpthemevaluatetheir SWMP.Collectionofinformationovertimewillfacilitatetheevaluationofthe covered entitysSWMP byallowingtheexaminationoftrendsintheinformationcollected. The coveredentity mustconductanannualevaluationofitsprogramcompliance,the appropriatenessofitsidentified BMPs,meetingnewpermitrequirements,andprogress towardsachievingitsidentified measurablegoals,whichmustincludereducingthe discharge ofpollutantstothe MEP. WheretheevaluationshowsthattheSWMPisnotreducingdischargestothe MEP,the SWMPshallberevisedtoreducedischargestothe MEP.UpdatetotheSWMPandthe SWMPplanmustbecompletedwithinayearfromtheannualevaluationoftheirSWMP withanimplementationschedulenolaterthan3yearsfromtheannualevaluation. B. Recordkeeping The coveredentity mustkeeprecordsrequiredbythis SPDESgeneralpermit(records thatdocument SWMP,recordsincludedin SWMPplan,otherrecordsthatverify reportingrequiredbythepermit,NOI,pastannualreports,andcommentsfromthe publicandthe Department,etc.)foratleastfive(5)yearsaftertheyaregenerated. Recordsmustbesubmittedtothe Department within5businessdaysofreceiptofa Department requestforsuchinformation.The coveredentity shallkeepduplicate records(eitherhardcopyorelectronic),tohaveonecopyforpublicobservationanda separateworkingcopywherethe coveredentitys staff,otherindividualsresponsiblefor the SWMP andregulators,suchas Department andEPAstaffcanaccessthem.Records, includingtheNOIandthe SWMPplan,mustbeavailabletothepublicatreasonable timesduringregularbusinesshours. C. Newlyregulated coveredentities arerequiredtosubmittheirfirstannualreport theyearthatauthorizationisgrantedifauthorizationisgrantedonorbefore December31ofthatreportingyear. b.AnnualReportSubmittalforCoveredentitiesAuthorizedbyGP008002 (ContinuingCoveredentities) Beginningwithannualreportsduein2010 coveredentities implementingtheir SWMP shallsubmit,ataminimum,informationspecifiedbythe Department in PartVIIorVIIIinaformatprovidedbythe Department. 2.SharedAnnualReportingandSubmittal Coveredentities workingtogetherto develop(fornewlyauthorizedMS4s)and/or implement their SWMP smaycompleteasharedannualreport.Thesharedannual reportisanannualreportthatoutlinesandexplainsgroupactivities,butalso includesthetasksperformedbyindividual coveredentities(BMPs,measurable goals,schedulesofplannedactivities,etc.).Tofacilitatethesubmissionofone annualreportfortheentiregroupof coveredentities,individual coveredentitys activitiesmaybeincorporatedintothereportbyeither: providingthedetailsspecifictotheir smallMS4(s)toaperson(s)who incorporatesthatinformationintothegroupreport.Thatonegroupreportis submittedtothe Department forallparticipating smallMS4s;or providingthedetailsspecifictotheir smallMS4(s)onaseparatesheet(s)that willbeattachedwiththeonegroupreport. TheMCCform,providedbythe Department,certifiesthatallapplicableconditionsof PartsIV,VII,VIIIandIXofthis SPDESgeneralpermit arebeing developed,implemented andcompliedwith.ItmustbesignedbyanindividualasdescribedinPartVI.J.2.The certificationprovidedbytheMCCformdoesnotaffect,replaceornegatethe certificationrequiredunderPartVI.J(2)(d).Ifcompliancewithanyrequirementcannot becertifiedtoontheMCCform,acompleteexplanationwithadescriptionofcorrective measuresmustbeincludedasrequestedontheMCCform. Failuretosubmitacompleteannualreport(PartV.C.)andacompleteMCCformshall constituteapermitviolation. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 21 Part VI. STANDARD PERMIT CONDITIONS A. General Authority to Enforce ThreeoftheMCMs(illicitdischargedetectionandelimination,constructionsite stormwater runoffcontrolandpostconstruction stormwater management)requirelocal laws,ordinancesorotherregulatorymechanismstoensuresuccessfulimplementationof theMCMs.Some coveredentities,however,arenotenabledbystatelawtoadoptlocal lawsorordinances.Those coveredentities(typicallynontraditionalMS4sandtraditional, nonlandusecontrolMS4s)areexpectedtoutilizetheauthoritytheydopossessto createormodifyexistingregulatorymechanisms,includingbutnotlimitedtocontracts, bidspecifications,requestsforproposals,etc.toensuresuccessfulimplementation. B. Duty To Comply A coveredentity mustcomplywithallconditionsofthispermit.Anypermit noncomplianceconstitutesaviolationoftheCWAandthe ECL andisgroundsfor enforcementaction. C. Enforcement Failureofthe coveredentity,itscontractors,subcontractors,agentsand/orassignsto strictlyadheretoanyofthe SPDESgeneralpermit requirementscontainedhereinshall constituteapermitviolation.Therearesubstantialcriminal,civil,andadministrative penaltiesassociatedwithviolatingtheprovisionsofthispermit.Finesofupto$37,500 perdayforeachviolationandimprisonmentforuptofifteen(15)yearsmaybeassessed dependinguponthenatureanddegreeoftheoffense. D. Continuation of the Expired SPDES General Permit This SPDESgeneralpermit expiresfiveyearsfromtheeffectivedateofthispermit. However,anadministrativelyextended SPDESgeneralpermit continuesinforceand effectuntilthe Department issuesanewpermit,unlessa coveredentity receiveswritten noticefromthe Department tothecontrary.Operators ofthe MS4s authorizedunderthe administrativelyextendedexpiring SPDESgeneralpermit seekingcoverageunderthe new SPDESgeneralpermit mustrefertothetermswithinthenew SPDESgeneralpermit tocontinuecoverage. E. Technology Standards Coveredentities,inaccordancewithwrittennotificationbythe Department,must complywithallapplicabletechnologybasedeffluentstandardsorlimitations promulgatedbyEPApursuanttoSections301and304oftheCWA.Ifaneffluent standardorlimitationmorestringentthananyeffluentlimitationinthe SPDESgeneral permit orcontrollingapollutantnotlimitedinthepermitispromulgatedorapproved SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 22 (PartVI.E.) afterthepermitisissued,the SWMPplan shallbepromptlymodifiedtoincludethat effluentstandardorlimitation. F. Duty to Mitigate The coveredentity shalltakeallreasonablestepstominimizeorpreventany discharge in violationofthis SPDESgeneralpermit whichhasareasonablelikelihoodofadversely affectinghumanhealthortheenvironment. H. Duty to Provide Information The coveredentity shall,withinfive(5)businessdays,makeavailableforinspectionand copyingorfurnishtothe Department oranauthorizedrepresentativeofthe Department anyinformationthatisrequestedtodeterminecompliancewiththis SPDESgeneral permit.Failuretoprovideinformationrequestedshallbeaviolationofthetermsofthis SPDESgeneralpermit andapplicableregulation. I. Other Information Coveredentities whobecomeawareofafailuretosubmitanyrelevantfactsorhave submittedincorrectinformationintheNOIorinanyotherreporttothe Department mustpromptlysubmitsuchfactsorinformation. J. Signatory Requirements AllNOIs,reports,certificationsorinformationsubmittedtothe Department,orthatthis SPDESgeneralpermit requiresbemaintainedbythe coveredentity,shallbesignedas follows: 1.NoticesofIntent AllNOIsshallbesignedbyeitheraprincipalexecutiveofficerorrankingelected official.Principalexecutiveofficerincludes(1)thechiefexecutiveofficerofthe municipalentityagency,or(2)aseniorexecutiveofficerhavingresponsibilityforthe overalloperationsofaprincipalgeographicunitoftheagency. 2.ReportsRequiredandOtherInformationRequested Allreportsrequiredbythis SPDESgeneralpermit andotherinformationrequestedby the Department,includingMCCforms(partV.D.),shallbesignedbyaperson SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 23 (PartVI.J.2.) 4 describedaboveorbyadulyauthorizedrepresentativeofthatperson.Apersonisa dulyauthorizedrepresentativeonlyif: a.TheauthorizationismadeinwritingbyapersondescribedinVI.J.1aboveand submittedtothe Department;and b.Theauthorizationspecifieseitheranindividualorapositionhavingresponsibility fortheoveralloperationoftheregulatedfacilityoractivity,suchastheposition ofplantmanager,operatorofawellorwellfield,superintendent,orpositionof equivalentresponsibility,oranindividualorpositionhavingoverallresponsibility forenvironmentalmattersforthe coveredentity(adulyauthorized representativemaythusbeeitheranamedindividualoranyindividualoccupying anamedposition);and c.Thewrittenauthorizationshallincludethename,titleandsignatureofthe authorizedrepresentativeandbeattachedtotheMCCform;and d.Changestoauthorization.Ifanauthorizationtodischargeisnolongeraccurate becauseadifferent coveredentity hasresponsibilityfortheoveralloperationof another coveredentitys program,thesechangesmustbeindicatedontheMCC formsubmittedtothe Department perPartV.D. e.Initialsignatoryauthorizationorchangestosignatoryauthorization.Theinitial signatoryauthorizationmustbesubmittedtothe Department withanyreportsto besignedbyasignatoryrepresentative.IfasignatoryauthorizationunderVI.J.2is nolongeraccuratebecauseadifferentindividual,orposition,hasresponsibility fortheoveralloperationofthefacility,anewsignatoryauthorizationsatisfying therequirementsofVI.J.2mustbesubmittedtothe Department withanyreports tobesignedbyanauthorizedrepresentative. f.Certification.AnypersonsigningdocumentsunderparagraphVI.Hshallmakethe followingcertification: Icertifyunderpenaltyoflawthatthisdocumentandallattachmentswere preparedundermydirectionorsupervisioninaccordancewithasystemdesigned toassurethatqualifiedpersonnelproperlygatheredandevaluatedthe 4 Positionsthatmustbedulyauthorizedinclude,butarenotlimitedto,EnvironmentalDirectors,DeputySupervisors,Safetyand EnvironmentalManagers,AssistantDirectors,andChiefHealthandSafetyOfficers. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 24 (PartVI.J.2.f.) informationsubmitted.Basedonmyinquiryofthepersonorpersonswhomanage thesystem,orthosepersonsdirectlyresponsibleforgatheringtheinformation, theinformationsubmittedis,tothebestofmyknowledgeandbelief,true, accurate,andcomplete.Iamawarethattherearesignificantpenaltiesfor submittingfalseinformation. UnderPartVI.J.(SignatoryRequirements),itshallconstituteapermitviolationifan incorrectand/orimpropersignatoryauthorizesanyrequiredforms,and/orreports. K. Penalties for Falsification of Reports Article17ofthe ECL providesacivilpenaltyof$37,500perdayperviolationofthis permit.Articles175and210oftheNewYorkStatePenalLawprovideforacriminal penaltyofafineand/orimprisonmentforfalsifyingreportsrequiredunderthispermit.. L. Oil and Hazardous Substance Liability Nothinginthis SPDESgeneralpermit shallbeconstruedtoprecludetheinstitutionofany legalactionorrelievethe coveredentity fromanyresponsibilities,liabilities,orpenalties towhichitisormaybesubjectundersection311oftheCWAorsection106ofthe ComprehensiveEnvironmentalResponse,CompensationandLiabilityActof1980 (CERCLA). M. Property Rights Theissuanceofthis SPDESgeneralpermit doesnotconveyanypropertyrightsofany sort,noranyexclusiveprivileges,nordoesitauthorizeanyinjurytoprivatepropertynor anyinvasionofpersonalrights,noranyinfringementofFederal,Stateorlocallawsor regulations,nordoesitlimit,diminishand/orstaycompliancewithanytermsofthis permit. N. Severability Theprovisionsofthis SPDESgeneralpermit areseverable,andifanyprovisionofthis SPDESgeneralpermit,ortheapplicationofanyprovisionofthis SPDESgeneralpermit to anycircumstance,isheldinvalid,theapplicationofsuchprovisiontoother circumstances,andtheremainderofthispermitshallnotbeaffectedthereby. O. Requiring an Individual Permit or an Alternative General Permit 1.Initssolediscretion,the Department mayrequireanypersonauthorizedbythis SPDESgeneralpermit toapplyforand/orobtaineitheran individualSPDESpermit or analternative SPDESgeneralpermit.Wherethe Department requiresa coveredentity toapplyforan individualSPDESpermit,the Department willnotifysuch SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 25 (PartVI.O.1.) personinwritingthatapermitapplicationisrequired.Thisnotificationshallincludea briefstatementofthereasonsforthisdecision,anapplicationform,astatement settingadeadlineforfilingtheapplication,andadeadlinenotsoonerthan180days fromcoveredentitysreceiptofthenotificationletter,wherebytheauthorizationto = dischargeunderthisgeneralpermitshallbeterminated.Applicationsmustbe submittedtotheappropriateRegionalOffice.The Department maygrantadditional timetosubmittheapplicationuponrequestoftheapplicant. 2.Any coveredentity authorizedbythis SPDESgeneralpermit mayrequesttobe excludedfromthecoverageofthis SPDESgeneralpermit byapplyingforan individual SPDESpermitoranalternativeSPDESgeneralpermit.Insuchcases,a coveredentity mustsubmitanindividualapplicationoranapplicationforanalternative SPDES generalpermit inaccordancewiththerequirementsof40CFR122.26(c)(1)(ii),with reasonssupportingtherequest,tothe Department attheaddressfortheappropriate RegionalOffice.Therequestmaybegrantedbyissuanceofany individualSPDES permit oranalternative SPDESgeneralpermit ifthereasonscitedbythe covered entity areadequatetosupporttherequest. 3.WhenanindividualSPDESpermitisissuedtoadischargerauthorizedtodischarge undera SPDESgeneralpermit forthesamedischarge(s),thegeneralpermit authorizationforoutfallsauthorizedundertheindividualpermitisautomatically terminatedontheeffectivedateoftheindividualpermitunlessterminationisearlier inaccordancewith6NYCRRPart750. P. Other State Environmental Laws 1.Nothinginthis SPDESgeneralpermit shallbeconstruedtoprecludetheinstitutionof anylegalactionorrelievea coveredentity fromanyresponsibilities,liabilities,or penaltiesestablishedpursuanttoanyapplicable State laworregulationunder authoritypreservedbysection510oftheCWA. 2.Noconditionofthis SPDESgeneralpermit releasesthe coveredentity fromany responsibilityorrequirementsunderotherenvironmentalstatutesorregulations. Q. Proper Operation and Maintenance A coveredentity mustatalltimesproperlyoperateandmaintainallfacilitiesandsystems oftreatmentandcontrol(andrelatedappurtenances)whichareinstalledorusedbythe coveredentity toachievecompliancewiththeconditionsofthis SPDESgeneralpermit. Properoperationandmaintenancealsoincludesadequatelaboratorycontrolsand appropriatequalityassuranceprocedures.Properoperationandmaintenancerequires theoperationofbackuporauxiliaryfacilitiesorsimilarsystems, SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 26 (PartVI.Q.) installedbya coveredentity onlywhennecessarytoachievecompliancewiththe conditionsofthe SPDESgeneralpermit. R. Inspection and Entry The coveredentity shallallowtheCommissionerofNYSDEC,theRegionalAdministrator oftheUSEPA,theapplicablecountyhealthdepartment,ortheirauthorized representatives,uponthepresentationofcredentialsandotherdocumentsasmaybe requiredbylaw,to: 1.Enteruponthe coveredentitys premiseswherearegulatedfacilityoractivityis locatedorconductedorwhererecordsmustbekeptundertheconditionsofthis SPDESgeneralpermit; 2.Haveaccesstoandcopy,atreasonabletimes,anyrecordsthatmustbekeptunder theconditionsofthispermit,includingrecordsrequiredtobemaintainedfor purposesofoperationandmaintenance;and 3.Inspectatreasonabletimesanyfacilitiesorequipment(includingmonitoringand controlequipment),practices,oroperationsregulatedorrequiredunderthepermit. S. Permit Actions Atthe Department ssolediscretion,this SPDESgeneralpermit maybemodified, = revoked,suspended,orrenewedforcauseatanytime. T. Anticipated noncompliance Thecoveredentityshallgiveadvancenoticetothe Department ofanyplannedchanges inthepermittedfacilityoractivitywhichmayresultinnoncompliancewithpermit requirements.Notificationofplannedchangesoranticipatednoncompliancedoesnot limit,diminishand/orstaycompliancewithanytermsofthispermit. U. Permit Transfers Coverageunderthis SPDESgeneralpermit isnottransferabletoanypersonexceptafter noticetothe Department.The Department mayrequiremodificationorrevocationand reissuanceofthisSPDESgeneralpermittochangetheresponsiblepartyandincorporate suchotherrequirementsasmaybenecessary. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 27 Part VII. MINIMUM CONTROL MEASURES - TRADITIONAL LAND USE CONTROL A. Traditional Land-Use Control MS4 Minimum Control Measures (MCMs) TheseMCMsapplyto traditionallandusecontrolMS4s(cities,towns,villages).The SWMPforthese smallMS4s mustbecomprisedofthe6MCMsbelow.Itis recommendedthatcoveredentitiesrefertoassistanceandguidancedocuments availablefromthe State andEPA. ContinuingcoveredentitieswererequiredtodevelopaSWMPwiththeMCM requirementsbelowbyJanuary8,2008(ifauthorizedbyGP0202)andwithinthree yearsofgainingcoverage(ifauthorizedbyGP008002).Underthis SPDESgeneral permit,thecontinuing coveredentities arerequiredtoimplementtheirSWMP,including theMCMrequirementsbelow.Notwithstandinganysoonerdeadlinescontained elsewherewithinthispermit,newlyregulated coveredentities arerequiredtodevelop theirSWMP,containingtheMCMrequirementsbelow,withinthefirst3yearsof coverageandthencommenceimplementation. ForeachoftheelementsoftheSWMPplan,the coveredentity mustidentify(i)the agenciesand/orofficesthatwouldberesponsibleforimplementingtheSWMPplan elementand(ii)anyprotocolsforcoordinationamongsuchagenciesand/oroffices necessaryfortheimplementationoftheplanelement. The coveredentity may develop(fornewlyauthorizedMS4s)and/or implement their SWMP withintheirjurisdictionontheirown.The coveredentity mayalso develop(for newlyauthorizedMS4s)and/or implement partoralloftheir SWMP throughan intermunicipalprogramwithanother coveredentity(s)orthroughothercooperativeor contractualagreementswiththirdpartiesthatprovideservicestothe coveredentities. 1.PublicEducationandOutreachSWMPDevelopment/Implementation Ataminimum,all coveredentities must: a.Identify POCs,waterbodiesofconcern,geographicareasofconcern,target audiences; b.Develop(fornewlyauthorizedMS4s)and implement anongoingpubliceducationand outreachprogramdesignedtodescribetothegeneralpublicandtargetaudiences: i.theimpactsof stormwaterdischarges onwaterbodies; ii.POC sandtheirsources; iii.stepsthatcontributorsofthesepollutantscantaketoreducepollutantsin stormwater runoff;and SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 28 (PartVII.A.1.b.) iv.stepsthatcontributorsofnon stormwaterdischarges cantaketoreduce pollutants(non stormwaterdischarges arelistedinPartI.A.2); c.Develop(fornewlyauthorizedMS4s),record,periodicallyassess,andmodifyas needed,measurablegoals;and d.Selectandimplementappropriateeducationandoutreach activities and measurable goals toensurethereductionofall POC sin stormwaterdischarges tothe MEP. Implementation reportingmaybeginearlierif implementation beginsduring development period. 2.PublicInvolvement/ParticipationSWMPDevelopment/Implementation Ataminimum,all coveredentities must: a.Complywiththe StateOpenMeetingsLaw andlocalpublicnoticerequirements,such as OpenMeetingsLaw,whenimplementingapublicinvolvement/participation program; b.Develop(fornewlyauthorizedMS4s)and implement apublic involvement/participationprogramthat: i.identifieskeyindividualsandgroups,publicandprivate,whoareinterestedinor affectedbythe SWMP; SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 30 (PartVII.A.2.b.) ii.identifiestypesofinputthe coveredentity willseekfromthekeyindividualsand groups,publicandprivate,tosupport development and implementation ofthe SWMPprogramandhowtheinputwillbeused;and iii.describesthepublicinvolvement/participationactivitiesthe coveredentity will undertaketoprovideprogramaccesstothosewhowantitandtogatherthe neededinput.Theactivitiesincluded,butarenotlimitedtoawaterquality hotline(reportspills,dumping,constructionsitesofconcern,etc.),stewardship activitieslikestreamcleanups,stormdrainmarking,andvolunteerwaterquality monitoring; iv.providetheopportunityforthepublictoparticipateinthe development, implementation,review,andrevisionofthe SWMP. c.Localstormwaterpubliccontact. Identifyalocalpointofcontactforpublicconcernsregarding stormwater managementandcompliancewiththis SPDESgeneralpermit.Thenameortitleof thiscontactandthetelephonenumbermustbepublishedinpublicoutreachand publicparticipationmaterialsandkeptupdatedwiththe Department ontheMCC form; d.Annualreportpresentation. Belowaretherequirementsfortheannualreportpresentation: i.priortosubmittingthefinalannualreporttothe Department,byJune1ofeach reportingyear(seePartV.C.),presentthedraftannualreportinaformatthatis opentothepublic,wherethepubliccanaskquestionsaboutandmake commentsonthereport.Thiscanbedone: atameetingthatisopentothepublic,wherethepublicattendeesareableto askquestionsaboutandmakecommentsonthereport.Thismaybea regularmeetingofanexistingboard,suchasplanning,zoningorthetown board.Itmayalsobeaseparatemeeting,specificallyfor stormwater.If multiple coveredentities areworkingtogether,theymayhaveagroup meeting(refertoPartV.C.2);or ontheinternetby: makingtheannualreportavailabletothepubliconawebsite; providingthepublictheopportunitytoprovidecommentsontheinternet orotherwise;and SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 31 (PartVII.A.2.d.i.) makingavailabletheopportunityforthepublictorequestanopen meetingtoaskquestionsaboutandmakecommentsonthereport.Ifa publicmeetingisrequestedby2ormorepersons,thecoveredentity mustholdsuchameeting.However,thecoveredentityneedonlyholda publicmeetingoncetosatisfythisrequirement. ii.providepublicnoticeaboutthepresentation,makingpublicthefollowing informationwhennoticingthepresentationinaccordancewiththelocalpublic noticerequirements: theplacementoftheannualreportontheagendaofthismeetingorlocation ontheinternet; theopportunityforpubliccomment.This SPDESgeneralpermit doesnot requireaspecifiedtimeframeforpubliccomments,althoughitis recommendedthat coveredentities doprovidethepublicanopportunityto commentforaperiodafterthemeeting.Commentsreceivedafterthefinal annualreportissubmittedshallbereportedwiththefollowingyearsannual = report.Coveredentities musttakeintoaccountthosecommentsinthe followingyear; thedateandtimeofthemeetingorthedatetheannualreportbecomes availableontheinternet;and theavailabilityofthedraftreportforpriorreviewpriortothepublicmeeting ordurationofavailabilityofannualreportontheinternet; iii.the Department recommendsthatannouncementsbesentdirectlytoindividuals s (publicandprivate)knowntohaveaspecificinterestinthe coveredentity SWMP; iv.includeasummaryofcommentsand(intended)responseswiththefinalannual report.Changesmadetothe SWMP inresponsetocommentsshouldbe describedintheannualreport;and v.ensurethatacopyofthefinalreportand,beginningin2009,theSWMPplanare availableforpublicinspection; e.Develop(fornewlyauthorizedMS4s),record,periodicallyassessandmodifyas needed measurablegoals;and SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 32 (PartVII.A.2.) f.Selectandimplementappropriatepublicinvolvement/participation activities and measurablegoals toensurethereductionof POCs in stormwaterdischarges tothe MEP. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 41 (PartVII.A.5.a.iv.) ifa stormwater managementpracticeisdesignedandinstalledinaccordance withtheNewYorkStateStormwaterManagementDesignManualorhas beendemonstratedtobeequivalentandisproperlyoperatedand maintained,then MEP willbeassumedtobemetforpostconstruction stormwater dischargedbythepractice; v.describesproceduresfor SWPPP reviewwithconsiderationofpotentialwater qualityimpactsandreviewofindividual SWPPP stoensureconsistencywithstate andlocalpostconstruction stormwater requirements; ensurethattheindividualsperformingthereviewsareadequatelytrainedand understandthe State andlocalpostconstruction stormwater requirements; ensurethattheindividualsperformingthereviewsforSWPPPsthatinclude postconstructionstormwatermanagementpracticesare qualified professionals orunderthesupervisionofa qualifiedprofessional; all SWPPP smustbereviewedforsiteswherethedisturbanceisoneacreor greater; afterreviewof SWPPPs,the coveredentity mustutilizetheMS4SWPPP A AcceptanceFormcreatedbythe Department andrequiredbytheSPDES @ GeneralPermitforStormwaterDischargesfromConstructionActivity (GP010001)whennotifyingconstructionsiteowner/operatorsthattheir planshavebeenacceptedbythe coveredentity; utilizeavailabletrainingfromsourcessuchasSoilandWaterConservation Districts,PlanningCouncils,TheNewYorkStateDepartmentofState,USEPA, and/orthe Department toeducatemunicipalboardsandPlanningandZoning Boardsonlowimpactdevelopmentprinciples,bettersitedesignapproach, andgreeninfrastructureapplications. vi.maintainaninventoryofpostconstructionstormwatermanagementpractices withinthe coveredentities jurisdiction.Ataminimum,includepractices dischargingtothe smallMS4 thathavebeeninstalledsinceMarch10,2003,all practicesownedbythe smallMS4,andthosepracticesfoundtocauseor contributetowaterqualitystandardviolations. theinventoryshallincludeataminimum:locationofpractice(streetaddress orcoordinates);typeofpractice;maintenanceneededpertheNYS StormwaterManagementDesignManual,SWPPP,orotherprovided documentation;anddatesandtypeofmaintenanceperformed;and SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 42 (PartVII.A.5.a.) vii.ensuresadequatelongtermoperationandmaintenanceofmanagement practicesidentifiedinPartVII.5.a.vibytrainedstaff,includinginspectionto ensurethatpracticesareperformingproperly. SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 48 PART VIII. MINIMUM CONTROL MEASURES - TRADITIONAL NON-LAND USE CONTROL AND NON-TRADITIONAL MS4s A. Traditional Non-Land Use Control and Non-traditional MS4 Minimum Control Measures (MCMs) TheseMCMsapplyto traditionalnonlandusecontrolMS4s and nontraditionalMS4s. TheSWMPforthese smallMS4s mustbecomprisedofthe6MCMsbelow.Itis recommendedthatcoveredentitiesrefertoassistanceandguidancedocuments availablefromthe State andEPA. Underthis SPDESgeneralpermit,thecontinuing coveredentities arerequiredto implementtheirSWMP,includingtheMCMrequirementsbelow.Newlyregulated coveredentitiesarerequiredtodeveloptheirSWMP,containingtheMCMrequirements below,withinthefirst3yearsofcoverageandthencommenceimplementation. The coveredentity may develop(fornewlyauthorizedMS4s)and/or implement their SWMP withintheirjursidictionontheirown.The coveredentity mayalso develop(for newlyauthorizedMS4s)and/or implement partoralloftheir SWMP throughan intermunicipalprogramwithanother coveredentity(s)orthroughothercooperativeor contractualagreementswiththirdpartiesthatprovideservicestothe coveredentity(s). ForeachoftheelementsoftheSWMPplan,the coveredentity mustidentify(i)the agenciesand/orofficesthatwouldberesponsibleforimplementingtheSWMPplan elementand(ii)anyprotocolsforcoordinationamongsuchagenciesand/oroffices necessaryfortheimplementationoftheplanelement. A@ LowImpactDevelopment isasitedesignstrategywithagoalofmaintainingorreplicating thepredevelopmenthydrologicregimethroughtheuseofdesigntechniquestocreatea functionallyequivalenthydrologiclandscape.Hydrologicfunctionsofstorage,infiltration, SPDESGeneralPermitforStormwaterDischargefromMS4s,GP010002 90 andgroundwaterrecharge,aswellasthevolumeandfrequencyofdischargesare maintainedthroughtheuseofintegratedanddistributedmicroscalestormwaterretention anddetentionareas,reductionofimpervioussurfaces,andthelengtheningofflowpaths andrunofftime.Otherstrategiesincludethepreservation/protectionofenvironmentally sensitivesitefeaturessuchasriparianbuffers,wetlands,steepslopes,valuable(mature) trees,floodplains,woodlandsandhighlypermeablesoils.LIDprinciplesarebasedon controllingstormwateratthesourcebytheuseofmicroscalecontrolsthataredistributed throughoutthesite.Thisisunlikeconventionalapproachesthattypicallyconveyandmanage runoffinlargefacilitieslocatedatthebaseofdrainageareas.SeealsoGreenInfrastructure andBetterSiteDesign. ManagementPractices Seebestmanagementpractices MaximumExtentPracticable isatechnologybasedstandardestablishedbyCongressin theCleanWaterAct402(p)(3)(B)(iii).SincenoprecisedefinitionofMEPexists,itallows ' formaximumflexibilityonthepartofMS4operatorsastheydeveloptheirprograms. (40CFR122.2Seealso:StormwaterPhaseIIComplianceAssistanceGuideEPA833R00002, March2000).WhentryingtoreducepollutantstotheMEP,theremustbeaseriousattempt tocomply,andpracticalsolutionsmaynotbelightlyrejected.Ifacoveredentitychooses onlyafewoftheleastexpensivemethods,itislikelythatMEPhasnotbeenmet.Onthe otherhand,ifacoveredentityemploysallapplicableBMPsexceptthosewhereitcanbe shownthattheyarenottechnicallyfeasibleinthelocality,orwhosecostwouldexceedany benefittobederived,itwouldhavemetthestatndard.MEPrequiredcoveredentitiesto chooseeffectiveBMPs,andtorejectapplicableBMPsonlywhereothereffectiveBMPswill servethesamepurpose,theBMPswouldnotbetechnicallyfeasible,orthecostwouldbe prohibitive. MeasurableGoals arethegoalsoftheSWMPthatshouldreflecttheneedsand characteristicsofthecoveredentityandtheareasservedbyitssmallMS4.Furthermore,the goalsshouldbechosenusinganintegratedapproachthatfullyaddressestherequirements andintentoftheMCM.Theassumptionisthattheprogramscheduleswouldbecreated overa5yearperiodandgoalswouldbeintegratedintothattimeframe.Forexample,a largerMS4coulddoanoutfallreconnaissanceinventoryfor20%ofthecollectionsystem everyyearsothateveryoutfallisinspectedoncewithinthepermitcycle Municipal/Municipalities referredtointhefederalrulethatdescribesthePhaseII stormwaterprogramincludesnotonlytheStatesmunicipalgovernments(cities,towns, = villagesandcounties),butanypubliclyfundedentitythatownsoroperatesaseparatestorm sewersystem.Examplesofotherpublicentitiesthatareincludedinthisprogramincludethe StateDepartmentofTransportation,StateUniversityCampuses,federalandStateprisons, Stateandfederalhospitals,ThruwayandDormitoryAuthorities,publichousingauthorities, schoolandotherspecialdistricts. The SWMP needstoinclude measurablegoals foreachofthe BMP s.Themeasurablegoals willhelpthecoveredentitiesassessthestatusandprogressoftheirprogram.TheSWMP should: 1.describetheBMP/measureablegoal; 2.identifytimelines/schedulesandmilestonesfordevelopmentandimplementation; 3.includequantifiablegoalstoassessprogressovertime;and 4.describehowthecoveredentitywilladdressPOCs.
