Provide thirty-five (35) parking stalls at a minimum dimension of 9'x19' and off- street parking requirements pursuant to §280-77 in the Southold Town Code. 2. Add additional evergreens to the screening along the property line to the West. 3. Re-locate the dumpster site away from homes and somewhere in the Southeast corner of the parcel. 4. Pursuant to §172 of the Southold Town Code, provide the location, design and specifications of any and all outdoor lighting and indicate all lighting on site. 5. Show shade trees on the site plan to be planted as follows: two (2) trees on the East side of the driveway (just north of handicap spaces) and three (3) trees to the North of the proposed patio in line with Oregon Road. Trees will be Liberty Elm or Little Leaf Linden and will be 2"-3" caliper. 6. Replace proposed arborvitae around the proposed patio with Thuja plicata (Western red cedar). 7. Remove the proposed front double gate off the North side of the proposed patio. 8. Oregon Road must be Saw Cut to provide a clean line for this new pavement section and all new pavements within the Town owned R.O.W. must meet the minimum requirements of the highway specifications. This would include a 4" Lieb Vineyards PaRe Two June 30,2011 thick stone blend base, a 2.5" Asphalt Binder and 1.5" top wearing course between the existing line of pavement and the property line. 9. Grades and/or elevations must be included for the proposed patio to determine how the surface will be sloped in the direction of an adjacent storm drain. 10. Grades and/or elevations for new parking areas. At a minimum, provide top and bottom curb elevations as well as grate elevations to guarantee that proper pitch can be achieved. These elevations should be taken off of the existing finish floor elevation in the building to determine that adequate slope and pitch can be maintained in the parking area without flooding the building. 11. Hay bale and silt fencing should be indicated on the plan to prevent silt and/or construction debris from entering the Town R.O.W. Installation details must be shown on the plan to provide proper installation. 12. Provide a safe and adequate fire apparatus turnaround area in the proposed parking lot behind the existing building, and at the end of the access near the barn in the back of the property pursuant to Fire Apparatus Access Roads in Appendix D of the Fire Code of New York State. A driveway of this size must be able to support at least 75,000 pounds and include a "120 foot Hammerhead, 60 foot 'Y', or a 96 foot diameter cul de sac". 13. Provide guaranteed access to the existing head well that will produce a required minimum of 500 gallons per minute for fire apparatus use. Upon reviewing the Comprehensive Plan, it has been determined that this proposal is consistent with the goal of supporting and maintaining agriculture. The conversion of an existing agricultural building to a new agricultural use (tasting room) will be furthering this goal. However, there are several challenges for this location to operate as a retail tasting room, all of which can be ovemome if the operators limit the number and size of vehicles at the site that current accommodations allow. The location is not suitable for large events. While the overall size of this vineyard parcel is 13.6 acres, 12.7 acres are restricted by an easement held by the Town for development rights, leaving only 0.92 acres available for use of the tasting room and necessary requirements. As proposed, the limited site area does not allow for any additional overflow parking. The site also appears unsuited to accommodate buses and large limos, the parking of which is not recommended along Oregon Road. The Planning Board supports the area variance and the creation of a tasting room at this location if the applicant will agree to refrain from conducting events that attract or invite more vehicles than the site can safely accommodate. The building has a much larger occupancy than is currently proposed. Our concern is Lieb Vines, LLC PaRe Two May 10, 2011 that the large storage room may be used for events in the future and that there isn't enough available parking on site. This is not to say that no events can be held at this site. Events where attendees are given the option to park elsewhere and are shuttled to the site is one way to control the number of vehicles at the site. Another concern is the proximity of nearby residences. Again, this concern can be alleviated by some control over the number and size of vehicles, and a limit on the number, size, and types of non-agricultural activities that are conducted at the site (e.g. weddings, private parties, amplified music, operating late in the evening, etc.). This is a general term inclusive of all other terms such as fire land, Public Street, Private Street, parking lot lane and access roadway. (F202) 3. Recommendations: a. After the elimination of embankment behind building, it is necessary to create a safe turn around area for fire apparatus in the proposed parking lot. b. Guaranteed access to existing head well located behind main building (currently for irrigation use), as long as it provided a minimum of 500 gallons per minute. B. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, the proposed action is CONSISTENT with the LWRP. -This area is not included and identified as an archeo-sensitive area (NY State Historic Preservation Office GIS-Public Access (2011)). Recommendation: None D. Town Engineer 1. The site plan indicates that the existing curb cut will be modified to accommodate the proposed site access to the expanded parking area. Oregon Road must be Saw Cut to provide a clean line for this new pavement section and all new pavements within the Town owned R.O.W. must meet the minimum requirements of the Highway Specifications. This would include a 4" thick stone blend base, a 2.5" Asphalt Binder and a 1.5" top wearing course between the existing line of pavement and the property line. 2. The proposed drainage calculations appear to meet the minimum requirement of Chapter 236 for Storm Water management. Grades and/or elevations have not been established for new patio. Will this surface be sloped toward the adjacent storm drain? If it does not, a trench drain or some other means must be installed to collect storm water and direct it to the adjacent drain. Grades and/or elevations have not been established for the new parking areas. At a minimum, it'is recommended that top and bottom curb elevations as well as top of grate elevations should be shown to guarantee that proper pitch can be achieved. These elevations should be taken off of the existing finish floor elevation in the building to determine that adequate slope and pitch can be maintained in the parking area without flooding the building. Hay bale and silt fencing should be indicated on the plan to prevent silt and/or construction debris from entering the Town R.O.W. Installation details must be shown on the plan to provide proper installation. 3 V: Staff Recommendations 1. The proposed location of the dumpster may create a disturbance with the neighbors to the West. It should be moved to a location away from neighboring residences, and screened from view of the road. 2. Lack of screening/buffer on West side of property from multiple dwellings. A more effective buffer may provide better screening with respect to the size and use of the building. -Additional landscaping may be beneficial/necessary Oversized parking space is not any longer than the standard stalls, are the intentions to use that for oversized vehicles such as buses or limos? If so, its placement should be changed and possibly the lengthened. It is a difficult placement for larger vehicles to get in and out of safely, assuming all 28 spots are full. The large storage area raises some concerns as far as future use. The existing storage area that is proposed to remain as such comprises the majority of the square footage of the building. It is possible this area could be used for events in the future, in which case the parking on-site is not adequate, and parking on the street is neither feasible nor desirable for the following reasons: This section of Oregon Road (to the north across the road and the adjoining vineyard) is considered a "key view" area to the scenic landscape of Southold Town as displayed and described in the "Scenic SouthoM Corridor Management Plan" of 2001.* · Oregon Road, especially in this area, is not capable of handling road parking due to its narrow construction and banked shoulders. · Additional off-street parking is recommended for any expansion of the tasting room, or any special events. The proposed septic system appears, from the notations on the plan, to be capable of handling the proposed sanitary uses, as well as a commercial kitchen. -It should be addressed whether there are intentions of installing a commercial kitchen in the future. -§280-13C(10) Wineries may not have a commercial kitchen as an accessory use but may have a noncommercial kitchen facility for private use by employees. The three(3) proposed double entry gates off of the patio lead to the parking lot, front yard and side yard. What will the purpose be of the gates to the front and side yard? It is possible the proposed gates may lead to outdoor seating and/or tables that may cause a disturbance to neighbors and should be considered.
