Dear Mr. Zevits,
Please disregard my previous letter, dated July 17, 2008, stating that the Department of State has closed the
file and terminated the review of your proposal, as I have been informed that the Army Corps of Engineers
has in fact received your application.
The Department of State received your modified proposal for the above referenced proposal on July 24,
2008. The modified proposal is depicted on the revised plan dated June 18, 2008 and approved by the
NYSDEC on July I I, 2008. The revised plan includes reducing the originally proposed 73'jetty to 42' in
length, and the elevation from 3' to 18" on the down-drift side.
The Department of State has determined that this proposed activity, which has been modified to be
consistent with the New York Coastal Management Program as expressed in the Town of Southold's Local
Waterfront Revitalization Program, meets the Department's general consistency concurrence criteria.
Therefore, further review of the proposed activity by the Department of State, and Department's concurrence
with an individual consistency certification, are not required.

LWRP CONSISTENCY ASSESSMENT FORM

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or 'bo", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency

The Department of State has received correspondence from the Army Corps of Engineers (COE) on
Thursday, July 17, 2008, indicating that you do not have a permit application submitted to the U.S. Army
Corps of Engineers for the above matter. The Department has, therefore, terminated its review of your
consistency certification for this proposal. This action on the part of the Department of State is not and
should not be construed as or presumed to be a consistency decision by this Department pursuant to 15 CFR
Parts 930.62 or 930.63.
Please disregard my request for a copy the revised proposal as it is no longer necessary. Although the
proposal, as revised, may be consistent with the New York State Coastal Management Program and may meet
the criteria for a general concurrence, it cannot be reviewed by the Department of State without a permit
application concurrently under review with the U.S. Army Corps of Engineers.
If you re-submit a new consistency certification for this proposal, a copy of the federal application for
authorization and a new Federal Consistency Assessment Form and certification should be provided to the

Dear Mr. Zevits,
The Department of State received your Federal Consistency Assessment Form and certification and
supporting information regarding the above matter on January 28, 2008 and began its review
pursuant to 15 CFR Part 930, Subpart D on that date.
We cannot complete our consistency review for this project until we coordinate our findings with
the involved Federal, State and local agencies, and the Public Notice issued by the Department of
State has expired, and comments, if any, are received.
The Waterfront Revitalization and Coastal Resources Act (Article 42 of the NYS Executive Law,
19 NYCRR Part 600) requires that activities proposed to be undertaken in the coastal area of a
municipality with an approved Local Waterfront Revitalization Program (LWRP) be consistent with,
and advance, the policies and purposes of the LWRP. Although the Department has not yet completed
our consistency review, the proposed activity does not appear to be consistent with the New York
State Coastal Management Program (CMP) as expressed in the Town of Southold's LWRP,
specifically Policy 4: Minimize loss of life, structures, and natural resources from flooding and
erosion. Policy 4 states "Erosion control structures can be both beneficial and detrimental. While
they may protect the immediate land behind the structure, they often contribute to erosion both on
and off the site due to poor design and siting and lack ofdowndrift remediation of sand. Poor design
and siting has resulted in accelerated erosion, aesthetic impairments, loss of public recreational
resources, loss of valuable marine and wetland habitats, and water quality degradation." Policy
standard 4.1 (C)(1) suggests "Enhance existing natural protective features and processes, and use
non-structural measures which have a reasonable probability of managing erosion...(c) Provide for
sand by-passing at engineered inlets or other shore protection structures to maintain coastal

processes and protective capabilities of beaches" and 4.1 (D) states "Use hard structural erosion
protection measures for control of erosion only where...(5) The proposed hard structural erosion
protection measures are (a) limited to the minimum scale necessary."
Given the foregoing, the Department preliminarily intends to object to the consistency certification
provided for the activity as proposed. If the Department does not concur with the consistency
certification provided for this proposed activity, the consistency provisions of the federal Coastal
Zone Management Act prohibit federal agency authorization of the activity, unless the Department's
objection is overridden on appeal to the U.S. Secretary of Commerce. Such an appeal must be based
on one or both of the grounds that the proposed activity is consistent with the objectives or purposes
of the Federal Coastal Zone Management Act, or is necessary in the interest of national security.
The Department strongly r~ecommends that you modify the proposed plans to reduce the length of the
jetty to meet MLW and the elevation reduced to 12" above grade (low-sill) on the down drift side
to comply with Policy 4 of the Town of Southold LWRP, or withdraw your consistency certification.

Upon review of the photographic evidence presented to the
Trustee Office it is my opinion that the original groin
construction on the Joseph Zevists property at
SCTM 91000-88-6-18.1 pre-dates the Towns claim to underwater
jurisdiction under Chapter 97 of the Town Code.
Consequently the Trustees office concludes that no violation
exists for this structure.
By copy of this memo the Bay Constable is requested to the take
photographs and measurements of the existing groins.
Mr. Zevits has been informed that new groin construction will
require a Chapter 97 permit from this office and that any and
all repairs to the groins must dimensionally & materially
conform to the existing as built structures.
Upon receipt of the Bay Constables field report, photographs and
measurements, this complaint will be deemed satisfactorily
answered by the Trustee Office.

We have completed our review of your correspondence dated 5 March 1980
concerning the need for a Department of the Army permit to repair the
jetties in Little Peconic Bay at Southold, Suffolk County, New York.
From the material presented, it appears that the work ia a repair
and/or replacement in-kind to a previously permitted or exempted structure
therefore, a Department of the Army permit will not be required provided
that the proposed work will be executed in such a manner that there will
be no additional encroachment into the waterway (beyond the existing
structure) and that no wettands or marsh areas will be disturbed.
Care should be taken so that construction materials (including debris) do
not enter the waterway and become a source of drift.
Appropriate State and local authorities should be contacted in order to
determine the extent of their jurisdiction in this matter.
