a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sots of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on pre~nises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within t 8 months from such date. If no zoning amendme, nts or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #6420A to truncate dormer originally proposed over porch replaced by open
deck; relocated existing second-floor bath to rear of house over existing first-floor baths
and bedrooms, and as depicted on the revised plan prepared by Robert O'Brien, last

Section 100-239.4B, which states;

exists and which are adjacent to tidal water bodies other than sounds shall be set back not less
than seventy-five (75) feet from the bulkhead."

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without further reviews under SEQRA.
PROPERTY FACTS/DESCRIPTION: The July 18, 2007 survey confirms the property size to
be 28,500 square foot parcel with 119.0 feet along Truman's Path, 219.0 feet along the
eastern lot line, 238.0 feet along the western lot line, and 151.14 feet along a tie line of a
high water mark of Gardiner's Bay. The property is currently improved with a one and one-
half story frame dwelling and one story shed.
BASIS OF APPLICATION: Zoning Code Section 280-116 (formerly 100-239.4B) based on
the Building Inspector's August 7, 2007 Notice of Disapproval concerning proposed additions
and alterations to the existing single-family dwelling, disapproved for the reason that the
new construction will be less than 75 feet from the existing bulkhead adjacent to Gardiner's
Bay.

280-116B states: "All buildings located on lots on which a bulkhead...exists & which are
adjacent to tidal water bodies other than sounds shall be set back not less than 75' front the
bulkhead.'
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on September 13,
2007, at which time written and oral evidence was presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board
finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The relief requested by the apphcant is for an
addition with alterations to the existing building, proposed at 28 feet instead of 75 feet, from
the existing bulkhead.

REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The addition with alterationt~ will be
within the same footprint and will be limited to the second floor, and the existing setback of
28 feet will be maintained. The adjacent house to the west has a 26 foot setback from the
bulkhead. The adjacent house to the east has a 35-foot setback.
2. The benefit of additional living space cannot be achieved without either building upwards
or increasing the existing footprint. The application has opted for the former alternative.
3. The variance sought is not substantial. The area of the two dormers will be approximately
300 square feet and increase the living space from 1504 square feet to 1804 square feet.
4. The difficulty has not been self-created.
5. Granting a variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood. There will be no excavation or grading and
therefore no ground disturbance.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Simon,
seconded by Member Goehringer, and duly carried to
GRANT the relief as applied for.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this apphcation when involving
nonconformities under the zoning code. This action does not authorize or condone any current or
future use, setback or other feature of the subject property that may violate the Zoning Code, other
than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an
alteration that does not increase the degree of nonconformity.

Drainage structures will not be required, as the proposed work consists of two
second floor dormer additions over existing roof areas and within the footprint of the ex-
isting house foundation. Therefore there will be no ground disturbance or change in
land contours. The existing rain gutters and leaders will be replaced in kind. All water
will continue to be deposited on flat lawn grass areas directly adjacent to the house
where it presently percolates directly into the sandy soil, causing no runoff or erosion is-
sues.

Please find attached four copies of revised approved drawing #2007-1J. The
change is necessitated by water damage to the existing two 2" x 10" header beams over
the two patio doors and porch roof joist ends. This caused by roof leakage. The beam
has deflected in excess of W' between the ends and center support. This has caused
the sliding glass doors to bind in their jambs, which are now out-of-square. The beam
will be replaced with a new 5-W'x 14" L V. L header with new 2" x 10" deck joists
framing into it.
