CHAPMAN and WENDY CHAPMAN, his wife, both residing at 28 Joss Way, Millington, New Jersey 07946 SOT {J Lg I M = FM party of second part, 0 In a WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying andbeingioxM= at Indian Neck, near Peconic, County of Suffolk and State of New York bounded and described as follows: BEGINNING at a monument set at the southwesterly corner of the premises about to be described, said monument being distant 424.3 feet northerly from a granite monument in the northerly side of Indian Neck Road; RUNNING THENCE North 3 degrees 48 minutes 30 seconds East 308.84 feet to the shore of Richmonds Creek; THENCE on a tie line course a distance of North 84 degrees 11 minutes 40 seconds East along Richmonds Creek 51.22 feet to land now or formerly of Lang; THENCE South 3 degrees 48 minutes 30 seconds East along last mentioned land 306.02 feet to the southeasterly corner of the premises hereby conveyed; THENCE South 81 degrees 07 minutes 10 seconds West 51.76 feet to the monument along the point or place of BEGINNING. TOGETHER WITH A RIGHT OF WAY for passage by foot and with vehicles over a strip of land ten feet in width along the westerly side of land formerly of Mary L. Wiles and adjoining lands now or formelry of Harry J. Smith from the premises hereby conveyed to Indian Neck Road. BEING AND INTENDED TO BE the same premises conveyed to the grantors herein by deed dated July 8, 1987 and recorded in the Office of the Suffolk County Clerk on July 31, 1987 in Liber 10380 cp. 164. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever,except as aforesaid. AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
