4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.

of Code Compliance from architect or engineer responsible for the building.
6. Submit Pl.a~ing Board Approval of completed site plan requirements.

Dear Gary,
in regards to the new Garage structure at the Miller Residence, the second floor "Loft", is a
"Non Habitable" space. The second floor of the Garage has sloped ceilings and a total
area of 753 square feet. The portion of the second floor "Loft", that has a vertical height
more than 7 feet, has an area of 280 square feet, which is 37.2% of the total square
footage of the second floor.
According to the 2010 Residential (Building) Code of New York State, Section R305
Ceiling Height, Paragraph R.305.1 Minimum height, Hab'table rooms, hallways, corridors,
bathrooms, toilet rooms, laundry rooms and basements shall have a ceiling height of not
less than 7 feet (2134 mm). The required height shall be measured from the finish floor to
the lowest projection from the ceiling."
Exception #3 "For rooms with sloped ceilings, at least 50 percent of the required floor area
of the room must have a ceiling height of at least 7 feet (2134 mm) and no portion of the
required floor area may have a ceiling height of less than 5 feet (1 524 mm)."
Since the second floor "Loft" space has an area of 37.2% of the total floor area, higher
than 7 feet high, the second floor "Loft" cannot be defined as "Habitable".

In regards to the new outdoor shower area - trellis structure, that's attached to the
"Cottage" and the Pool Equipment enclosure. Both structures have been engineered and
built to be rated for 120 mph. wind load, using the requirements of the 2010 Building Code
of New York State, Section 2304.9 - Connections and Fasteners and Section 2304.9.6 -
Load Path.
