Ehlers dated March 10, 2003 and determined the proposed single-family dwelling and porch to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code(Chapter 97)and the Coastal Erosion Hazard Area(Chapter 37)no permit is required. Please be advised, however, that no construction, sedimentation,or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project.A line of staked hay bales must be installed along the coastal erosion hazard line before any activity begins. However, any activity within 100'of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. This determination is not a determination from any other agency. If you have any further questions, please do not hesitate to call. Box 1179 Southold,NY 11971 Re: 1300 Properties,LLC, 1300 Leeton Drive, Southold Dear Mrs. Doherty: As discussed at the public hearing on the captioned application, I have attached hereto (3) copies of a revised project plan that includes a crossview of the project prepared by Jeffrey T. Butler, P.E., P.C. The revised crossview reflects changes to the originally proposed dimensions of the proposed stone annor in response to the request that the structure be more clearly depicted as being installed with a sloped face rather than as a more vertically faced stone wall. Specifically, the approximate height of the structure above grade has been reduced by about 6 inches; the structure will be located about 2 feet closer to the existing house; the width of the subsurface footing of the structure has been increased by 2 feet (to achieve an overall structural slope of 1:1); and the approximate above-ground width of the structure remains unchanged. The project description remains unchanged but should now reference "plans prepared by En-Consultants, last dated August 17, 2011, and by Jeffrey T. Butler, P.E.,P.C, last dated August 12, 2011." A signed 30-year maintenance agreement was hand-delivered to your office on August 30'h. Please let me know if you require anything further from me before the Wetlands and Coastal Erosion Permits can be issued. Respe tfully yours, , L.,,! — I ! SEP - i 2u l Robert E. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The purpose of the project is to restore a previously existing natural protective feature, i.e.,a naturally vegetated berm, approximately 20'-25'of which was avulsively eroded and removed during the Christmas Blizzard of 2010. Therefore, the project will only seek to restore the pre-storm naturally existing condition, except for the introduction of the proposed stone armor at the seaward side of the proposed sand renourishment, which is proposed to a)increase the potential for the renourishment and plantings to become successfully established;and b)once established,to provide a reasonable measure of protection for the restored berm during a severe storm event. The stone would be continued to the west by the adjacent westerly property owner, where it will tie into similar existing toe stone;and there is similar stone on the adjacent property to the east. Therefore, the project will have no significant adverse impacts to the adjacent properties but together with those properties will provide a measure of protection to the landward natural protective feature, the vegetated berm. The project will be further consistent with Policy 4 because vegetative resource enhancement is the primary component of the design and the hard stabilization component is being included only for the protection and enhancement of the vegetation where efforts to preserve that vegetation have been proven inadequate during the most recent storm season. That is given the narrowed beach and recently demonstrated vulnerability of this stretch of shoreline to severe storm damage, providing some form of hard stabilization is the only practicable design consideration that can effectively provide toe protection for the renourished berm area. Ultimately, the goal of the project is to restore, enhance, and stabilize the natural protection feature of the property to minimize loss of structures and natural resources from flooding and erosion, consistent with the goal of Policy 4.
