PROPERTY LOCATION: 2000 Nassau Point Rd. (adj. to Broadwaters Cove), Cutchogue, NY
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated August 2, 2011 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town
of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP
Coordinator issued his reply dated September 26, 2011. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is EXEMPT from Coastal Consistency Review for the setback variance
request and the proposed dormer at more than 40% is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTION: The subject property is improved with a single family dwelling, a framed
accessory building and a one and a half story framed accessory garage. It contains 45,983 sq. ft. and has 150.29
feet on Nassau Point Rd., 182.36 feet on the east property line, 143.86 feet on Broadwaters Cove, 281.76 on the
west property line and 111.64 feet on the south property line as shown on the survey prepared by Peconic
Surveyors dated June 10, 2011.
BASIS OF APPLICATION: Request for Variance from Article XXIII Code Section 280-122, and Article Ill Code
Section 280-15 and the Building Inspector's June 2, 2011 Notice of Disapproval based on an application for
building permit for additions/alterations to a non-conforming accessory garage at; 1) a nonconforming building
containing a conforming use may be enlarged as long as the action does not create any new nonconformance or
increase of nonconformance with regard to the regulations pertaining to such buildings, 2) less than the code
required side yard setback of 15 feet, 3) second floor roof dormers at more than the code required 40% of the roof
width.
RELIEF REQUESTED: The applicant proposes to maintain the existing nonconforming 3.6 foot side yard
setback, of the existing nonconforming garage, which will require an 11.4 foot variance relief from the Code
required 15 feet. The applicant also proposes to dormer the area between two existing "dog house" dormers,
creating one dormer, which would create a dormer of 84% of the roof width and require a 110% relief of the Code
permitted 40%.

ADDITIONAL INFORMATION: A letter of opposition was written by an adjoining property owner with concerns
of property line encroachment and the subject garage being used as an illegal residence. The footprint of the
existing garage is proposed to remain the same and there was no evidence submitted to imply that the subject
garage will be used as a dwelling. The applicant testified at the public hearing that he intends to use the subject
structure as an unheated, seasonal recreation and sitting space for family use.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on October 6, 2001, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property
and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following
findings:
1. Town Law §267-b(3)(b)(l). Granting of the requested variances will not produce an undesirable change in
the character of the neighborhood or a detriment to nearby properties. No evidence has been presented to indicate
that the location of the existing nonconforming garage has caused a detriment to nearby properties. The garage
has existed in its current location since prior to zoning of 1957 and has a pre-CO.
2. Town Law §267-b(3){b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than the area variances. It would not be feasible to relocate the subject garage to a
conforming side yard setback. The requested relief of the dormer variance is the only method available for the
applicant to pursue in order to acquire additional headroom height on the second floor.
3. Town Law §267-b(3)(b)(3). The variance granted herein for the side yard setback relief of 11.4 feet or 76% is
mathematically substantial, however the substantiality is mitigated when considering the subject garage exists in its
present location. The variance granted herein for the dormer relief of 110 % is mathematically substantial. The
substantiality may be mitigated when considering the proposed dormer will combine the existing "dog house"
dormers.
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
garage has existed in its current location since prior to 1957, and the renovated garage will incorporate gutters and
leaders to control onsite roof runoff per code.
5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant acquired the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of pumhase.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of renovating the existing nonconforming garage while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member
Goehringer, and duly carried, to;
GRANT, the variance as applied for, and shown on the Architectural drawings entitled "Seiferth Residence-
Proposed Garage Renovation" dated 4.5.2011 and prepared by Nancy Dwyer, Design Consulting, Inc.,
professionally stamped by James J. Deerkoski, P.E., subject to the following conditions:

CONDITIONS:
1. The accessory garage shall not be used for cooking or sleeping
2. The structure shall be used seasonally and shall only contain the utility of electricity
That the above conditions be written into the Building, Inspector's Certificate of Occupancy, when issued
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a
possible denial by the Building Department of a building permit, and may require a new application and public hearing before
the Zoning Board of Appeals.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or
survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action
does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar desi~ that is de minimis in nature for an alteration that does not increase the degree of nonconformiiy.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed action
(structure is located less than the code required side yard setback of 15 feet from the side yard) is
EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item "F" and "11" which state:
F. Granting of individual setback, lot line and lot area variances, except in relation to a
regulated natural feature or a bulkhead or other shoreline defense structure or any activity within
the CEHA;
The second floor roof dormers at more than the code required 40% of the roof width are CONSISTENT
with the LWRP.
Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

Pursuant to 280~15, the required side yard setback is 15'. The existing nonconforming garage is
setback 3.6' in the side yard.
Also, dormers are permitted up to forty percent of the roof width.
The proposed second floor dormers will be greater than 40%.

Dear Oakside Construction,
I have reviewed your letter dated December 30, 2011, and the foundation plan with elevations
prepared by Nancy Dwyer dated 4-5-201 l noted as page 3, with your request to establish a building
height of 19'-3", which is approximately 8 to 10 inches higher than the height shown in the
drawings stamped for approval by the ZBA in decision #6504 in 2011.
Since you do not propose any changes to the variances granted in decision #6504, and since the
proposed changes are as noted on the original approved plans "replace where necessary", I have
determined that your requested modification is de minimus in nature.
I will instruct the office to send a copy of this letter and a stamped approved copy of the foundation
plan with elevations prepared by Nancy Dwyer dated 4-5-2011 noted as page 3, you attached with
your request to the Building Department so that you can proceed with completing construction and
obtaining a CO. If you have any questions, please call the office.

Please accept this letter in lieu of my personal appearance in opposition to Mr. Seiferth's application for a variance: non-
conformity & setback. The basis for my objection is that, in general, the setback requirement enforced by the Town of
Southold is the very essence that creates the tranquil and picturesque neighborhoods in which we have our houses.
Without it, and with the impending encroachment on the side of my property, the neighborhood will begin to look like any
other developer "McMansion" subdivision. As it affects me personally, the proximity of the proposed garage addition will
encroach on my side yard thereby devaluing my property and impacting the privacy my family enjoys while utilizing this
area.
Moreover, and as an equally important second point, if approved, this type of addition seems dpe for a quick and easy
further alteration into an illegal 2nd dwelling area without a multiple residence certificate of occupancy. And, once
approved, and without a grant of access thera is no means by which the Town of Southold can police this possible illegal
use of the addition. Instead, it is then left up to the other neighbors to ensure enforcement if a violation is occurring
through notification.
While at first it may seems that my concern that the garage may be used as an illegal residence is based on conjecture
and speculation, it is not. Instead it is based on a series of events that I feel ara telling as to the true intended use of this
modified space. First, I feel it worthy to note that both Mr. Seiferth and his father inquired about purchasing my adjacent
property. Second, since no deal was reached with me, I know of no other neighbor with whom any deal was reached,
Third, the application before the board was thereafter filed to modify the garage. I find these series of events compelling
that his true intention is to use the addition as I suggest, as an illegal residence for his father. The series of events and
their timing is at the very least, suspicious.
Lastly, it is not like Mr. Seiferth's lot is devoid of space. Rather, there ara numerous other options he could entertain such
as building out the garage toward the road and/or extending his residence, all of which accomplish the same end and are
less impactful on my adjacent residence.

Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Times Review newspaper.
1) Before September'19th:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to al_JI owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable, you are requested to make other attempts to
obtain a mailing address or to deliver the letter to the current owner, to the best of your ability,
and to confirm how arranqements were made in either a written statement, or during the
hearinq, providing the returned letter to us as soon as possible;
AND not later than September 26th: Please either mail or deliver to our office your Affidavit
of Mailing (form enclosed) with parcel numbers, names and addresses noted, along with the
green/white receipts postmarked by the Post Office. When the green signature cards are
