WHEREAS DENIS E. AMIAGA died on the 12~ day of June, 201 i; and
PURSUANT to Fi~l Judgment of Divorce dated October 5, 1985 filed in the Superior Court of
New Jersey, ChangelT Division: Hudson County, Docket # M-04854-86;
WITNESSETH, that the par~ of the first part, in consideration of said Final Judgement of
Divorce, does hereby grant and release unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever,
ALL OF HER INTEREST IN that certain plot, piece or parcel of land, situate, lying and beingat
Southold, Town of Southold, County of Suffolk and State of New York. bounded and described
as follows:
BEGINNING at a point on the southwestgrly side of a fight of way distant 250 feel southerly when
measured along the same from a poim on the southeasterly side of Middle Road, where it is
intersected by the northeasterly side of land now or formerly of Levin; running thence South 48
degrees 47 minutes 30 seconds East along the southwesterly side of Right of Way, 131.15 feet;
thence South 41 degrees 12 minutes 30 seconds West along land now or formerly ofllazan, 99.54
feet; thence North 48 degrees 47 minutes 30 seconds Wmt along land now or formerly of
Mulvaney, 131.15 feet and thence North 41 degrees 12 minutes 30 seconds east along land now
or formerly of Koelme, 99.54 feet to the southwesterly side of said Right of Way and point or place
of BEGINNING.
TOGETHER with an easement over said Right of Way, 25 feet in width, for access to and from
Middle Road, and over the continuation thereof in a generally southeasterly direction to the shore
of Arshamomaque Pond.
BEING AND INTENDED to he the same premises conveyed to the party of the first part and
DENIS E. AMIAGA by deed dated the December 19, 1969 and recorded in the Office oftbe
Suffolk County Clerk on ~ E- ~ q- (= ~ at Liber 6681, page 472.
COMMONLY KNOWN AS:
TOGETHER with all r~ght, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises ~ the center lines thereof; TOGETHER
with thc appurtenances, and all the estate and rights of the party of the first pan in and to said
premises; TO HAVE AND TO HOLD thc premises herein granted unto the party of the second
part, the heirs or successors and assigns of thc party of the second pan forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
pamj of the first part will receive the consideration for this conveyanee and will hold the fight to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "pan'y" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
