RESOLVED, that the Southold Town Board of Trustees APPROVE the Administrative
Amendment to Wetland Permit #7643 to reduce the size of the non-turf buffer area from
20' to a 17' buffer; 5' of which is existing decking over sand and 12' to be untreated
mulch; and as depicted on the revised project plan prepared by Deborah Penney,
received on November 13, 2012 and stamped approved on December 12, 2012.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated June 28, 2011 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application has been reviewed under Chapter 268, Waterfront Consistency review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the
Memorandum to the Board of Appeals dated August I, 2011 from the LWRP Coordinator Mark Terry, information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records
available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards
and therefore is CONSISTENT with the LWRP, provided the following best management practices are followed; a
20 foot wide landscaped buffer landward of the bulkhead and the proposed 10 foot leaching pools be located
landward of the new dwelling.
PROPERTY FACTS/DESCRIPTION: The Applicant's property is a 12,902 sq. ft. parcel in the R-40 Zone.
The northerly lot line measures 112 feet along Sailors Needle Road. The easterly lot line measures 148.23 feet.
The southerly lot line measures 95.04 feet of waterfront along a bulkhead on an inlet adjacent to James Creek, and
the westerly lot line measures 112 feet. The property is improved with a one story single family dwelling and
attached garage, as shown on the site plan survey sheet A-2 drawn by Richard Boyd, Architect, and dated Feb. 18,
2011. Also shown on this site plan are the proposed new construction, and the proposed new septic system.
BASIS OF APPLICATION: Request for Variance from Code Article XXII Section 280-116 and 280-124 and the
Building Inspector's June 3, 2011 Notice of Disapproval based on an application for building permit for demo and
new construction of a single family dwelling at: 1) less than the code required setback of 75 feet from a bulkhead,
2) less than the code required front yard setback of 35 feet.
RELIEF REQUESTED: The applicant requests variance relief for a 43.79 feet setback from the bulkhead, %,hen
75 feet is required by Town Code. The Applicant also requests variance relief for a 29.15 feet front yard setback,
when 35 feet are required. The Applicant proposes to demolish an existing single family residence, and construct a

new dwelling on the property. The existing structure has a 21.25 feet front yard setback, and a 40.73 feet bulkhead
setback.
AMENDED RELIEF REQUESTED: The Applicant requests relief from a condition imposed by ZBA decision
#6484 dated Sept. 15, 2012, requiring a 20 foot non-turf buffer landward of the existing bulkhead on this property,
as recommended by the LWRP coordinator. The Applicant has proposed that the required non-turf buffer be
reduced to a total of ten feet which includes 5 feet of sand under the existing wooden walkway that s adjacent to the
bulkhead, plus an additional 5 feet of plantings landward from the edge of the wooden walkway, for a total of 10
feet.
ADDITIONAL INFORMATION: The Board, while considering information pertinent to this application,
reviewed material supplied through ZBA office research regarding the extent of the existence of nonconforming
structures, and the nature of variances granted within this particular neighborhood. The Board also reviewed all
written information supplied by the applicant, the applicant's architect and attorney, and the adjacent neighbor to
the west of the subject property and his agent, regarding the status of existing neighborhood covenants and
restrictions, the preservation of property values, and all the other concerns that were raised during the public
hearings as recorded in the hearing transcripts. The Board finds that both written submissions and oral testimony
failed to make the case that the subject dwelling, as applied for, would adversely affect the value of the adjacent
dwelling to the west or that homeowner's ability to utilize solar energy applications in the future on his dwelling.
As acknowledged during the public hearings, the compliance with covenants and restrictions between private
parties is a civil matter that is outside the jurisdiction of this Board.
AMENDED APPLICATION ADDITIONAL INFORMATION: Upon re-opening the hearing to consider the
applicant's request for amended relief, the Board reviewed the LWRP recommended best management practices
concerning the non-turf buffer, and reviewed other non-turf buffers required by the Board of Town Trustees when
granting various permits for construction projects within the adjacent neighborhood. In addition, the Board
considered material submitted by the applicant which included photos of adjoining and other neighborhood
properties with non-turf buffers and letters in support of the amended request from twelve neighbors.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals originally held two public hearings on this application, on August 4, 2011, and on
September 1, 2011, before making a decision dated September 15, 2011. The Zoning Board of Appeals also held
another hearing on September 6, 2012, upon the Applicant's request to re-open the hearing, at which time written
and oral evidence were presented only to consider the condition imposed in the ZBA decision made on September
15, 2011 that the Applicant"will install and maintain a 20 feet wide landscaped buffer landward of the bulkhead as
recommended by the LWRP Coordinator in the Memorandum dated August 1, 2011." Based upon all testimony,
documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning
Board finds the following facts to be true and relevant and makes the following findings:
On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following
findings:
1. Town Law &267-b(3)(b)(1). Grant of the variances of will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. The applicant's property is in a residential neighborhood
containing many nonconforming sized parcels improved with existing dwellings with nonconforming front yard
and bulkhead setbacks.
2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method feasible for
the applicant to pursue, other than an area variance. However, the applicant proposes to reduce the existing non-
conformities and comply more closely with the code. The applicant also demonstrated a good effort to keep the
number of variances to a minimum by not requesting any side yard setback variance.
3. Town Law&267-b(3)(b)(3). The variances granted herein for a 29.15 feet front yard setback is a +20%variance
relief from Code required 35 feet, and is substantial. The variance granted herein for a 43.79 feet setback from the

bulkhead is a 44% variance relief from Code required 75 feet, and is substantial. However, the applicant proposes a
site plan for new construction which increases the existing setbacks from the bulkhead and the front yard area,
thereby reducing the existing degree of nonconformity. Additionally, in the context of this area where many of the
dwellings are non-conforming the requested variances become less substantial.
4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant proposed to increase the front yard setback by +/- 8 ft., and the setback from the bulkhead by +/- 3 ft.
%%ith the new construction. The applicant will also install a new septic system landward of the proposed dwelling
and install drywells as per code.
5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created, in so far as the applicant proposes to
demolish the existing non-conforming dwelling and construct a new dwelling in a non-conforming location.
6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a new single family dwelling and septic system, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Homing, seconded by Member Weisman
(Chairperson), and duly carried, to
GRANT, the variances as applied for, and shown on the site plan and architectural drawings by Richard Boyd,
Architect, dated Feb 18, 2011, and labeled AI-A6
Conditions:
I . Applicant will install and maintain a 20 foot wide landscaped buffer landward of the bulkhead as recommended
by the LWRP Coordinator in the Memorandum dated Aug. 1, 2011.
AMENDED RESOLUTION OF THE BOARD:
The ZBA has determined that the existing 5 feet wide wooden walkway with a sand base underneath,that is
landward of and adjacent to the bulkhead could be considered to be a part of the 20 feet non-turf buffer zone
that was recommended by the LWRP Coordinator as best management practices. In addition, the Board
considered the overall character of this long established neighborhood and the relative sizes of other non-turf
buffers established within the area.
In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion
was offered by Member Horning, seconded by Weisman(Chairperson), and duly carried, to
GRANT, the following ALTERNATIVE AMENDED RELIEF to condition 41 above.
Amended Condition:
I . The Applicant shall provide a minimum of 12 feet of non-turf buffer landward of the inner most edge of
the wooden walkway, for the entire length of the walkway on the applicant's property, in addition to the 5
feet of sand underneath the wooden walkway, for a total non-turf buffer of 17 feet.
That the above condition be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the survey,site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by
the Building Department of a building permit,and may require a new application and public hearing before the Zoning Board of Appeals.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site
maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or

condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de mmmus in nature for an alteration that does not increase the degree of nonconformity

The Zoning Board approved the action on September 15, 2011 with the following condition:
1. Applicant will install 20' wide landscaped buffer landward of the bulkhead.
Richard Boyd on behalf of DEBORAH PENNEY requests a Wetland Permit to remove existing
1,817 sf. dwelling, attached garage and enclosed porch; remove existing wood platform,
driveway, brick walk and septic system; construct new 2,631 sf. two-story dwelling with 1.5
story attached garage and roofed-over porches; new 538.8 sf. on-grade stone patio; new paver
on sand driveway and walkways; new septic system; and new leeching pools for roof run-off.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the denoted following Policy
Standards and therefore is CONSISTENT with the LWRP provided the following:
To further Policy 6; Protect and Restore the Quality and Function of the Town of Southold
Ecosystem

D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities
in order to ensure protection of the wetland's character, quality, values, and functions.
The adequacy of the buffer depends on the following factors:
3. Direction and flow of surface water between a use and adjacent or nearby
wetland. Buffer widths may be reduced in areas where drainage patterns
normally do not lead directly to the wetland and where adverse affects on
the wetland, other than those due to runoff, are not likely.
4. Buffer width necessary to achieve a high particulate filtration efficiency of
surface runoff as determined by vegetative cover type, soil characteristics,
and slope of land.
If the action is approved, it is recommended that a 20 wide landscaped buffer be required
landward of the bulkhead to further the above policies. An example definition of a landscape
buffer is included for your use:
LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with
indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of
the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover
within two years of installation. Survival of planted vegetation shall be 90% for a period of three
years. Maintenance activities within the buffer are limited to removing vegetation which is
hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain
viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed
of pervious material for access to the water body. [Added 12-15-2009 by L.L. No. 15-2009]
In addition to further Policy 5: Protect and Improve Water Quality in the Town of Southold, it is
recommended that the 10' diameter leaching pools be relocated to landward of the new
residential structure to maximize the distance of the basins to the surface waters and minimize
the potential for storm water to negatively influence the surface water body via subsurface
flow.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

from the condition imposed in the Zoning Board of Appeals decision application #6484.
Since you are requesting a 50% reduction in the condition requiring a 20 foot wide
landscaped buffer, your proposed change is not de minimus in nature. As such, your
request must be presented at a public hearing. Should you wish to proceed, you may
request in writing for the Board to consider re-opening your application.

Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on September 21, 2011,
and in consideration of application fee in the sum of $250.00 paid by Deborah Penney and subject to the Terms

roof run-off; with the condition of the installation of a 20 foot wide non-turf buffer
along the landward edge of the bulkhead to be maintained; and as depicted on the site

TERMS AND CONDITIONS
The Permittee Deborah Penney, residing at 160 Sailor's Needle Road, Mattituck, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released bom any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Boar~l or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal an~or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety (90)
calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action dudng its regular meeting held on
Wednesday, September 21,2011 regarding the above matter:
WHEREAS, Richard Boyd on behalf of DEBORAH PENNEY applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated August 24,
2011, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 21,2011, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of DEBORAH

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated June 28, 2011 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application has been reviewed under Chapter 268, Waterfront Consistency review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the
Memorandum to the Board of Appeals dated August 1,2011 from the LWRP Coordinator Mark Terry, information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records
available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards
and therefore is CONSISTENT with the LWRP, provided the following best management practices are followed; a
20 foot wide landscaped buffer landward of the bulkhead and the proposed 10 foot leaching pools be located
landward of the new dwelling.
PROPERTY FACTS/DESCRIPTION: The Applicant's property is a 12,902 sq. fi. parcel in the R-40 Zone.
The northerly lot line measures 112 feet along Sailors Needle Road. The easterly lot line measures 148.23 feet.
The southerly lot line measures 95.04 feet of waterfront along a bulkhead on an inlet adjacent to James Creek, and
the westerly lot line measures 112 feet. The property is improved with a one story single family dwelling and
attached garage, as shown on the site plan survey sheet A-2 drawn by Richard Boyd, Architect, and dated Feb. 18,
2011. Also shown on this site plan are the proposed new construction, and the proposed new septic system.
BASIS OF APPLICATION: Request for Variance from Code Article XXII Section 280-116 and 280-124 and the
Building Inspector's June 3, 2011 Notice of Disapproval based on an application for building permit for demo and
new construction of a single family dwelling at: 1) less than the code required setback of 75 feet from a bulkhead,
2) less than the code required front yard setback of 35 feet.
RELIEF REQUESTED: The applicant requests variance relief for a 43.79 feet setback from the bulkhead, when
75 feet is required by Town Code. The Applicant also requests variance relief for a 29.15 feet front yard setback,
when 35 feet are required. The Applicant proposes to demolish an existing single family residence, and construct a
new dwelling on the property. The existing structure has a 21.25 feet front yard setback, and a 40.73 feet bulkhead
setback.

ADDITIONAL INFORMATION: The Board, while considering information pertinent to this application,
reviewed material supplied through ZBA office research regarding the extent of the existence of nonconforming
structures, and the nature of variances granted within this particular neighborhood. The Board also reviewed all
written information supplied by the applicant, the applicant's architect and attorney, and the adjacent neighbor to
the west of the subject property and his agent, regarding the status of existing neighborhood covenants and
restrictions, the preservation of property values, and all the other concerns that were raised during the public
hearings as recorded in the hearing transcripts. The Board finds that both written submissions and oral testimony
failed to make the case that the subject dwelling, as applied for, would adversely affect the value of the adjacent
dwelling to the west or that homeowner's ability to utilize solar energy applications in the future on his dwelling.
As acknowledged during the public hearings, the compliance with covenants and restrictions between private
parties is a civil matter that is outside the jurisdiction of this Board.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on Aug 4, 2011, and Sept 1,2011, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property, an assessment of the character of the neighborhood, and other evidence, the Zoning Board finds the
following facts to be true and relevant and makes the following findings:
On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following
findings:
1. Town Law §267-b(3)(b)(1). Grant of the variances of will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. The applicant's property is in a residential neighborhood
containing many nonconforming sized parcels improved with existing dwellings with nonconforming front yard
and bulkhead setbacks.
2. Town Law §267-b{3)(b}(2}. The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. However, the applicant proposes to reduce the existing non-
conformities and comply more closely to the code. The applicant also demonstrated a good effort to keep the
number of variances to a minimum by not requesting any side yard setback variance.
3. Town Law §267-b{3)(b)(3}. The variances granted herein for a 29.15 feet front yard setback is a +20%variance
relief from Code required 35 feet, and is substantial. The variance granted herein for a 43.79 feet setback from the
bulkhead is a 44% variance relief from Code required 75 feet, and is substantial. However, the applicant proposes a
site plan for new construction which increases the existing setbacks from the bulkhead and the front yard area,
thereby reducing the existing degree of nonconformity. Additionally, in the context of this area where many of the
dwellings are non-conforming the requested variances become less substantial.
4. Town Law 1~267-b{3'~(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant proposed to increase the front yard setback by +/- 8 ft., and the setback from the bulkhead by +/- 3 ft.
with the new construction. The applicant will also install a new septic system landward of the proposed dwelling
and install drywells as per code.
5. Town Law §267-b(3){b){5). The difficulty has been self-created, in so far as the applicant proposes to
demolish the existing non-conforming dwelling and construct a new dwelling in a non-conforming location.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a new single family dwelling and septic system, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the denoted following Policy
Standards and therefore is CONSISTENT with the LWRP provided the following:
To further Poficy 6; Protect and Restore the Quafity and Function of the Town of Southold
Ecosystem
Provide adequate buffers between wetlands and adjacent or nearby uses and activities
in order to ensure protection of the wetland's character, quality, values, and functions.
The adequacy of the buffer depends on the following factors:
Direction and flow of surface water between a use and adjacent or nearby
wet/and. Buffer widths may be reduced in areas where drainage patterns
normally do not lead directly to the wetland and where adverse affects on
the wet/and, other than those due to runoff, are not likely.
Buffer width necessary to achieve a high particulate filtration efficiency of
surface runoff as determined by vegetative cover type, soil characteristics,
and s/ope of/and.
If the action is approved, it is recommended that a 20 wide landscaped buffer be required
landward of the bulkhead to further the above policies. An example definition of a landscape
buffer is included for your use:
LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with
indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of
the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover
within two years of installation. Survival of planted vegetation shall be 90% for a period of three
years. Maintenance activities within the buffer are limited to removing vegetation which is
hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain
viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed
of pervious material for access to the water body. [Added 12-15-2009 by L.L. No. 15-2009]
In addition to further Policy 5: Protect and Improve Water Quality in the Town of Southold, it is
recommended that the 10' diameter leachin,q pools be relocated to landward of the new
residential structure to maximize the distance of the basins to the surface waters and minimize
the potential for storm water to ne.qatively influence the surface water body via subsurface
flow.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for pemfits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
.minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfi'ont Revitalization Program. A proposed action will be evaluated as to its si..tmifieant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explained in detail~ iistin~ both supporting and non-
suooortin~ facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
