The public hearing on this matter was held on May ~7, 1983 and
June 23, 1983.
Upon application of JACK LEVIN, 59670 C.R. 48, Greenport, NY, for
a Special Exception to the Zoning Ordinance, Article III, Section 100-
30(B) [1] for permission to convert existing dwelling into two-family
dwelling use on a minimum two-acre parcel located at the south side of
C.R. 48, Greenport, NY; more particularly identified as County Tax Map
Parcel No. 1000-44-4-5.
WHEREAS, on April 20, 1983, this application was filed with the
office of the Town Clerk under Appeal No. 3125 for permission to convert
existing dwelling into two-family dwelling use on two acres;
WHEREAS, on April 27, 1983, this board scheduled the subject
application for public hearing to be held at the next Regular Meeting,
to wit, May 27, 1983; and
WHEREAS, on May 20, 1983, the Amended Bulk Area and Parking
Requirements of the Zoning Code was filed with the N.Y.S. Department
of State; and
WHEREAS, the Amended Bulk Area and Parking Requirements of the
Zoning Code was amended to require a minimum lot area of four acres
(rather than two acres) for a two-family dwelling, and 275 feet of
road frontage; and
WHEREAS, on July 26, 1983, the applicant herein requested that
the subject application be withdrawn and that he will restore the
subject dwelling to one-family use;
NOW, THEREFORE, on motion by Mr. Sawicki, seconded by Mr. Grigonis,
BE IT RESOLVED, that Appeal No. 3125, application of JACK LEVIN
be and hereby is WITHDRAWN AS REQUESTED.
Vote of the Board: Ayes: Messrs. Goenringer, Doyen, Grigonis,
Douglass and Sawicki. This resolution was unanimously adopted.

As you know, the public hearings in the above matters
were recessed until June 23, 1983, in order to give you an
opportunity and more time to decide whether you wished to
proceed with these applications in view of the new area
requirements adopted by the Town Board May 16, 1983,
requiring four acres of land to each two-family dwelling.
Since it can be assumed that you wish to proceed with
these two applications rather than withdrawing them, the
board has requested that a survey be submitted delineating
the 160,000 square feet of area and 275 feet of road front-
age you would prefer before any action is taken.
These matters will be placed on our agenda for our
August meeting, and your response by August 10th would be
appreciated.
