Pursuant to Section 617.13 of the N.Y.S. Department of
Environmental Conservation Act, Article 8 of the Environmental
Conservation Law, and Section 44-4 of the Southold Town Code,
notice is hereby given that the Southold Town Board of Appeals
has determined that the subject project as proposed in this
appeal application is hereby classified as a Type II Action,
not having a significant adverse effect upon the environment
for the following reason(s):
An Environmental Assessment in the Short Form has been
submitted which indicates that no significant adverse effects
were likely to occur should this project be implemented as
planned.
This declaration should not be considered a determination
made for any other department or agency which may also be in-
volved, nor for any other project not covered by the subject
appeal application.

is requested for the reason that Applicant seeks to renovate an existing barn with an
insufficient side yard as shown on the annexed survey into a residence

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or ur{neces-
sary HARDSHIP because Applicant seeks to convert an existing barn into a residence.
The said barn has an insufficient side yard to the West. It would be impracticable
and: a financial hardship to the applicant to have to move the barn in order to
provide a sufficient side y~rd.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because the barn is already on the subject
premises and has been for a long time. It is the intention of the applicant to
renovate the barn into a one family residence and the applicant intends to use the
westerly portion of the barn as a garage.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the barn is already in existance and the granting
of the Variance would not change the character of the neighborhood.
