WITNESSETH, that the party~ of the first part, in consideration ofTen Dollars, lawful
money of the United States, paid by the party of the second part, does hereb~ grant and release
unto thc party of the second part, the heirs or successors attd assigns of the party oft_he second
part forever,
ALL that certain plot, piece or parcel of land, with the buiMings and improvements
thereon erected, situate, lying and being at Fleet's Neck near Cutchogue, in the Town of
Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a p~int on the northeasterly side of Pequash Avenue, distant 340.00 feet
southeasterly from the comer formed by the intersection of the'northeasterly side of Pequash
Avenue with the southeasterly side of First Street;
RUNNING THENCE along the northeasterly side of Pequash Avenue, South 45 degrees
22 minutes East 60.00 feet;
THENCE North 45 degrees 05 minutes East, 200.00 feet;
THENCE North 45 degrees 22 minutes West 60.00 feet;
THENCE South 45 degrees 05 minutes West, 200.00 feet to the northeasterly side of
Pequash Avenue, at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same prcmisea conveyed to the paxt of the first part
by deed dated 7/7t2005 and recorded in the Office of the Suffolk County Clerk on 8/19/2005 at
Liber 12404 Page 863.
TO~ETHER with all right, tide and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises,
TO HA VEAND TO HOLD the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
tha'c the party of the first part will receive the consideration for this conveyance and will hold the
fight to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the covt of the
improvement before using any pan of the total of the same for any othor purpose.
The word "party" shall be cons~ed as if it read "parties'* whenever the sense of this
indenture so requires.
