Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold
with the Resolution of the Board of Trnstees adopted at the meeting held on Au~,nst 24.. 2011
application fee in the sum of $500.00paid by 8925 LLC and subject to the Terms and Conditions as stated in the
Resolution, the Southold Town Board of Trustees authorizes and permits the following:
Wetland Permit for a 4'X 24' open-grate catwalk, seasonal 3'X 20' ramg
20' floating dock, electric and water, and with the condition of a 30' non-turf buffer
landward of the wetland boundary, and as depicted on the survey prepared by John T.
Metzger dated February 22, 2011 and stamped approved on September 21, 2011
plans prepared by Peconic Permit Expediting last revised September 6,
approved on September 21, 2011.
IN WITNESS WHEREOF, the said Board of Trnstees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
Thc Permittee, 8925 LLC, 8925 Bay Ave;, Cutcllogu¢, NY as part of the consideration for the
issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Pennittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Towx~ of Southold.
The Permittea is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covema~ and deed restriction
to the deed of the subject pamel. Such evidence shall be provided wilhin ninety (90)
calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.

That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Lehnert:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., August 24, 2011 regarding the above matter:
WHEREAS, Peconic Permit Expediting on behalf of 8925 LLC applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance, application dated July 7, 2011, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the Local Waterfront Revitalization Program policy standards,
specifically with Policy 6 - Protect and restore the quality and function of the Town of
Southold ecosystem, Policy 6.3 - Protect and restore tidal and freshwater wet/ands,
and,
WHEREAS, the Board of Trustees has furthered Policies 6 and 6.3 of the Local
Waterfront Revitalization Program to the greatest extent practical through the imposition
of the following Best Management Practice requirements: the removal of the flood light,
the existing decking on the catwalk to be removed and replaced with open-grate
decking, and a 30' non-turf buffer landward of the wetland boundary, and,

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 24, 2011, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approves the application of 8925 LLC for a 4'X
24' open-grate catwalk, seasonal 3'X 20' ramp and 6'X 20' floating dock, electric and
water, and with the condition of a 30' non-turf buffer landward of the wetland boundary,
and as depicted on the survey prepared by John T. Metzger dated February 22, 2011
and stamped approved on September 21,2011 and dock plans prepared by Peconic
Permit Expediting last revised September 6, 2011 and stamped approved on
September 21,2011.
BE IT FURTHER RESOLVED, that the removal of the flood light and replacement of the
catwalk with open-grate decking must be completed within 60 days from the date of this
permit.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

that you were considering submitting an application to the Office of the Trustees for a
permit for the as-built deck. The Trustees indicated that they would accept hand-written
drawing depicting the deck on a survey if you were not inclined to get a new survey done
for the purposes of making an application to the Board.
The Justice Court matter has been adjoumed to November 15, 2010. Please submit
your application to the trustees by that date if you are opting to have the deck legalized,
or remove the structure and contact my office so that a compliance inspection may be
scheduled.

submi~ed and approved by the Tom. However, we do not ~ow ifa
ceffificme of completion was ever issued for ~is dock. The dock was built
~d in place when we purchased the home in 1997.
Based on our conversation, I am enclosing the copies of the plans, permits,
and town approvals along with a check in the amount of $50.00 to get a

Dear Members of the Board:
A permit to construc='a dock facility at the above
referenced was issued by the Board of Trustees in 1977.
Mr. cucinotta hired Costello Marine to remove four existing
2-pile dolphins and relocate two 2-pile dolphins in a position
that would better secure his float. The N¥S DEC did not require
a permit for this work and issued a "No Permit Necessary" (NPN
~1-4738-00352/00001-0). For this reason, and because the size of
the protect'was being reduced in size, we did not think it was
necessary to apply for Trustee approval and subsequently
completed the work. Before closing our files, we called your
office for confirmation and were advised by your secretary that
we should have filed a request to emend the existing permit.
Enclosed please find sketch of the proposed modification
that was sent to the DEC. Also enclosed is a check in the amount
of $35.00 representing the fee you require for an amendment. We
apologize for any inconvenience this may have caused and res-
pectfully requ/est your favorable determination.

INSTRUCTIONS PERTINENT TO T]tE FILING OF AN APPLICATION
1. All applicants should read and hecame familiar with the Town Ordinances which govern the
use of WETLANDS or PUBLIC LANDS OF THE TOWN. Extracts and complete Ordinances are
available from the Secretary of this Boc~ Or from the Town Clerk's Office.
2. A completed application will normally mcluire a SINGLE COPY of each of the following items:
(c~) An applJcatic~n FORM A/I, A/2, A/3, A/4, or A/5) with all the questions answered.
(b) An Area Map to show location of project. (supplied by Secretary).
(c) A Licensed Engineer's Survey of the property involved.
(d) A copy of the Contractor's Plans & Specifications. This may be supplied after approval
of the opplicotic~ but a Permit will r~ be issued until the Secretary of this Board receives this item.
(e) An applicant's diagram drawn to SCALE or the reverse side of the AreaMap, showing
the size, shape, and overall dimensions of the structure or work as well as its relation to Ordinary
High Water Mark.
3. A completed opplicatios~ must be filed with the Secretary of this Board, before it can be reviewed
by the Board at the earliest meeting after it~ date of fi~ing.
4. In complicated cases, or at the request ofthe Secretary, it rn~y be necessary for the applicant

formation than the Forms provide for.
5. After review by the Board, the applicant will be notified of the action taken, and if approved,

6. The following schedule of charges will apply:

(d) Fee for Bulkheads (Form A/D) -- at the rate of $1.00 per lineal foot of construction
offshore of Ordinary High Water Mark.
(e) Fee for Dredging/Filling (Form A/4) -- at the rate of 10c per cu. yd. based on the
estimated maximum from computing the application.
(f) Fees for Special Purposes (Form A/5) -- at a rate depending on the type of work.
7. The Permit Fee, rhode p=~o[e to the Board of Southold Town Trustees, must be paid either in
person or by mail prior to the issuance of the Permit. IF PAID IN PERSON, THE PERMIT IS OB-
TAINABLE AT THE TIME PAYMENT IS MADE.
8. NO'[IFICATION OF APPROVAL of an application ?s NOT a PERMIT.
9. A Permit is usually issued for a period of construction to cover 12 mos., but may be for a shorter
or a longer ~eried of time as the case may warrant. The Permit should be retained, however, for as

Peconic Permit Expediting on behalf of 8925 LLC requests a Wetland Permit for the as-built 4'X 24'
catwalk, 3'X 20' ramp and 6'X 20' floating dock. Located: 8925 Bay Ave., Cutchogue. SCTM#104-3-15
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the
LWRP:
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions
The structures were constructed without a permit pursuant to Chapter 275 Wetlands and Shorelines of
the Southold Town Code.
Additionally, if the action is approved and to further Policy 4.2 Protect and restore natural protective
features and Policy 6; it is recommended that natural vegetated buffer incorporating existing
vegetation (trees) landward of the wetland, An example definition follows:
NATURAL VEGETATED BUFFER -- a land area of a certain length and width where existing
vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be
maintained to achieve a minimum percent ground cover of ninety-five (95) percent. To achieve the
percent ground cover indigenous, drought tolerant vegetation shall be planted. Survival of planted
vegetation shall be (ninety) 90 percent for a period of three (3) years. Maintenance activities within the
buffer are limited to removing vegetation which are hazardous to life and property, trimming tree limbs
up to a height of fifteen feet (15') to maintain viewsheds, replanting of vegetation and establishing a four
foot (4') wide access path constructed of pervious material for access to the water-body.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other rninisteHal permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
.minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfrom Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listinfl both supporting and non-
supporting facts, If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
