I submit this letter by way of brief explanation of Ms. Grattan's revised plans, which are intended to be submitted contemporaneously by agent Suffolk Environmental Consulting, Inc. by 10 a.m. tomorrow morning, As a threshold matter, Ms. Grattan wishes the Board to consider that she instructed the design of her original submission to provide maximum protection to the environmental features, and in view of the unique configuration of the property. You will recall that, at present, a legal residence occupies the property in close proximity (7 feet) to the wetlands, along with a many decades-old (but legal) septic system, also abutting the wetlands (18 feet). Ms. Grattan instructed the original plan with the intent of replacing that existing development with a proposal that would substantially increase all setbacks from the wetlands and include a modem sanitary system set back 90 feet. Notwithstanding Ms. Grattan's belief in the original plan and its beneficial effects, she has taken the Board's comments to heart and offers the revised plan. This submission is without waiver of Ms. Grattan's legal rights to pursue the original plan and/or the redevelopment of the existing structure, At Ms. Grattan's request,I will reserve all such legal arguments in deference to seeking the prompt approval of the revised plan. Sep. 20. 2011 3:35PM . No. 0022 P. 3 Please observe that the proposed "swimming pool and related structures" are programmed well beyond Town Code Chapter 275's SO-foot setback requirement (Southold Town Code§275-3.D,(I)(a)(5].) Moreover, the revised plan is in all ways a substantial reduction in size and scope. Without limitation, the revised plan: - Decreases the ground coverage by approximately 26 percent (from 19.5 to 14.3 percent of upland area, well below the 20 percent coverage permitted by zoning); - Collapses the program as far away from the wetlands (and towards the road) as practicable, while allowing for the location of the sanitary system to remain at its maximum 90 foot setback; ▪ Forfeits a substantial portion of the program that extended away from.the proposed house and towards the beach, removing decking, and eliminating the previously proposed Screened Rec Room&Cabana and Screened Terrace; - Incorporates the Trustees suggestion that the residence be built on piles (as opposed to slab); - Depicts the erosion control measures to be employed during construction;and - Incorporates the planting plan/buffer provided by Suffolk Environmental Consulting Inc.on August 24,2011, I am available to discuss these matters, at the Board's convenience, and respectfully request the approval of the revised plan at the next meeting of the Board. A site inspection was conducted on August 19, 2011. Suffolk Environmental Consulting, Inc. on behalf of LISA GRATTAN requests a Wetland Permit to remove the existing 2,465 sf. single-family dwelling, porches, brick patio and sanitary system; construct new 3,250 sf. single-family dwelling, rear terrace containing a swimming pool and spa, screened rec-room/cabana, screened terrace, and upgraded sanitary system surrounded by a 120' retaining wall. Located: 11860 New Suffolk Ave., Cutchogue. SCTM#116-6-9 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP provided the following: The applicant mentions on the LWPR Coastal Assessment Form that parcel will be filled in the northeastern section of the property. The details of the proposal are not shown. It is recommended that the applicant provide the elevations of fill to the Board to better assess site drainage. S• Location and composition of erosion controls to minimize damage to wetland vegetation during demolition and construction are not shown on the survey. It is recommended that the Board require that the locations of construction/erosion controls be shown. It is recommended that the Board require complete removal of the current structure and have applicant specify the restoration of the area (buffer). If the action is approved to further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is recommended that a 25' landscaped buffer be required landward of the wetlands (where possible). Fertilization and pesticide use within the buffer should be prohibited. LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover within two years of installation. Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed of pervious material for access to the water body. [Added 12-15-2009 by L.L. No. 15-2009] It is further recommended that the Board preserve the large oak tree east of the current structure to the greatest extent practicable. The proposed terrace may need to be redesigned to include a tree well to accomplish this. a O eatOW Figure 1. Subject parcel showing location of large oak tree. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
