Both the armor stone erosion cant~ol and the deck repair work have been completed and are ·ow

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on Aut, ust
24, 2011, and in consideration of application fee in the sum of $500.00 paid by Nicholas Noyes and subject to
the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and
permits the following:
Wetland Permit and Coastal Erosion Permit to repair 600 square feet of wood
patio deck including existing perimeter bench and new post supported c~ible rail; and
as depicted on the site plan prepared by Docko, Inc., last dated April 25, 2011, and
stamped approved on August 24, 2011.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Nicholas Noyes, residing at Off Private Road, Fishers Island~ New York as part
of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittea
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of thc Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the TOwn of Southold.
That the said Board will be notified by the Permittee of the completiOn of the work
authorized. ;,
That the Permittee will obtain all other permits and consents that may l~e required
supplemental to this permit, which may be subject to revoke upon failth~ to Obtain same.

Dear Mr. Neilson:
The Board of Town Trustees took the following action dudng its regular meeting held on
Wednesday, August 24, 2011 regarding the above matter:
WHEREAS, Docko, Inc. on behalf of NICHOLAS NOYES applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town
Code, Coastal Erosion Hazard Areas, application dated August 1,2011, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 24, 2011, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 and
Chapter 111 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of NICHOLAS NOYES
to repair 600 square feet of wood patio deck including existing perimeter bench and new
post supported cable rail; and as depicted on the site plan prepared by Docko, Inc., last
dated April 25, 2011, and stamped approved on August 24, 2011.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Purpese: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there am aspects of
a project that am subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal
knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge

The proposed proiect is repairing an existing deck attached to the house. The view and vista of the

structural integrity of the without adversely impacting the natural features of the site.

wildlife habitat quality and this project will not degrade the habitat or the shoreline protection in any
way. If any shrubbery must be removed, it will be replaced to maintain a 10-foot non-turf buffer.

DECK REPAIR

GENERAL
The Noyes family owns property off East End Road located along the shore of
Chocomount Cove on Fishers Island. This project involves the repair of the existing, long-
standing deck as shown in the photographs and attached permit application drawings. All work is
landward of the apparent high water line, tidal wetlands vegetation and top of the bank. It is
anticipated that all work will be done from the land and by hand except possibly using a
gasoline-powered auger to dig the post holes.
The exposure is to the north and east and the site is subject to occasional waves and
flooding conditions depending on weather conditions and wind direction. The Noyes' property is
approximately 1.8 acres with a steep bank transitioning to wetlands at the shoreline. Shoreline
protection at this site has been reviewed during previous permit applications. The deck on the
north side of the house is in need of repairs. Beyond the deck there is a drop of about eight feet
from the yard to the toe of the bank. The slope is covered with junipers and yews and various
vegetation, not turf.
The attached narrative substantiates the scope of work and provides responses to various
concerns outlined in Local Law No. 6 2004, relating to new Chapter 97 "Wetlands and
Shoreline" of the Code of the Town of Southold.
REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW
The permittee acknowledges that the validity of this permit is or may be subject to the
approval of other governmental or municipal authorities.
The permittee does, by the acceptance of these permits, assume all responsibility for
operations undertaken pursuant to this permit, and shall take all precautions for the prevention of
injuries to persons and property resulting from such operations. By such acceptance, the
pennittee also agrees to indemnify and save harmless the Town of Southold and its officers.
The permittee gives consent to the Town and the NYS DEC, and their officers,
employees and agents to enter upon the premises where such operations are being conducted to
make such inspections to determine whether said operations are being conducted in conformity
with the permit.
The permittee will notify the Town of Southold, Board of Trustees as well as State and
Federal agencies in writing one week prior to initiation of any and all operations.

In response to Sub-section 2a, most of this project relates to modifications of shoreline
protection, and there are no dock facilities at the site and none are requested.
Upon receipt of the permit for this project, appropriate permit numbers will be
affixed to the most seaward face of the deck for identification from the water.

Completion of the proposed work will not encumber public passage along the
shore. It should be noted that the shore of Chocomount Cove represents a substantial
drop-off of terrain and there is very little passable foreshore landward of the house.
The foot traffic in this area is rare, if at all.
NYS DEC Tidal Wetlands Regulations - Sections 661.5 and 661.9
This project represents the repair of an existing deck at the Noyes property at the far south
west of quadrant of Chocomount Cove. New posts will support the deck in place as shown in the
application drawings. There is an area of tidal wetlands fringe vegetation approximately 30 feet north
of the deck, at the toe of the bank, and that vegetation will not be disturbed. Deck's at residential
properties on the waterfront are considered to be generally compatible use in an adjacent area (AA)
with a permit being required under Section 661.5(b) (1), 15 and 24.
This deck was repaired in the 1990's. Routine maintenance and replacement of damaged or
deteriorated decking has been on an "as needed" basis.
Under Section 661.9, the standards for issuance of permits of NYS DEC regulations, the
following are considered to be pertinent considerations.
The policies are created to preserve and protect tidal wetlands and prevent their despoilation
and destruction. Regulated activities will not have an undo adverse impact on the present or
potential value of the affected tidal wetlands.
This deck repair project is compatible with public health and welfare policies of the State and
a building permit for the repairs will be acquired prior to the start of work. Maintenance of the
deck is allowable under zoning regulations. It will maintain the same dimensions and
elevation as the long-standing structure, with a mil as necessary for safety.
The project complies with development restrictions contained in Section 661.6 as this work is
repair of an existing long-standing deck structure and is compatible with the use of the site,
zoning and the long-standing use of the site.
This project will not have an undo or adverse impact on the present or potential value of
nearby tidal wetlands vegetation or the stability of the bank.
Town of Southoid - Local Waterfront Revitalization Program
These application documents include a copy of the Federal Consistency Assessment Form
utilized for the New York State Coastal Management Program under the jurisdiction of the New York

State Department of State.~ll~he following policies from the Locaffil~terfront Revitalization Program
are appropriate.
Policy 2 -Water Dependent Uses - This project is to conduct routine repair work on fully functional
deck at this waterfront site. This deck is used for passive recreation and enjoyment of the waterfront
which is a legitimate water-dependent use.
Policy 5 - Use of Existing Developed Shorefront - This project will be primarily repair of a long-
standing deck, clear of sensitive habitat or tidal wetlands and maintain it to be safe and reliably usable
in all weather conditions.
Policy 7 - Significant Fish & Wildlife Habitat - Protection of significant fish and wildlife habitat has
been considered in the development of this project layout. Two feet or more of height will continue to
be maintained above bottom. The ground and the deck stops short of the bluff (bank). There will be
no change to the dimension, height or amount of structure which might affect fish habitat and special
wildlife or marsh habitat. The non-turf vegetated buffer at the bank will be retained or replaced as a
part of this project.
Policy 8 - Protection & Preservation of Habitat - Protection and preservation of habitat has also been
considered in this deck repair project, keeping the structure in the existing configuration, and will be
repaired consistent with standards of the industry and restrictions set forth in the Wetlands Law, No. 6,
2004 set forth by the Town of Southold.
Policy 11 - Minimize Damage to Natural Resources - The deck repair project will be conducted in
such a way so as to minimize damage to natural resources as identified in Policy 7 above by alignment,
footprint and elevation. There are no tidal wetlands at this project site and the tidal wetlands vegetation
further north will not be disturbed.
Policy 14 - No Measurable Increase in Flooding - This project consists of the repair of an open wood
post-supported deck that will in no way adversely affect water flow and circulation in the cove or
flooding potential of the area. Flood levels all around Fishers Island are dictated by water levels in
Long Island Sound, Fishers Island Sound and Block Island Sound and this structure will have no
adverse influence on those flood levels.
Policy 15 - No Dredging - Dredging is not required in this project.
SUMMARY
This project represents the repair of a long-standing, deck off the back side of the house
at the property of the Noyes family on Fishers Island. The shorefront protection in place has
existed for years, probably since the house was built in the 1960s.
This project complies with all applicable standards of Local Law No. 6, 2004, the Town
of Southold LWRP and the NYS DEC Tidal Wetlands and its approval is respectfully requested.
