dated April 5, 2011, Karl Robert Raacke, residing at 192
Mill Road, Olivebridge, New York 12461, and John Rose,
residing at 1705 Laurelwood Drive, Laurel, New York
11948, as Trustees; and THE BARBAItA M. RAACKE
XRREV0CABLE TRUST, under agreement dated April 5, 2~11,

WXTNESSETH, that the party of the first part, in
consideration of Zero Dollars and other valuable
consideration paid by the party of the second part, does
hereby grant and release quitclaim unto the party of the
second part, the heirs or successors and assigns of the
party of the second part forever, all of the party of
the first part's interest in

MADE A PART HEREOF
Together with all right, title and interest, if any, of
the party oi the first part in and to any streets and
roads abutting the above-described premises to the
center lines thereof;
Together with the appurtenances and all the estate and
rights of the party of the first part in and to said
premises;
To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and
assigns of the partyof the second part forever.
And the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises have been encumbered in any
way whatever, except as aforesaid.
And the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for
the purpose of paying the cost of improvement and will
apply the same first to the payment of the cost of the
improvement before using any part of the total of the
same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of
this indenture so requires.

All that certain plot, piece or parcel of land lying and being in
the Village of Mattituck, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows=
BEGINNING at a point on the southerly side of Westphalia Road at
the northeast corner of premises herein described and at the
northwest corner of a 50-foot private right of way and which point
of beginning is distant 1540.45 feet westerly from the westerly
side of Youngs Avenue;
RUNNING THENCE along the westerly side of the 50-foot private right
of way South 15 degrees 55 minutes 20 seconds West 200 feet to land
of C.A. Bennett Estate; THENCE along said last ~ntioned land the
following 3 courses and distances:
(1) North 74 degrees 04 minutes 40 seconds West 155.26 feet;
(2) North 47 degrees 06 minutes 20 seconds East 58.44 feet;
(3) North 15 degrees 55 minutes 20 seconds East 150 feet to the
southerly side of westphalia Road;
THENCE along the southerly side of westphalia Road, South 74

TOGETHER WiTH a right of way 50 feet in width along the easterly

the right to dedicate said right of way to the Town of Southold for
highway purposes. Until such dedication, however, nothing herein

THENCE along land conveyed or about to be conveyed by the party of
the first part to Harrison, South 15 degrees, 55 m/nutes 20 seconds
west, 442.75 feet;
THENCE along land conveyed or about to be conveyed by the party of
the first part to Harold R. Reeve & Sons, Inc., North 29 degrees,
22 minutes 50 seconds West, 287.87 feet;
THENCE along land of LeValley, North 47 degrees, 06 minutes 20

BEING AND INTENDED TO BE the same premises conveyed to the Grantor
by Deed dated September 30, 1994 and recorded in the Suffolk county
Clerk's Office on October 4, 1994 in Liber 11696 page 856, the
Grantor being the same person described as the Grantee in said
Deed.
AND EXCEPTING THE PARCEL DESCRXBED BELOW FROM THE ABOVE-REFERENCED

and improvements thereon erected, situate, lying and being at

New York, being bounded and described as follows:
BEGINNING at a point which is the northerly point of a triangular
parcel of land about to be described herein, said point being the
following three courses and distances from a n~)nument located on
the southerly side of Westphalia Avenue 9Road) at the northwesterly
corner of land of Barbara Raacke and the northeasterly corner of
land of Monsell;

monument located at the existing northeasterly corner of land
of Barbara Raacke and the existing northwesterly corner of
land of Robert Raacke and Barbara Raacke;

mentioned land 150.00 feet to a monument; and

said last mentioned land 26.48 feet to the said point of

page 634, the Grantor being the same person described as the
Grantee in said Deed.
AND ADDING PARCEL III TO THE ABOVE-REFERENCED PARCELS X MID XZ:

BEGINNING at a monument located on the southerly side of westphalia
Avenue (Road) at the existing northwesterly corner of land of
Robert Raacke and Barbara Raacke and the existing northeasterly
corner of land of Barbara Raacke, which point is distant 1665.45
feet westerly from the corner formed by the intersection of the
southerly side of Westphalia Avenue (Road) with the westerly side
of Young's Avenue;
RUNNING THENCE along land presently of Robert Raacke and Barbara
Raacke the following two (2) courses and distances:
(i) South 15 degrees 55 minutes 20 seconds West 150.00 feet to a
monument; and
(2) South 47 degrees 06 m/nutes 20 seconds West 26.48 feet to a

a deed dated September 30, 1994 and recorded in the Suffolk County
Clerk's Office on October 4, 1994 in. Liber 11696 page 856 (SCTM

Deed dated May 29, 2003 and recorded in the Suffolk County Clerk's
Office on June 4, 2003 in Liber D00012254 page 635, the Grantor
