(631) 765-1809 · Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF AUGUST 18, 2011 ZBA FILE: #6491 NAME OF APPLICANT: George and Constantine Zachariadis PROPERTY LOCATION: 2195 Ruth Road, Mattituck, NY CTM 1000-106-%5 SEQRA DETERMiNATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMiNISTRATIVE CODE: This application is not subject to review by the Suffolk County Department of Planning. LWRP: This application is not subject to review under Chapter 268 because does not involve features that relate to a regulated natural feature or a bulkhead or other shoreline. PROPERTY FACTS/DESCRIPTION: The Applicant's property is a rectangular shaped, 20,000 sq. ft parcel in the R-40 Zone. The northerly lot line measures 100 feet along Ruth Road. The easterly and westerly lot lines measure 200 feet, and the southerly lot line measures 100 feet. The property is improved with a single-family dwelling with attached garage, as shown on the site survey drawn by Garrett A. Strang dated April 28, 2011. BASIS OF APPLICATION: Request for Variance fi.om Article XXIII Code Section 280-124 and the Building Inspector's May 16, 2011 Notice of Disapproval based on an application for building permit to construct addition to a single family dwelling at 1) side yard setback of less than the code required 15 feet. RELIEF REQUESTED: The applicant requests a variance for a side yard setback of 12 feet, when Code requires 15 feet. The Applicant proposes to construct a new l~2.6ft.x24.1ft, single-story garage addition, and 12.6~.X_1_6~. patio with a pergola located in the side yard area. All proposed construction will maintain a 12 foot side yard setback. ADDITIONAL iNFORMATION: There were no objections submitted by any neighbors to the Applicant's plan. FiNDiNGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 4, 2011, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, an assessment of the character of the neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 2 - August 18, 2011 ZBA File#6491 - Zachariadis CTM: 1000-106-7-5 1'. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed garage addition will create an attached two car garage which is customary in the applicant's residential neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. A garage addition with a narrower width of 9 feet to allow for a conforming side yard would compromise both the function and appearance of the garage. 3. Town Law §267-b(3)(b)(3). The variance granted herein is not substantial and mathematically represents a 20% relief from the code. Further, the adjacent neighbor's side yard is also open and unobstructed and the side yards appear to be spatially large. 4. Town Law §26%b(3)(b)(4) No ~vidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The land where the garage and patio are proposed is basically flat. There will be no trees removed, or any other significant environmentally sensitive features that will be affected by the construction. 5. Town Law ~267-b(3)(bi(5). The difficulty has not been self-created, but is the result of the house being constructed exactly in the middle of this property, resulting in a building footprint with two equal side yard setbacks of 24 feet on a parcel where a 15 foot single side yard is required by Code. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new single story garage addition and a new patio with a pergola, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Homing, seconded by Member Goehringer, and duly carried to, GRANT~ the variance as applied for, and shown on the site plan labeled SP-1 and architectural drawings labeled A-3 and A-4 prepared 4/28/11 by Garrett Strang, amhitect.
