AMENDED DECLARATION OF COVENANTS

WITNESSETH:
WHEREAS, DECLARANT is the owner of certain real pmporty located on Sound Drive,
Greenport, Town of Southold, County of Suffolk, State of New York, described in the Suffolk County
Tax Map as District 1000, Section 33, Block 4, Lot 3, which is more particularly bounded and described
as set foah in Schedule "A" annexed hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of Trustees of
the Town of Southold (hereinafter the "Trustees") pursuant to Chapter 275 of the Town Code of the Town
of Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLAKANT therefore made application to the Trustees for a permit pursuant to
the Wetlands Law of the Town of Southold to undertake certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated
activities, the Trustees required that a "nonturf buffer" be established and maintained between the top of bluff
and the Coastal Erosion Hazard Area Boundary; and
WHEREAS, the "Declaration of Covenants recorded in the Office of the Suffolk County Clerk on
April 6, 2012 as Liber 12689 Page 853 references a "15' nonturf buffef', this Amended Declaration of
Covenants is intended to correct and supercede said previously recorded Declaration;
NOW, THEREFORE, the DECLARANT does hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and subsequently maintained between the top of bluff and the Coastal Erosion
l-laTard Area Boundary on the subject premises a "nontuff buffer" as defined by Chapter
275 of the Town Code; and
2)
These covenants shall nm with the land and shall be binding on the DECLARANT, ins
heirs, assigns, purchasers, or successors in interest and may be modified only upon resolution
of the Board of Trustees.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, September 21,2011 regarding the above matter:
WHEREAS, En-Consultants on behalf of MICHAEL PHILLIPS applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated Apdl 27, 2011,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 21,2011, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of MICHAEL PHILLIPS
to demolish and remove the existing single-family dwelling, swimming pool and
appurtenances, and construct farther from the bluff a new two-story, single-family
dwelling and swimming pool, each with a smaller footprint; install a drainage system of
leaders, gutters, and drywells; establish and maintain in place of existing lawn along the
top of bluff a non-turf buffer to be planted with native vegetation up to the Coastal
Erosion Hazard Area line; remove existing sanitary system and install an upgraded
sanitary system located entirely landward of the 100' setback; and install a new
driveway beyond Chapter 275 jurisdiction; and as depicted on the survey prepared by
Lisa McQuilkin Land Surveying, last dated March 29, 2011, and stamped approved on
October 4, 2011.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The Permittee Michael Phillips, residing at 1000 Sound Drive, Greenport, New York as part of
thc consideration for thc issuance of thc Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 mOnths, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety (90)
calendar days of issuance of this permit.

The Board of Town Trustees took the following action dudng its regular meeting held on
Wednesday, September 21,2011 regarding the above matter:
WHEREAS, En-Consultants on behalf of MICHAEL PHILLIPS applied to the Southold
Town Trustees for a permit under the previsions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated Apd127, 2011,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Headng was held by the Town Trustees with respect to said
application on September 21,2011, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of MICHAEL PHILLIPS
to demolish and remove the existing single-family dwelling, swimming pool and
appurtenances, and construct farther from the bluff a new two-story, single-family
dwelling and swimming pool, each with a smaller footprint; install a drainage system of
leaders, gutters, and drywells; establish and maintain in place of existing lawn along the
top of bluff a non-turf buffer to be planted with native vegetation up to the Coastal
Erosion Hazard Area line; remove existing sanitary system and install an upgraded
sanitary system located entirely landward of the 100' setback; and install a new

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Plauning issued its
reply dated July 20, 2011 stating that this application is considered a matter for local determina6on as there appears
to be no significant county-wide or inter-community impact.
LWRP: This application was referred for reviewed under Chapter 268, Waterfront Consistency review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The
LWRP Coordinator issued his reply dated August 24, 2011, based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP, provided the following best management practices are followed: Landscaped
buffer landward of the top of bluff including the entire Coastal Erosion Hazard Area, relocate drywells to landward
of the proposed residence.
PROPERTY FACTS/DESCRIPTION: Subject property is improved with a single family dwelling and in-ground
pool. It has 100.00 feet of frontage on Sound Drive, 382.00 feet along the west property line, 101.25 along Long
Island Sound and 376.00 feet on the east propot~j line as shown on the survey dated last revised March 29, 2011
prepared by Lisa McQuilkin, LS.
BASIS OF APPLICATION: Request for Variances from Art. XXII Section 280-116A(1) and the Building
Inspector's June 16, 2011 Notice of Disapproval based on an application for building permit to demolish and
construct a new dwelling and accessory In Ground swimming pool, at; 1) less than 100 foot setback from top of
bluff for the dwelling and accessory swimming pool.
RELIEF REQUESTED: The applicant proposes to demolish the existing dwelling and pool and construct a new
two story dwelling at 82.32 feet with an in-ground swimming pool at 65 feet from the top of the bluff where the
code requires 100 feet. The requested bluff setback for the proposed dwelling and in-ground pool are greater than
what pre-exists.

ADDITIONAL INFORMATION: The Board requested information fi.om Suffolk County Soil and Water. In a
letter dated August 12, 2011, they stated the bluff is stable, the soil is well drained and they do not anticipate any
adverse impacts on the stability and integrity of the bluffer other natural resources.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on September 1,2011, at which time
written and oral evidence were presented. Based upon ail testimony, documantatien, personal inspection of the
property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true
and relevant and makes the following findings:
1. Town Law ~267-b(3~(b'~(IL Grant of the variances will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. Adjoining properties have structures get closer to the bluff
than this proposal. Several dwellings in this neighborhood have in-ground swimming pools in the rear yard with
non-conforming setbacks.
2. Town Law ~26%b(3)fb}(2). The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. However, the proposed location of the new dwelling and in-
ground swimming pool are being setback further than the existing slxuctures. The front yard of the property is
landscaped and due to the proposed location of the septic system and drywell, the proposed location is more
feasible for the applicant to pursue.
3. Town Law ~267-b(3)(b)O). The variances granted herein for the proposed dwelling and proposed in-ground
swimming pool are mathematically substantial requiting an 18% and 35% relaxation from the code, respectively.
However the proposed setbacks are greater than what presently exists and would bring the proposed structures into
more conformity with the code.
4. Town Law ~267-bO)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
proposed structures will result in a net decrease in lot coverage of approximately 3% and the required storm-water
management will be followed.
5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law ~267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a new dwelling and in-gro3md swimming pool while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman
(Chairperson), and duly carried, to
GRANT., the variance as applied for, and shown on the survey dated last revised March 29, 2011 prepared by Lisa
McQuilkin, LS.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a
possible denial by the Building Department cfa building permit, and may require a new application and public hearing before
the Zoning Board of Appeals.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicanl's diagrams or survey site
maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or
condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with the
LWRP provided the following:
If the action is approved to further Policy 5: Protect and Improve Water Quality in the Town of Southold
and Policy 6; Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is
recommended that the buffer be extended landward to the CEHA line.
LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with indigenous,
drought-tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation
shall be installed in sufficient densities to achieve 95% ground cover within two years of installation.
Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the
buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up
to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four-foot-wide
access path constructed of pervious material for access to the water body. [Added 12-15-2009 by L.L.
No. 15-2009]
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The existing site is characterized by swimming I~oI and dwelling located +37' and +65% respectively, from the bluff; a lawn that extends to the crest of the bluff'; an
antiquated sanitary system located a little more than 100 feet from the crest of bluff; and no drainage system to collect roof runoff The proposed project seeks to
remove these existing stmctares and to construct a new, smaller swimming pool located +65' from the crest of bluff and a new dwelling with a smaller footprint
located +82' from the crest of bluff; to install a drainage system of leaders, gutters, and drywells; to install an upgraded, SCDHS-apgroved sanitary system located
more than 150 feet from the crest of bluff; and to establish a 15-foot wide planted buffer along the top of the bluff in place of existing lawn. All proposed structures
will be located more than 140 feet from the surface waters and littoral zone wetlands of Long Island Sound.
The project design and incorporated mitigation measures thus provide the following environmental benefits: a) lot coverage by structures will be decreased by 735
square feet or approximately 3 percent of buildable land; b) wetlands setbacks will be increased and the minimum structural setback to the crest of bluff will
increase by approximately 28 feet or 75 percent; c) on-site septic treatment will be improved and located farther from surface waters through upgrade and relocation
of the sanitary system; d) the proposed drainage system will capture and recharge roof runoffto reduce surface water runoff; e) the quantity and quabty of surface
water runoffreaching the bluffwill be mitigated through establishment of approximately 1,500 square feet of naturally vegetated buffer in place of existing lawn,
which serves both as a sink and filter for stormwater runoffand contaminants contained therein; and f) the area of property treated with fertilizers, pesticides, and
insecticides will be reduced and set farther from surface walers by the proposed buffer. Therefore, the project will produce a net benefit to the environmental
conditions of the property and to the adjacent bluff and tidal waters and wetlands of the Town.

The project will protect and improve water quality and thus be consistent with Policy 5 through the establishment of a 15'-wide nontuff
buffer to be planted with native vegetation in place of existing maintained lawn area adjacent to the top of the bluff. The existing
naturally vegetated slope will remain undisturbed and continue to serve as a buffer adjacent to Long Island Sound. The surface water
runoff absorption capacity of the site will be increased not only by the replacement of lawn with this buffer but also via installation of a
drainage system of leaders, gutters, and drywells to capture and recharge roof runoff from the entire finished dwelling structure.

proposed project seeks to remove these existing structures and to construct a new, smaller swimming pool located +65' from the crest of bluff and a
new dwelling with a smaller footprint located +82' from the crest of bluff; to install a drainage system of leaders, gutters, and drywells; to install an
upgraded, SCDHS-approved sanitary system located more than 150 feet fi.om the crest of bluff; and to establish a 15-foot wide planted buffer along the
top of the bluffin place of existing lawn. All proposed structures will be located more than 140 feet from the surface waters and littoral zone wetlands
of Long Island Sound, and the project is located beyond the Tidal Wetlands jurisdiction of the New York State Department of State Coastal Resources
Division.
Although the newly proposed structures do not meet a 100-foot setback from the crest of bluff, the project design and incorporated mitigation measures
will produce a significant net benefit to the environmental conditions of the property and to the adjacent natural resources, including: a) lot coverage by
structures will be decreased by 735 square feet or approximately 3 percent of buildable land; b) wetlands setbacks will be increased and the minimum
structural setback to the crest of bluff will increase by approximately 28 feet or 75 percent; c) on-site septic treatment will be improved and located
farther from surface waters through upgrade and relocation of the sanitary system; d) the proposed drainage system will capture and recharge roof
runoff to reduce surface water runoff; e) the quantity and quality of surface water runoff reaching the bluffwill be mitigated through establishment of
approximately 1,500 square feet of naturally vegetated buffer in place of existing lawn, which serves both as a sink and filter for stormwatar runoff and
contaminants contained therein; and f) the area of property treated with fertilizers, pesticides, and insecticides will be reduced and set farther from
surface waters by the proposed buffer. Therefore, the project will be consistent with the Policy 6 goal of protecting and restoring the quality and
function of the Town of Southold's ecosystems.
