WITNESSETH, that the party of the first part, in cons~eration of One and More Dollars and other valuable
consideration paid by the parties of the second part, does hereby grant and release unto the party of the second
part, the heirs or successors and assigns of the parties at the second part forever.
ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND, with the buildings and improvements thereon,
erected, situate, Tying and being at Mattiluck in the Town al Southold, County of Suffolk and State of New York,
being bounded and described as follows:
BEGINNING at a point on the westerly side of Factory Avenue, said point being distant 603 +/- feet southerly from
its intersection with Sound Avenue;
THENCE from said point of beginning, along the westerly side of Factory Avenue South 17 degrees 29 minutes
East, ! 15.00 feet Io a point;
THENCE South 72 degrees 22 minutes Wesl, 256.00 feet to & point;
THENCE North 17 degrees 29 minutes West, 113.22 feet to a point;
THENCE North 71 degrees 58 minutes East, 256.00 feet Io the point or place of BEGINNING.
Grantee herein shall be prohibited from conveying captioned properly for a sales price of greater than $354,000
for a pedod of 3 months from the date of this deed. Grantee shall also be prohibited from encumbering subject
property with a security interest in the principal amount of greater than $354,000 for a period of 3 months from the
date of this deed. These restrictions shall run with the land and are not personal to grantee.
This restriction shall.terminate immediately upon conveyance at any foreclosure sale related to a mortgage or
deed of trust.
TOGETHER with'ell right, title and interest, if any, of the party al the first part in and to any streets and roads
abutling the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the pa~ of the tirst part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND Ihe party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid,
AND lhe party of the first pad, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost al the improvement and will apply the same first to
the payment of the cost at the improvement before using any pad of the total of the same for any other purpose.
THAT THIS CONVEYANCE is nol of all or substantially all of the property at the paAy of the Erst part and is made
in the regular course of business actually conducted by the party al the first part.
The word "party' shall be construed as if il read "parties" whenever the sense of this indenture so requires.
