seconds East, 146 feet to land now or formerly of Gates;
THENCE along said land now or formerly of Gates the following two (2) courses and distances:
l.South 69 degrees 34 minutes West, 48.32 feet;
2.South 22 degrees 34 minutes 30 seconds East, 16.81 feet to the ordinary high water mark of
Town Creek;
THENCE along said ordinary high water mark of Town Creek as it meanders on a tie line course
of South 24 degrees 23 minutes 40 seconds West, a distance of 212.38 feet to land now or
formerly of Doebler;
THENCE along said last mentioned land, North 63 degrees 13 minutes 30 seconds West, 215
feet to a concrete monument and land now or formerly of Joost;
THENCE along said last mentioned land, North 8 degrees 25 minutes 50 seconds East, 240,13
feet to a concrete monument and land now or formerly of Edson;

TOGETHER with all right, title and intex~st, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and ali the estate and fights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatevex, except as
aforesaid.
AND the party of the first part, in complianc~ with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such considexation as a trust fund to be applied first for the purpose of paying the cost
of the improvement and wilt apply the same first to the payment of thc cost of thc improvement
before using any part of the total of the same for any other purpose.
The word "parry" shall be construed as if it read "parties" whenever th~ sense of this indenture so
requires.
